11/26/1984 - Regular - MinutesPort Orchard, Washington November 26, 1984 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill, Councilmembers present: Clauson, Wilson, Geiger, Miller, Grosso and Grable. Also present: Attorney McCluskey, Police Chief Mathews, City Engineer Curles, Fire Chief Snow, City Clerk bower and City Administrative Assistnat Kernan. Councilman Childress excused. Councilman Grable led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grosso, seconded by Councilman Clauson and carried, Council approved the November 13, 1984 minutes, as circulated. Jim Lambert, Manager of Diamond Parking in Kitsap County presented proposal to manage City parking lots. Mayor Weatherill took matter under advisement for Council consideration. At 7:45 P.M. City Clerk opened and read aloud the following three bids received in response to Call for Bids for Gravel Road Construction. Bids read as follows: Net Bid Price 1. Bruhn Construction, Inc.$6,632.50 (bid bond attached) 2. Nordby Construction 4,596.50 (bid bond attached) 3. James Ryan Construction 7,418.12 (bid bond attached) Engineer's Estimate 6,180.00 Councilman Wilson moved to refer bids received for "Gravel Road Construction" to the City Engineer and Street/Alley Committee for evaluation and action; Councilwoman Miller seconded and motion carried. Complaint submitted by Ralph Rummel; 2381 South Flower Street was assigned to the Street/Alley Committee for review. Councilman Grosso moved to adopt proposed Ordinance No. 1298 amending Ordinance No. 907 S10 known as Kitsap County Humane Society -impounding authority (POMC Chapter 7.08) providing for Fur, Fin and Feathers Society, a non-profit corporation, seconded by Councilwoman Miller.:.:;.. Mrs. Barringer, President Fur, Fin and Feathers requested City provide for this organization as a "shelter" under City jurisdiction. Councilman Wilson moved to amend motion to approve proposed Ordinance No. 1298 by deleting the words "and operations", seconded by Councilman Geiger and motion failed with two ayes and four nays. Councilmembers Grable, Grosso, Miller and Geiger voting nay. Original motion as presented to adopt proposed Ordinance No. 1298 to provide for Fur, Fin and Feathers Society failed unanimously. Councilman Grosso moved to remove Ordinance No. 1297 from the table; Councilman Geiger seconded and motion carried. November 26, 1984 Page Two Motion to approve proposed Ordinance'No. 1297 as presented November 13, 1984 Council meeting by Councilman Grosso failed unanimously. On motion by Councilman Grosso, seconded by Councilman Clauson, Council set December 10, 1984; 8:00 P.M. as date and time of Public Hearing relative to application for Special Use Permit as submitted by Marlys Recknagle requesting to locate a beauty shop at 198 Fremont. At 9:00 P.M. Mayor called for recess with meeting'_to.reconvene at. 9:15 P.M. Municipal Court Judge Dolan requested Council reconsider previous motion to not move the Court to the old library building/736 Prospect and he outlined the need to move due to inadequate Court facilities such as inadequate Court office space; no private conference space and inadequate phone lines. Councilman Geiger moved to authorize City Engineer to proceed with the remodeling of old library/736 Prospect for Court purposes; Councilman Grable seconded and motion carried with 5 ayes, 1 nay. Councilmembers Grable, Grosso, Miller, Geiger and;.Wilson'voting aye. and Councilman Clauson voting nay. City Attorney McCluskey reported on the Bontrager case stating the City is not allowed to give a'".gift" above and beyond the"City`s obligation. Council requested City Attorney to further research coverage for volunteer firemen and the legality of establishing a fund for Volunteer Emergencies. Councilman Wilson moved to set December 10, 1984; 8:15 P.M. as date and time of Public Hearing relative to request for modification of a Special Use Permit which was issued to Robert Schlaefli on December 27, 1982. Request is to allow deletion of a requirement (Resolution No. 1285) for construction of an upper parking lot as shown on site plan (623 Dwight Street). Councilman Clauson moved to continue matter of rescinding approval of "Vacation of a portion of Morton Street" until the next Council meeting (held over from 11/13/84 meeting), seconded by Councilman Grosso and motion carried. Councilman Geiger moved to authorize payment of the bills in the amount of $649,711.58 (Warrant No. 4,604-4,649),-seconded by Councilwoman Miller and carried. Councilman Geiger moved to authorize City Engineer remove trees from vicinity of Port Orchard Carpet Store; Councilman Grosso seconded and motion carried. Councilman Grosso moved to allow Mayor to sign contract with Kasprinsin Design Group regarding Waterfront Walkway at a cost of $7,000; Councilman Geiger seconded and motion carried. Councilman Geiger moved to allow Downtown Merchants to affix a Christmas tree to the totem pole on December 1, 1984; Councilman Clauson seconded and motion carried. Councilman Grosso moved to authorize Mayor to sign purchase agreement allowing purchase of computer hardware on State Contract for Police Department; Councilman Clauson seconded and motion carried. ",.November 26, 1984 Page Three Councilman Clauson moved to allow closure of Bay Street from Kitsap Street to the Dairy Queen, December 5, 1984, 4:00 P.M.-4:15 P.M. to allow a "parade" honoring South Kitsap High School football players; Councilwoman Miller seconded and motion carried. City Clerk informed Council that "Automated Records Management System" (police computer software) is being readvertised with Bid Opening scheduled for December 10, 11:00 A.M. Bid received at November 13, 1984 meeting was disqualified due to non-conformance to specifications. On request of Councilman Clauson, Mayor Weatherill called for Executive Session to discuss personnel matters (10:50 P.M.) At 11:00 P.M. Mayor called Council to regular session. Councilman Geiger moved to authorize longevity pay for all City employees; Councilwoman Miller seconded and motion -carried. Councilman Clauson moved to abide by non -uniformed contract (which expired June 30, 1984) until a new contract is ratified; Councilman Grosso seconded and motion carried.
