12/26/1984 - Regular - Minutes.Port Orchard, Washington December 26, 1984 Council of the City of Port Orchard, Washington, called to regular session by Mayor Pro Tempore Grosso. Mayor Weatherill was excused. Councilmembers present: Clauson, Childress, Wilson, Geiger, Miller and Grable. Also present: Attorney McCluskey, Police Sergeant Eoflin, City Engineer Curles, Deputy Eire Chief Wernet, City Clerk Hower and City Administrative Assistant Kernan. Councilman Wilson led the audience and Council in the Pledge of Allegiance. On motion by Councilman Grable, seconded by Councilman Clauson and carried, Council approve& the minutes of the December 10, 1984 . meeting as circulated. Councilman Wilson moved to. extend the contract with Kitsap County for use of Detention/Incarceration facilities January 1, 1985 - December 31, 1985, seconded by Councilman Clauson and carried. Councilman Geiger moved to adopt Ordinance No. 1300 amending the budget for the year 1984 and ordering appropriation of funds, seconded by Councilman Childress and carried. Councilman Geiger moved to adopt Resolution No. 1371 authorizing segregation of properties in accordance with Section 35.44.410 RCW ULID assessment as requested by Earl L. Green, seconded by Councilwoman Miller and carried. 0 Councilman Clauson moved to adopt Resolution No. 1372 approving issuance of Special Use Permit to Marlys Recknagle for allowing a beauty shop to be located at 198 Tremont Street, seconded by Councilman Wilson and carried. Councilman Geiger moved to adopt Resolution No..1373 authorizing segregation of properties in accordance with Section 35.44.410 RCW ULID assessment as requested by Lloyd'(Dutch) Davis, seconded by Councilwoman Miller and carried. On motion by Councilwoman Miller, seconded by Councilman Grable and carried, Council confirmed Mayor Weatherill's appointment of Al Mares to the Civil Service Commission for a six year term, effective January 1, 1985. .Mr.,Mares.will replace Art Mikelsen. Councilman Geiger moved to inform'Mr. Gary Deal that the City would like to investigate sources for potential funds to purchase his waterfront property for parks purposes, seconded by Councilman Clauson and carried. Page Itwo December 26, 1984 Councilman Geiger moved to reject proposed animal control ordinance, seconded by Councilman Wilson and carried. Council discussed comparing existing animal control ordinance and proposed items relative to animal control matters. Councilman Clauson moved to authorize City Engineer to draft a resolution requesting the Department of Natural Resources rescind the easement granted to the City.of Port Orchard to facilitate Port of Bremerton moorage project, seconded by Councilman Grable and carried. City Attorney McCluskey summarized status of the.following pending litigation: (1) Mathew Haynes case: a. Boy's attorney filed appeal stating amount of verdict was not high enough. (this attorney has agreed for settlement with driver and drivers insurance company for the drivers policy limits -appeal dismissed) b. Parent's attorney filed appeal claiming City should not have been released by jury (appeal close to settlement) c. City vs. Puget Power based on franchise agreement.wi.th,Puget Power. (2) Claim which was filed few years ago relative to matter ' involving Building Department and some house which involved the City and the Veterans Administration -for lack of action on part of the plaintif the Court Clerk's office has closed dismissed claim. On motion by Councilman Geiger, seconded by Councilman Clauson Council unanimously authorized payment of the bills in the amount of $81,035.15 (Warrant No. 04726-04782) and the November payroll in the amount of $118,514.20 (Warrant No..103828-103976).
