Council of the City of Port Orchard, Washington -called to order `by .
Mayor L. Weatherill. Council members present: Clauson, Childress,
Wilson, Geiger, Miller, Grosso and Grable,':Also present: Attorney`
McCluskey, City Clerk Lloyd, Interim..Police,Chief Mathews, City,
Engineer Curles and.Fire Chief Snow.
Councilman Clauson led the Council arid 'a'udience_.in the Pledge of
Allegiance.
On motion by Councilman Geiger, seconded and'carried, Council
approved the minutes of the April 23-24,1984,,mee.ting as.mcircuIated
Mayor Weatherill opened Public Hearing'relat'ive to application for -
a Preliminary Plat located at the,West end of Shamrock Lane as
submitted by S.R.V. Corporation.
Mayor Weatherill requested public input for, -or against- application
for Preliminary Plat at this time. -
D. Alson VanderStaay, applicant, spoke in favor of approval of
application and responded to:questions from Councilmembers
On motion by Councilman Miller, seconded and carried,- Council
approved application submitted:by S.R.V. Corporation for Preliminary
Plat to be known as "STETSON'.', a residential subdivision, comprised
of eight single family lots on '4.10,7` acres, --located :a't the ;;West end .
of Shamrock Lane. (Legal description -Attachment No.'1)(Planning
Commission finding ,of facts` and recommend,a,t,ion-Attachment' No:; 2) .
Mayor Weatherill closed Public Hearing
Letter -from Michael H. Moger,'offeri-ng`to selI'the '.City two parcels
of property on Mitchell'Avenue.- north' ofv "Ni tchel 1,'Street' Shed" was
addressed. Councilman Grosso questioned if sale.pr.-ice.i.s based upon,`
an appraisal. Mr. Moger informed Council no'appraisal has-been
done on this property. The $27,500. price quoted in writing --is '
based upon.evaluation by, three..independent'r:ealtors.
On motion by Councilman Grosso, seconded.and'carrie.d,,.-Council referred
Mr. Moger's offer to sell his property to .the City -Building and
Property Committee for recommendation
On motion'by Councilman Geiger, seconded and_'car,ried,, Council
approved Ordinance No. 1271, amending' Ordinance No. 844 increasing'x
fund balance of Advance Travel Expense Revolving Fund from'Two
Hundred and Fifty Dollars. ($250) to Five; Hundred-'Doilars.($500)
Councilman Grosso moved to approve Resolution No.',1356 authorizing
cancel 1atation of Claim Fund Warrant No's 219, 459 and 988 in the;..
combined total amount of Thirty-four Dollars and!T-wenty-nine Cents,
($34.29), seconded and carried.
On motion by Councilman Geiger, seconded and ca.rr-ied, Council
rescheduled the regular City Council meeting of May-.28, 1984�to
May 29, 1984 due to legal holiday.
On motion by Councilman Geiger, seconded -and carried, Council set
May 29, 1984 at 8:00 P.M. as date of Public Hearing -on application.-::,:_'.'
for Special Use Permit as submitted by,James...A, Sullivan.:

Councilman Geiger moved to set'May 29, 1984 as date of Public
Hearing relative to application for Special Use Permit submitted
by James A. Sullivan, Mr. Sullivan is requesting authorization
to utilize an existing building, located at 207 Rockwell, as a
professional office with on site client service, by.'appointment
only.
Gary Tomasch, Cedar Heights Junior High Air Fair, requested funding '
support to purchase paint for A-4 Skyhawk Navy Fighter Jet which
the school is receiving from the United States Navy.
On motion by Councilman Geiger, seconded an.d carried, Council
allocated approximately $250. from Community -Events Fund to
purchase paint for Cedar Heights.Junior High A-4 Skyhawk Navy
Fighter Jet.
At 8:00 P.M. Mayor Weatherill announced.time for bid opening on,
the follow Call for Bid items:
1. "Sale of the Kendall. -Water Tanks"
2 "Purchase of Utility Truck"
Councilman Clauson informed 'Mayor that a relative:has.submitted
a bid on the Kendall Water Tanks and requested to be excused.::-.
Mayor Weatherill-excused Councilman Clauson'from.'this-matter.
Deputy Clerk opened and real alou,.d two.bids received as follows
for sale of Kendall Water~ Tanks_:
1. A-1 Auto Wrecking $11.00 net
2. Eldorado Hills, Inc. $1,000.00 net
Councilman Grosso moved to award bid for sale of Kendall Water
Tanks as per specifications to Eldorado Hills, Inc.' -for amount of
$1,000.00 (net), contingent upon approval by City Engineer,.seconded
and carried.
Two bids received for purchase of Utility Truck'as per specifications
were opened and read aloud by.Deputy Clerk:
1. Utelco $11,223.00 net.
2. Capital Chevrolet $10,146..59 net
On motion by Councilman Miller, seconded and carried, Council
referred bids for purchase of Utility Truck to City Engineer, with
authority to award or reject the bidding.
On motion by Councilman Geiger,'seconded.and carried, Council
approved Ordinance No. 1273 creating a fund to be known as "State
Land Purchase Trust Fund" for the handling of payments into an
escrow account as set forth by contract with Washington State
Veterans Affairs to purchase Joint Sewer Treatment Plant property.
Mayor Weatherill addressed letter from Tom'Sapp, a junior at South
Kitsap High School. Tom is an active participant in the wrestling
program and has placed third in the State Tournament. He has been
chosen to go to Japan with the Cultural Exchange Program. Mr. Sapp
has requested to be allowed the honor of presenting 'a "Key to.the.
City(of Port Orchard to his eight host families ltn""Japan.....
Councilman Miller moved to authorize Community Event Fund monies for.
purchase of eight "Keys to the City of Port Orchard" -to be presented
by Tom Sapp to eight host,'Japanese. f;ami l ies -wi th 'the Cultural Exchange
Program.
On motion by Councilman Miller, seconded and carried, Council
approved Ordinance No. 1274 declaring the need for condemnation -
of parcels of land in and through certain real property for the
purpose of constructing the.Port Orchard By -Pass.

City Attorney McCloskey presented proposed ordinance to amend
Chapter 7.04 of the Port Orchard Municipal Code dealing with
animal control.
After much discussion, Councilman Miller'moved to table proposed
animal control ordinance for further consideration, seconded and
carried.
Councilman Grosso moved to adopt Ordinance No. 1275, amendina
Ordinance No._ relative to fire hydrant installation, seconded
and carried. ��
Councilman Geiger moved to remove proposed mobile home ordinance
from the table. Motion died for lack of second.
City Attorney McCloskey reported a protest has been received from
an attorney representing Mr. Schwartz relevant to condemnation
proceedings against property located at 810 Bay Street.
On motion by Councilman Clauson, seconded and carried, Council
removed proposed mobile home ordinance from the table for
consideration.
Councilman Clauson moved to adopt Ordinance No. 1276, establishing
regulations for the installation'of mobile homes and providing for
permit inspection fees, seconded by Councilman Miller and carried,
with five ayes and two nays. Councilmen..Childress.and Wilson voting
nay.
Mayor Weatherill call for.recess.with meeting to reconvene at
9:05 P.M.
Councilman Grosso and Fire Chief'Snow'reported bids received for
purchase of fire truck (4/9/84) were rejected. 'Specificat.ions
have been redrafted and bid opening set for June 11, 1984.
Fire Chief Snow reported Fire Tuck No..—77 i.,s.out of service, the.
pump is leaking and required repairs. Cost estimate is $7,000
maximum.
Councilman Grosso moved to declare emergency repairs necessary and
authorized Fire Chief to proceed with Fire Truck No. 77 repairs
as expeditiously as possible, seconded and carried.
On motion by Councilman Geiger, seconded., -and carried, Council moved
to allow modification of Joint Sewer.Treatment Plant eight inch
water line.
On motion by Councilman Wilson, seconded and carried, Council
declared 1945 Dodge Oiler as surplus and authorized City Engineer
to dispose of this piece of equipment'in the best interest of the
City.
Councilman Clauson moved to authorize Mayor Weatherill, to sign
contract with Entranco Engineers for design consultation on the
Port Orchard By -Pass at a cast not to exceed $19,000.00
On motion by Councilman Geiger, seconded and carried, Council
authorized acceptance of out -of -court settlement with Mans.
Kirkebjerg et ux,. for Bypass land acquisition,
Councilman Grosso moved to authorize Mayor Weatherill to sign
Department of Natural Resources Lease for Joint Sewer Treatment
Plant Outfall as negiotated by City Attorney's office, seconded
and carried.

1. A SEPA checklist has been submitted and received a declaration of non -significance.
2. The Applicant has requested a preliminary plat to be known as "STETSON", a
residential subdivision, comprised of eight single family lots on 4.107 acres. The
site is located at the west end of Shamrock Lane.
3. This is a re -plat of the parcel, which was short platted into four lots in 1951.
In 1981 the applicants intended to put a four-plex appartment on each lot a
Iota! of 16 units.
4. The proposed subdivision is for eight lots that will each have one (1) single-family
dwelling unit.
5. In accordance with RCW 58.17 The area included in an approved short subdivision
shall not be further subdivided in any manner within a period of five years from
date of approval of such short sudivision until a final plat thereof has been approved
and filed,
6. City water is located on Shamrock land. An 8 inch main extention into the
development and a hydrant will be required (Ordinance 999)
9. In 1981 the Kitsap County Health Department approved perk tests for 16 units.
