Council of the City of Port Orchard, Washington called to regular session by
Mayor Lee F. Caldwell. Council €rembers present: Wilson, Childress, Geiger,
Miller, Grosso and Clark.' Also present: Attorney McCluskey, Police Chief
Trotter, Engineer Curles and Fire Chief Snow.
Mayor Caldwell led the Council and the Audience inthe Pledge of Allegiance.
On motion by Councilman Clark,'seconded and carried, Council approved the
minutes of the January 10, 1983 meeting, as circulated.
Jeff Webber, Project Manager for the Design Phase of the Port Orchard ByPass
briefed Council on progress of project.
Councilman Wilson presented letter from Frank Shiers, attorney'.representing
Dorothy Williams. In his letter, Mr. Shiers'maintains that in or about 1966
Firs. Williams and her now deceased spouse deeded, for`the`sum of $200 a portion
of their property (South Street.east of Sidney Road for a`distance of
approximately 391 feet) for use as a sewer easement and right-of-way. `The
right-of-way was to be graded, graveled and maintained by the°City of Port
Orchard. Councilman Grosso moved to authorize City Engineer to effect
necessary maintenance to bring this'section'of South Street up"to`standards,
contingent upon a determination by the City Attorney that this is City right-..
of-wa,. Motion died for lack of second.
Mrs. Williams presented copy of deed to City:Attorney, who'confirmed the deed
does set forth this as right-of-way easement to be used as.a public road forever.
On motion by Councilman Clark, seconded and carried, Council authorized City
Engineer to grade, compact, gravel°and maintain'that portion of South Street
which lies east of Sidney.
On motion by Councilman Geiger,seconded and carried, Council moved to confirm
the intent of the Negotiating Committee, in wrtinq the section on longevity pay
in the Teamsters Union Agreements, was that the extra pay a person becomes
eligible to receive on the appropriate employment anniversay date shall be
always calculated to be equal to the contract base pay for the position plus
an appropriate percentage of that base scale., Payroll Department is to
examine the payroll record of each employee who is eligible fora'longevity
percentage increase and make any adjustments necessary to reflect this 'intent,
This adjustment shall be retroactive to point of eligibility for longevity
increase. The formulaat any given payday would be -..'..Contract base (including
cost of living) plus longevity percentage equals. current base pay).
Councilman Geiger moved to declare mute, the matter relative to non -conforming
structure - 260 Granat (Loftus/Roland). It has been determined subject property
does encompass sufficient square footage'(19,620.sq. 1t.) to allow a duplex,
therefore, the owner did not need to submit an application for variance to
construct a duplex. Seconded and carried.
On motion by Councilman Diller, seconded and carried,` Council`` appointed John
W. Clauson to fill council position vacated by the appointment of Councilman
Lee Caldwell to the position of ,Mayor.
On motion by Councilman Clark, seconded and carried, Council authorized Mayor
Caldwell to sign 1983 Humane Society Agreement relative to animal control within
the City of Port Orchard...
Police Chief Trotter presented letter from Downtown Merchants. Association
requesting ?permission to hold 1983. Streeti=air on August'7, 1983, 12 noon -
6 P.M. This function would require:the closure to Bay Stret'from Rockwell to
Kitsap Street.
On motion by Councilman WilsonV,seconded and carried, Council approved Downtown
Merchants Association request to hold 1983 Street Fair on August 7, 1"£33, 12 noon
to 6 P.M. Chief Trotter is to contact:the State Highway Department relative to
closing Bay Street from Rockwell'to'.Kitsap Street.

Engineer Curles reported receipt of copy of letter from William Eickmeyer,
Executive Director of Kitsap Youth domes, Inc. recommending that the Private
Industry Council of Kitsap County award City of Port Orchard employee Jay
Cookson a "Certificate of Commendation" for his exemplary service to the youth
of Kitsap County through the Youth Employment Program.
On motion by Councilman Geiger, seconded and carried, Council authorized
retaining the firm of Roberts & Shefelman as legal counsel relative to
bonding for the U.L.I.D (Wastewater Treatment Plant).
On motion by Councilman Wilson, seconded and carried, Council authorized
Mayor Caldwell to sign Cemetary Plats, Sections 9, 10 and 11 of Sunset Lane
Cemetary.
