10/24/1983 - Regular - MinutesPort•,Orchard, Washington October 24, -,1983 Council of the City of Port Orchard, Washington called to order by Mayor Protem James Wilson. Council members present: Clauson, Geiger, Miller, Grosso and Clark. Also present: Attorney McCluskey, Police Chief Trotter and Engineer Curles.• Mayor Caldwell, Councilman Childress and Fire Chief -,Snow excused. Councilman Clark led the Council and audience in.`the Pledge..of,Allegiance. On motion by Councilman Grosso, seconded and carried; Councilapproved the minutes of the October 10, 1983 meeting as circulated. Marna Snow, 1319 Sherman Avenue,representing severalneighboring property` owners complained about condition of street and drainage problems incurred in this area. Mayor Protem Wilson referred matter to Street/Alley' Committee for investigation and recommendation. 4--H Little Farmers group from Sunnyslope, 7324 Alta Vista Drive, stated they would like to donate a lifesize nativity scene to the City for use during the Christmas- season. City Attorney stated he would like opportunity to research legality of City accepting donation of this nature. At this time Mayor Rroterr► Wilson referred matter to Police/Fire/Safety Committee and City Attorney. Irene Schaefer requested Council authorization to locate and operate a non -motorized hot dog stand near the foot ferry.- Mayor Protem Wilson referred matter_to Police/ Safety Committee. On motion by Councilman Clark, seconded and carried, Council authorized City Engineer to accept Blackjack Creek Access.Road complete as per plans and specifications. On motion by Councilman Clark, seconded and carried,"Council authorized Mayor to sign change order relative.to Force Main construction, at no cost to the City. Mayor Protem Wilson called for executive _session'to discuss O.L•I•D. litigation. Councilman Grosso moved to confirm action.taken on behalf of the'City'of Port Orchard to settle appeal of court decision on U.L.I.D., seconded and carried.' Settlement is payment of Mr. Simpson's attorney fees in the amount `of $3,000.00. Robert McDermott an attorney, spoke on behalf of Dorothy Williams relative to maintenance of that portion of South Street which was dedicated to the City of Port Orchard. Mayor Protem Wilson:referred Mr. McDermott to City Attorney for investigation of matter. Councilman Clark moved to approve` proposed ordinance amending`the,1983 Budget and ordering distribution of anticipated'excess"sales tax `revenue with`'the`amount of $110,000 to be placed in the By -Pass Fund and revenue received in excess of $110,000 to be place in Current Expense Fund. Seconded. After much discussion as to budgetary demands and needs, Councilman Wilson moved to table proposed ordinance.for further study Seconded and carried. On motion by Councilman Grosso, seconded and carried, Council moved to approve Resolution No. 1324 authorizing the City Treasurer to transfer the amount of Two Thousand Four Hundred Seventy Seven Dollars from Federal Shared Revenue -Financial & Administrative (Machinery and Equipment) to Federal Shared Revenue -Other Govern- mental Service (Harbor Area.Lease) to facilitate payment 'of`annual lease rental on waterfront parking area. On motion by Councilman Clark, seconded and carried, Council approved payment on the bills in the amount of.$7.00,951.16 (Warrant No.'02642-02690) Meeting adjourned at 8:40 P.M.' .
