August 8, 1983
Council of the City of Port Orchard, Washington, called to order by Mayor
Lee F. Caldwell. Council members present: Clauson, Childress, Wilson,
Geiger, Miller, Grosso and Clark. Also present::. Attorney Haberly, Acting
Police Chief Blacknall, Engineer Curles and Fire Chief Snow.
Councilman Miller led.the Council and audience in the Pledge of Allegiance.
On motion by Councilman Clark, seconded and carried, Council approved the
minutes of the July 25, 1983 Council meeting as circulated with the following
addition; On motion by Councilman Geiger, seconded and carried, Council
approved the minutes of -the July ll,,1983 meeting as circulated.
Anita Sanford presented the 1983 Kitsap County Fair and Rodeo Royalty who
presented Mayor Caldwell with official fair and rodeo hat and invited
citizens of Port Orchard to attend this year's event.
John Stetson of Department of Ecology spoke relative to wastewater treatment
facility project. Mr. Stetson assured Council and Mayor the DOE considers
this a priority project and they want to see construction underway and
completed. Mr. Stetson further stated the Department of Ecology will loan
the City of Port Orchard 25% of project costs in addition to the existing
grant funding, bringing total state support to 75% of projectcost which is
the maximum amount allowed for state participation.
John Marshall, Bice President of Foster and Marshall and Terry Thompson the
City's financial advisor spoke concerning financial aspects of project.
On motion by Councilman Clark, seconded and carried, Council moved to accept
low bids as opened and read at May 23, 1983 Port Orchard City Council meeting
as follows: Schedule A (pump.station) & Schedule C (treatment plant) Humphrey
Contractors, Inc.; Schedule B (force main) Hos Bros. Construction; and
Schedule D (outfall) General Construction.
Mayor opened Public Hearing relative to Petition for Annexation as submitted
by Victor Barsay, et.al, owners of 15 properties in Section 36, Township 24
Range 1 East, Willamette Meridian, as recorded in Kitsap County, Washington.,
that lie contiguous to the east side of Bethel Road and southerly from the.
Port Orchard city limits to the north side of Lincoln Avenue
Mayor Caldwell call for public input at this time. No response.
On motion by Councilman Clark, seconded and carried, Council approved Ordinance
No. 1238 providing for the annexation of territory to the City of Port Orchard
as petitioned by Victor Barsay, et.al
Mayor Caldwell declared recess with meeting to reconvene at 9:10 P.M.
On motion by Councilman Clauson, seconded and carried, Council authorized
Mayor to sign contracts for Schedule,A, B., C & D of Wastewater Treatment.
Project (Resolution No. 1309)
Engineer Curles briefed Council background of proposed ordinance to increase
sewer rates. After much discussion Councilman Geiger moved to table proposed
ordinance increasing sewer rates to August 22, 1983 City Council meeting.
Michael McCormick brought Council"•'up to'date on 'status of Block"Grant and
proposal to have grant application.amended to cover entire"+.U.L.I.D. area.
On motion by Councilman Grosso, "seconded and carried, Council'authorized
Michael McCormick to initiate necessary changes to Block Grant application
to allow grant funds to be distributed to Sewer District No 5 property owners
after City property owners are:.taken care.
On motion by Councilman Clauson, seconded and carried, Council authorized
Mayor to sign agreement with Fire District #1 relative to.use of Tactical
Equipment and allow for contract.payment of $100.annually. (Resolution No. 1310).
Councilman Clauson presented motion for Council approval of. Resolution No.
1308 authorizing a budgetary change within Current''Fxpen'se`Fund-Police
Department for travel expense. Seconded and carried, with 6 ayes and 1 nay.
Councilman Wilson voting nay,
Councilman Geiger moved to instruct City attorney to prepare amending
ordinance providing for an exemption for lending institutions from late
charges and penalties on utility.:accounts,'.seconded and carried..,
Councilman Clauson moved to amend instructions'to City attorney relative to
preparation of ordinance exempting lending'institutions from late charges
and penalties on utility accounts for a period of 90 days only, seconded
and carried.
On motion by Councilman Grosso, seconded and carried, Councilauthorized a
credit be allowed on utility account #2204, Gene Caldwell,`904 Dwight Street
in the amount of $4.65.
Coouncilman Grosso questioned status of voucher presented at July 25, 1983
meeting for payment of attorney Logerwell for services rendered to City,
After much discussion as to City's responsibility for payment Councilman
Grosso moved to table matter to:August 22, 1983 meeting.
Councilman Geiger moved to place the Bypass'PhaseAl Bond Issue on the ballot
for the following 17 voting precincts: Port Orchard 201,'202, 203 and 204,
Annapolis 212, Bethel 215, Colby 220, Davis 225, Harper 240, Long Lake 245,
Lundberg 250, Manchester 255, Overlook,267, Parkwood 270, Sedgwick 272,
Sinclair 275 and Waterman 295.
On motion by Councilman Clark, seconded and carried, Council authorized payment
of the bills in the amount of $75,877 16 (Voucher No. 02283.-:.02357).'=
