03/22/1982 - Regular - MinutesPort Orchard, Washington March 22, 1982 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Childress, Wilson, Caldwell, Miller, Grosso and Clark. Also present: Attorney Riehl, Provisional Police Chief MacPherson, Engineer Curles and Fire Chief Snow. Councilman Geiger excused. Mayor Powers led the Council and the audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the March 8, 1982 meeting as circulated. Terry Bump, 317 Cline, approached Council relative to construction of a garage on his property. Mr. Bump reported a complaint has been filed with the Building Department by his neighbor Forest Adkins, stating that Mr. Bump's garage is blocking his view. Engineer Curles informed Council that the garage in question infringes on the Adkins view but does not block it. Mr. Bump was granted a variance allowing the garage to be situated in such a manner as to avoid blocking Mr. Adkins view. Council confirmed that as long as Mr. Bump is in conformance with the site plans and requirements as set forth in the variance,he may continue construction of his garage. On motion by Councilman Caldwell, seconded and carried, Council authorized the closure of Bay Street from Guy Wetzel.to Tracy on May 27, 1982 for the Fathoms 0' Fun Jet Ski Race and July 4, 1982 for the Dingy Derby. Fire lanes will be open,! during both events. On motion by Councilman. Caldwell, seconded and carried, Council approved closure of Kendall Street from Sidney to Cline on July 4, 1982 to allow the "Kendall 500" to be held. Engineer Curles reported he has contacted the majority of property owners within the boundary of Highway 160, Retsil Road and present City limits relative to proposed annexation into the City of Port Orchard. Mr. Curles stated most property owners contacted were not interested in annexing into the City at this time. He recommended providing Mr. Lee Sebring, who initated the original petition for annexation of his property (851 Mitchell), with petition forms and he may contact property owners relative to annexation. On motion by Councilman Caldwell, seconded and carried, Council approved Ordinance No. 1193 repealing Ordinance No. 824 (Port Orchard Municipal Code Chapter 6.08) relating to food service establishments. Clerk read letter from Port Orchard Civil Service Commisison requesting City Attorney be authorized to attend the Commission's meetings until the Police Chief selection has been completed. On motion by Councilman Wilson, seconded and carried, Council authorized City Attorney to attend the Civil Service Commission meetings until the Police Chief selection has been made. On motion by Councilman Caldwell, seconded and carried, Council moved that adequate fire flow will be available prior to opening of Bowling Alley. On motion by Councilman Caldwell, seconded and carried, Council approved the proposed amendment to the Six -year Transportation Plan to include Item No. 39: West - South Sidney. Total length in miles .11. (Resolution No. 1263) John Clauson, Chairman Civil Service Commission reported on progress of Entry Level Patrolman, Sargeant and Police Chief positions. Mayor Powers declared recess with Council to retire to executive session to discuss personnel matters. Mayor Powers reconvened meeting and addressed letter from Patrolman Frank Connelly relative to his request to be allowed to participate in the Sargeants examination. Mayor Powers informed Mr. Connelly the mayor does not have legal powers to override the Civil Service Commission's decision. Mr. Connelly must follow Civil Service Regulations relative to appeals. Commission Chairman John Clauson read Civil Service Regulation No. 13.03.040 relative to appeals and hearing procedures. Meeting adjourned at 8:55 P.M. C1er Mayor
