01/12/1981 - Regular - MinutesPort Orchard, Washington Page 1 of 3 January 12, 1981 Council of the City of Port Orchard, Washington, called to regular session by Mayor Paul D. Powers, Jr. Council members present: Dominguez, Wilson, Caldwell, Geiger, Miller and Grosso. Also present: Attorney Riehl, Engineer Kane and Fire Chief Weatherill. Councilman Clark and Police Chief Mares excused. Mayor Powers led Council and audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the December 22, 1980 meeting as circulated with the following corrections: (1) Councilman Gerald Grosso excused himself as a member of the City Council and presented himself to the City as a citizen of the City and requested that the City allow his property and that of Mrs. Marie Olszewski to hook up with the Annap- olis Sewer District. Matter referred to Water/Sewer Committee. (2) Add; On motion by Councilman Geiger, seconded and carried, Council approved the minutes of the December 8, 1980 meeting as circulated. Cliff McIntosh, 9072 Austin, approached Council requesting permission to maintain 2 single family residences for a period of five years on property presently zoned for only 1 single family residence. Mr. McIntosh wished to rebuild the front house as it now exists (with addition of 2 dormers) and live in the small building located at the rear of his property (9072 Austin). On motion by Councilman Geiger, seconded and carried, Council moved to allow Mr. McIntosh to retain a second residence on his property located at 907/9072 Austin fora period of five years to facilitate his rebuilding the large house (907 Austin) with the same foundation dimensions as present. At the end of the five year period, the smaller building (9071-, Austin) must revert to a non-residential use. Mr. William Evans, owner of property located between the National Guard Armory and the South Kitsap Mall, approached Council to in- quire as to status of his request (December 22, 1980 Council meet- ing) to amend condition of zone reclassification granted Iliad, Inc.. (Ordinance No. 1148) which stipulates property located at 1730 & 1750 SR 160 must have ingress and egress other than directly to SR 160. Mayor Powers informed Mr. Evans that as of this date Council is not ready to take action on this matter. Mr. Evans stated he will provide Council with letter stating his concurrence in Iliad rezone request application and provide City of Port Orchard with proof of ownership for subject property. Nancy Mahan, 103 Rockwell, voiced concern for safety of Bay/Rockwell Street intersection. Mayor Powers assured Ms. Mahan the City will study this intersection for potential ways of reducing the hazards. Mayor Powers opened Public Hearing relative to Special Use Permit as submitted by Gerald Matosich & Ronald Ness to permit their property located at 420 Cline Street, a single family residence to be used as a law office. Clerk read Planning Commission's findings and conditions for recommend- ations for approval as submitted to Mayor and City Council. Mayor Powers requested public input at this time. Mr. Ronald Ness, applicant, appeared on behalf of himself and Mr. Matosich and requested that condition for approval "parking area to be paved and approved by the City Engineer prior to occupancy" be changed to eliminate paving requirement. Mr. Ness and his partner would like to maintain a natural state as much as.possible to retain the residential neighborhood atmosphere and avoid a "commercial" look to the property. Port Orl.chard, Washington Page 2 of 3 January 12, 1981 Richard Brown, Crown Properties, spoke in favor of the proposed Special Use Permit stating it is his opinion that locating offices of the legal profession in the area of the Courthouse is in accordance with the Comprehensive Plan. On motion by Councilman Geiger, seconded and carried, Council approved Special Use Permit application as submitted by Gerald Matosich and Ronald Ness to permit their property located at 420 Cline Street, a single family residence to be used as a law office. Council also accepted and adopted Planning Commission recommendations for conditions of approval as follows: 1. That a lease agreement be signed between the City of Port Orchard and the proponent for the proposed R/W lease (parking) area, as designated on the site plan. 2. Storm drainage system to be installed and approved by the City Engineer prior to occupancy of the Structure. 3. Parking area to be graveled and approved by the City Engineer prior to occupancy. Mayor Powers declared Special Use Permit approved and Hearing closed. Mayor Powers opened Public Hearing relative to application for Zone Reclassification as submitted by Karen Plummer, owner of property located at 1200 Bethel to upgrade zoning from Residential Low to Commercial General and a change in the Comprehensive Plan Map from Greenbelt to Commercial General. Clerk read facts of finding and recommendation for approval as sub- mitted to Mayor and City Council by Port Orchard Planning Commission. Mayor requested public input from audience at this time. Mayor read letter from Ruby Roller, 1140 Bethel Avenue, in protest of this application stating increased traffic will cause additional burden on neighborhood. On motion by Councilman Caldwell, seconded and carried, Council approved Zone Reclassification application as submitted by Karen Plummer, owner of property located at 1200 Bethel to upgrade zoning from Residential Low to Commercial General and institute a change in the Comprehensive Plan Map from Greenbelt to Commercial General. Council also accepted and adopted Planning Commission conditions of approval. (See attached) Mayor Powers declared Zone Reclassification approved and Nearing closed. Mayor Powers opened Public Hearing relative to Petition for Vacation of a portion of Guthrie Street as submitted by Howard Minor, Virginia King and Larry J. King, owners of record. Mayor Powers requested public input from audience at this time. After much discussion, Councilman Wilson moved to approve petition requesting vacation of that portion of Guthrie Street extending westerly from Flower Avenue to the easterly R/W of Port Orchard Boulevard EXCEPT: that portion of Canyon Lane extending across Guthrie Street. The City of Port Orchard also retains an easement 15' in width running along the southerly side of Guthrie Street from Flower Avenue to the easterly R/W of Port Orchard Blvd. for utilities. Mayor Powers declared Vacation approved and instructed Ms. King to contact Clerk's Office for payment for vacated property. bearing closed. Mayor Powers declared recess with meeting to reconvene at 9:30 P.M. Councilman Gerald Grosso excused himself as a member of the City Council and stepped down from Council table to present himself as Port Orchard, Washington Page 3 of 3 January 12, 1981 a citizen of this City due to conflict of interest on upcoming matter. On motion by Councilman Caldwell, seconded and carried, Council approved Gerald Grosso and Marie Olszewski obtaining sewer services from Sewer District No. 5 for their respective properties on Mitchell that are not presently served by Port Orchard sewer lines. Approval is contingent upon Mr. Grosso and Mrs. Olszewski entering into a covenant with the City of Port Orchard stating that in the event an L.I.D. is formed in this area, they will agree at that time to connect with Port Orchard sewer lines. Covenant is to be recorded. (Councilman Grosso not present at Council table due to conflict of interest). Councilman Grosso, Chairman Police/Fire/Safety Committee, reported the loth police officer, Dave Anderson, is now on board. Officer Anderson and Patterson will be leaving for police academy training on February 2, 1981 for 10 weeks. Fire Chief Weatherill reported on Federal Grant Funding (50% City matching) is available for a Trauma Kit ($300.00 funding) and Traction Splint ($600.00 funding). Chief Weatherill stated City matching funds are allocated in the 1980 Federal Shared Revenue Fund Budget. On motion by Councilman Caldwell, seconded and carried, Council authorized agreement to be prepared (for Mayor's signature) by City Engineer and Entranco Engineers to do design work and prepare necessary plans and specifications to issue a call for bids on the construction of Perry Avenue wall at a cost of $6,500.00. On motion by Councilman Caldwell, seconded and carried, Council authorized Mayor Powers to sign document titled First Amendment to Washington State Department of Transportation City/County Agreement No. GC-5914 which eliminates in --kind services on Federal aid projects. On motion by Councilman Caldwell, seconded and carried, Council authorized Mayor Powers to sign Supplement No. 1 of Washington State Department of Transportation City/County Agreement No. GC-5914, Project No. HES-6611(1) for installation of new signal control at the inter- section of Bay and Sidney Streets. Mayor Powers announced study sessions will be held by the City Council in Council Chambers, 216 Prospect Street on the following dates: 1. Monday, January 19, 1981, 8:00 P.M. - to discuss revisions in the zoning ordinance. 2. Monday February 2, 1981, 7:30 P.M. - (a) to discuss proposed sub -division ordinance. (b) to discuss proposed 1981 Federal Shared Revenue Fund Budget. On motion by Councilman Geiger, seconded and carried, Council author- ized specifications and a call for bids to be issued for purchase of a computer system for the City of Port Orchard as allowed for in the 1981 budget. On motion by Councilman Geiger, seconded and carried, Council approved payment of the bills in the amount of $26,503.77 (Warrants No. 7487 - 7571) and the December payroll in the amount of $65,000.58 (Warrants No. 11096 - 11210).
