October 26, 1981
Council of the City of Port Orchard, Washington, called to regular
session by Mayor Pro-Tem Lee Caldwell. Council members present:
Dominguez, Geiger, Miller, Grosso and Clark. Also present: Attorney
Riehl, Provisional Police Chief MacPherson, Superintendent of Public
Works Curles. Mayor Powers, Councilman Wilson and Fire Chief Weatherill
excused.
Mayor Pro-tem Caldwell led the Council and audience in the Pledge of
Allegiance.
Mr. Charles Buell, James Kirby and Ilan Bennett presented statistical
data relative to Kitsap County Alcoholism Program and requested $1200.00
in addition to the regular 1982 appropriation for the Kitsap County
Alcoholism Program.
On motion by Councilman Clark, seconded and carried, Council approved
the minutes of the October 12, 1981 meeting as circulated.
Mayor Pro-Tem Caldwell opened Public Hearing relative to application
for Zone Reclassification, a change in the Comprehensive Plan and a
Special Use Permit as submitted by East Port Orchard Towing for property
located on the southwest corner of Maple and Kitsap Streets.
Clerk read recommendation and fact of findings as set forth in Planning
Commission Resolution No. 010-81 recommending Council approve a Special
Use Permit to allow an open storage yard that will be used as a vehicle
impound lot.
Mayor Pro-Tem. Caldwell called for public input at this time. No
response.
On motion by Councilman Clark, seconded and carried, Council approved
the issuance of a Special Use Permit to East Port Orchard Towing for
property located on the southwest corner of Maple and Kitsap Streets.
Special Use Permit is to allow an open storage. yard that will be used
as a vehicle impound lot. Legal Description: Tom Clines, Addition
to Sidney, Block 5, Lots 1-15, Section 36, Township 24 North, Range
1 East, W. M.
Duane Severson representing residents of Arnold Avenue area approached
Council relative to flooding problems of this area. Mr. Severson
requested a meeting with City Council, Kitsap County officials and
residents of the Arnold Avenue Area to determine what will be done
to alleviate runoff and flooding problems. Mayor Pro-Tem Caldwell
informed Mr. Severson the City and County have met on this matter and
engineers will be contacting him.
Terry Oostenbrug, attorney representing Harold Drive Community Association,
requested Council take necessary steps to close the access to Lundberg
Park property on Harold Drive. Matter referred to Parks Committee.
On motion by Councilman Clark, seconded and carried, Council approved
Resolution No. 1253, authorizing Mayor Powers to sign Consultants
Agreement for design phase of Port Orchard By -Pass Project and authorizing
the Mayor to issue an order to proceed.
On motion by Councilman Geiger, seconded and carried, Council approved
Resolution No. 1251 authorizing a budgetary transfer within Federal
Shared Revenue Fund in the amount of $18,000.00 for the purchase of
a street sweeper.
On motion by Councilman Clark, seconded and carried, Council approved
Resolution No. 1250 authorizing a budgetary transfer within Federal
Shared Revenue Fund in the amount of $700.00 to correct storm drainage
at Fire Station.
On motion by Councilman Grosso, seconded and carried, Council approved
Ordinance No. 1182 relating to and providing for the annexation of
territory to the City of Port Orchard described as follows: Tract 4,
Port Orchard Villa Tracts, Volume 4 of Plats, Page 100, Kitsap County,
Washington.
On motion by Councilman Miller, seconded and carried, Council set
November 9, 1981, 7:30 P.M. as date and time of Public Hearing relative
to application for Zone Reclassification as submitted by Ryan Built,
Incorporated for property located on the northwest corner of Kitsap Street
and Harrison Avenue. Request is for reclassification from Residential
High to Multiple Family 20 to allow the construction of a 6-plex
condominium. Legal description: Lot 1, Block 12, including vacated
20 feet of Harrison Avenue, abutting on the east side; also west 10
feet of the east 65 feet of Lot 7, Block 12; also the south half of
Lot 8, Block 12, all in the first addition.to Sidney,.per plat, Section
26, Township 24 North, Range l Bast, W. M.
Mayor Pro-Tem Caldwell declared recess with meeting to reconvene at
9:00 P.M.
Mayor Pro -Terry Caldwell stated Hearing requested by Mr. Richard Barry
relative to the impounding of his vehicle by Port Orchard Police was
scheduled for 7.30, all parties involved are present except Mr. Garry.
Attorney Riehl advised Council that Section 8 of Resolution No. 1244
(Complaint Procedures) has been complied with and proper notification
has been made to Mr. Barry, as to time and place of nearing, therefore,
with Mr. Barry`s failure to appear he would. advise matter be dismissed.
Mayor Pro-Tem Caldwell dismissed hearing as requested by Mr. Richard
Barry.
