05/26/1981 - Regular - MinutesPort Orchard, Washington May 26, 1981 Council of the City of Port Orchard, Washington, called to regular session by Mayor Paul D. Powers, Jr. Council members present: Dominguez, Wilson, Caldwell, Geiger, Miller and Grosso. Also present: Attorney Rainey, Engineer Kane and Provisional Police Chief Benton. Councilman Clark and Fire Chief Weatherill excused. Mayor Powers led the Council and audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the May 11, 1981 meeting as circulated. Pastor Herb Ireland, Church of Nazarene, requested an extension of Special Use Permit, approved by Council action October 13, 1980 to allow a day care/pre-school at the present facility located at 601 Jones Drive. On motion by Councilman Grosso, seconded and carried, Council authorized 180 day extension of Special Use Permit issued to Church of Nazarene (approved by Council action October 13, 1980) to allow a day care/pre-school at facility located at 601 Jones Drive. Steven D. Rench submitted revised site plan for proposed construction of three four-plexes to be located at the corner of Portland Avenue and Sroufe Street. Property was rezoned (Ordinance No. 1083, February 26, 1979) with site plan depicting two four-plexes. Councilman Caldwell moved to allow Steven D. Rench to construct three four-plexes in lieu of two four-plexes, as shown on site plan submitted with zone reclassification application. Jim Millard, 909 Sidney, requested authorization to locate a real estate office and sharpening shop on his property (in building other than home) under the home occupation ordinance. Mayor Powers and Council defined "home" of home occupation use as residence and/or outbuildings located on same lot. Councilman Geiger moved to approve Resolution No. 1244, setting forth rules and regulations governing tow companies on City of Port Orchard Police Department Rotation List while operating within the City limits. Seconded. After much discussion, Councilman Geiger moved to amend motion to change word "impound lot" (Page 1, section 1, paragraph B.) to "storage yard", seconded and carried. Original motion, as amended, setting forth rules and regulations governing tow companies on the City of Port Orchard Rotation List approved. Councilman Caldwell moved to remove from table motion to purchase new sweeper on out -right purchase or lease -purchase plan (tabled 5/11/81) seconded and carried with four ayes and two nos, Councilman Miller and Geiger voting no. Original motion by Councilman Caldwell to purchase new sweeper on out -right purchase or lease -purchase plan, lost with three ayes and three nos. Councilman Geiger, Miller and Grosso voting no. Councilman Caldwell moved to issue call for bids for used street sweeper. Seconded and carried, with four ayes and two nos. Councilman Miller and Geiger voting no. Councilman Grosso moved that call for bids not be issued until present City equipment is.surplused and funds are receipted. Seconded and lost with three ayes and three nos, Councilman Dominguez, Wilson, and Caldwell voting no.. Councilman Grosso and Provisional Police Chief Benton presented proposed police car rotation schedule outlining use of police vehicles, (from purchase to disposal) and discussed feasibility of retaining 1977 Pontiac (blue) which is scheduled to be traded in. On motion by Councilman Caldwell, seconded and carried, Council approved police vehicle useage by rotation concept (proposal attached) and authorized retention of 1977 Pontiac (blue) and expenditure of $1,000.00 in lieu of using 1977 Pontiac (blue) as trade in on new police vehicle. Engineer Kane informed Council of letter from One -Way Construction (low bidder of Perry Avenue Retaining Wall call for bids). One -Way Construction has requested they be allowed to withdraw bid and that their bid bond be returned. Councilman Caldwell moved to release One -Way Construction from bid submitted for construction of Soldier Pile Wall on Perry Avenue, City of Port Orchard to retain bid bond. Councilman Caldwell further moved to award bid to Dale Madden, Inc., submitter of next low bid of $82,136.00. Seconded and carried, with five ayes and one no, Councilman Geiger voting no. Mayor Powers announced, in the absence of Police Chief Mares who is on disability sick leave, he has appointed Sergeant James:Benton, to the position of Provisional Police Chief for a period not to exceed six months. Mayor Powers declared recess with meeting to reconvene at 9:15 P.M. Clerk read letter from Jack Perelli requesting renewal of Special Use Permit issued December 8, 1980 allowing remodeling and use of existing church facility, located at 817 Sidney, for non -retail offices. On motion by Councilman Wilson, seconded and carried, Council approved renewal and extension (for period of 180 days) of Special Use Permit issued December 8, 1980, allowing use of property located at 817 Sidney Avenue for non -retail offices. On motion by Councilman Caldwell, seconded and carried, Council approved Resolution No. 1242, authorizing a budgetary transfer with Federal Shared Revenue Fund to allow purchase of paint striper. Clerk read letter submitted by Jack Perelli requesting City lease property at the northeast corner of Dwight and Sidney which adjoins Mr. Perelli's property. Engineer Kane recommended City deny Mr. Perelli's request to lease City property on northeast corner of Dwight and Sidney Street based on the following facts: I. Leasing this property and allowing Mr. Perelli to use it for off-street parking would eliminate 3 on --street parking spaces. 2. Vehicles parking on this land would have to back onto Sidney to egress, creating a hazard. 3. Line of vision for approaching south bound traffic on Sidney would not be adequate. On motion by Councilman Caldwell, seconded and carried, Council moved to deny request submitted by Jack Perelli to lease City property located on the northeast corner of Dwight and Sidney which adjoins his property. On motion by Councilman Caldwell, seconded and carried, Council proclaimed June 5, 1931 as Official Fathoms 0' Fun Button Day. On motion by Councilman Caldwell, seconded and carried, Council set date of June 8, 1981, 7:30 P.M., as date of Hearing relative to application for Special Use Permit as submitted by David J. and Patricia A. Bourbeau for property located at 225 Sidney Street. On motion by Councilman Dominguez, seconded and carried, Council moved to go on record in support of need for hospital in South Kitsap area and the South Kitsap Hospital Association's efforts to locate a facility in this area. Mayor Powers opened Public Hearing relative to proposed zoning ordinance. Mayor Powers called for public input at this time. No response. Councilman Dominguez moved to adapt zoning ordinance as presented. Seconded. Councilman Geiger moved to amend motion to delay publication of zoning ordinance until such time as cost of publishing ordinance by section summary is knownand reviewed. Seconded and carried. Original motion as amended 'to adopt zoning ordinance as presented and delay publication until cost of publishing ordinance by section summary is known and reviewed, carried.
