Council of the City of Port Orchard, Washington, called to regular
session by Mayor Paul D. Powers, Jr. Council members present:
Dominguez, Wilson, Caldwell, Geiger, Miller, Grosso and Clark. Also
present: Attorney Rainey, Engineer Kane, Fire Chief Weatherill, and
Provisional Police Chief Benton.
Mayor Powers led the Council and audience in the Pledge of Allegiance.
On motion by Councilman Caldwell, seconded and carried, Council approved
the minutes of the June 22, 1981 meeting as circulated.
Mayor Powers notified Council and audience that Public hearing relative
to application for Zone Reclassification as submitted by Leonard Hanson/
Schilling Enterprises, Inc. for property located on Lots 1, 2, 3, 4, 5
& 6, Block,l, Pottery Addition to Sidney, Volume 1, Page 68 is to be
held over to the next Council meeting July 27, 1981 to allow time for
proponents to furnish additional necessary information.
Several citizens submitted questions to Council and Mayor relative to
development of Lundberg Park on Harold Drive. Questions will be
reviewed (by Parks Committee) and addressed at July 27, 1981 Council
meeting.
Mayor Powers at this time opened Public Hearing relative to Petition
submitted for Vacation of a portion of West Street between Kendall
and Smith Streets as submitted by Walter Sand and Edward Hahn,
(approximately 153 feet.)
Councilman Lee Caldwell, Chairman Street/Alley Committee moved that
Petition for Vacation of a portion of West Street be denied due to
the possibility this property could be utilized for street purposes
if there is further development of the area.' Seconded.
Walter Sand, 501 Kendall, petitioner, apprized Council that if a street
were developed on this property his house and garage would be located
immediately adjacent to the street. Mr. Sand also presented questions
as to actual location of property lines between City right--of-way
and his property.
Councilman Lee Caldwell moved to table motion until July 27, 1981
Council meeting allowing Mr. Sand an opportunity to locate and define
actual property lines. Seconded and carried.
Mayor Powers declared Public Hearing relative to Petition submitted
for Vacation of a portion of West Street between Kendall and Smith
Streets as submitted by Walter Sand and Edward Hahn held over until
July 27, 1981 meeting.
Mayor Powers opened Public Hearing relative to application for change
in the Comprehensive Plan and a Zone Reclassification as submitted
by Frank Shiers and William Kamps for property located on Lots 1, 4,
& 5, Block 7, S.M. Stevens Town Plat of Sidney, according to Plat,
Volume 1 of Plats, Page 1, Kitsap County.
Gary Chrey, partner of the law firm Shiers, Kamps, Love & Chrey,
spoke relative to amended plans which have been submitted to Council.
Mr. Chrey assured mayor Powers and Council proponents will develop
property and construct building to comply with all building code
requirements and will be using the building for business offices.
Offices for their firm will be situated in the proposed building.
Mayor Powers called for public input at this time. No response.
On motion by Councilman Dominguez, seconded and carried, Council
moved to approve application for change in Comprehensive Plan from
Multi -Family 20 ("MF-20") to Commercial General (CG) as submitted
by Frank Shiers and William Kamps for property located on Lots 1,
4 & 5, Block 7, S.M. Stevens Town Plat of Sidney, according to Plat,
Volume 1 of Plats, Page 1, Kitsap County. (Corner of Cline and Kitsap
Street.)
Councilman Geiger moved to approve Application for Zone Reclassification
from Residential 'High - to Commercial General as submitted by Frank Shiers
and William Kariips for property located on Lots 1, 4 & 5, Block 7, S.M.
Stevens Town Plat of Sidney, according to Plat, Volume 1 of Plats,
Page 1, Kitsap County, with conditions that property be used for
Office Building only and that construction commence within 18 months
(of approval of rezone) or property will revert to Residential High.
zoning. Seconded.
Councilman Grosso moved to amend motion to include recommendations
of Planning Commission as'submitted to Council in Planning Commission
Resolution #004-81. Seconded and carried.
Original motion as amended to approve Application for Zone Reclassificatior
from Multi --Family 20 to Commercial General as submitted by Frank Shiers
and William Kamps for property located on Lots 1, 4 & 5, Block 7, S.M.
Stevens Town Plat of Sidney, according to Plat, Volume 1 of Plats,
Page 1, Kitsap County with conditions as set forth in motions, carried.
Mayor Powers declared application approved and hearing closed.
City Attorney Roy Rainey requested Council authorization to allow
the City Attorney's Office to represent Fire Marshal J. L. Snow
relative to the Williamsburg Steel lawsuit until such time as insurance
carrier reverses decision that Mr. Snow is not covered under City's
insurance policy or Mr. Snow provides his own legal counsel.
Councilman Caldwell moved the City provide any necessary legal counsel
for Fire Marshal J. L. Snow relative to Williamsburg Steel lawsuit
in the event Mr. Snow is not covered by City's insurance policies,
seconded and carried.
Mayor Powers declared recess with meeting to reconvene at 9:15 P.M.
On motion by Councilman Caldwell, seconded and carried, Council set
July 27, 1981, 7:30 P.M. as date and time of hearing relative to
amending the 1981-1987 Six -year Transportation Improvement Program to
include Perry Avenue Retaining Wall Construction and adoption of
1982-1988 Six -year Transportation Improvement Program.
Councilman Clark moved to approve Ordinance No. 1165 amending Ordinance
No. 1103 and providing for compensation for those Councilmen eligible
according to RCW 35.24.090, seconded and carried with five ayes and two
nos. Councilman Geiger and Wilson voting no.
On motion by Councilman Geiger, seconded and carried, Council approved
payment of the bills (Voucher Nos. 8096 - 8196) in the amount of
$148,754.47 and the June payroll (Warrant Nos. 11787 - 11893) in the
amount of $66,631.54.
