Port. Orchard, Washington
Council of the City of Port Orchard, Washington, called to regular
session by Mayor Paul D. Powers, Jr. Council members present:
Dominguez, Wilson, Caldwell, Geiger, Miller, Grosso and Clark. Also
present: Attorney Riehl, Provisional Police Chief MacPherson,
Superintendent of Public Works Curles and Fire Chief Weatherill.
Mayor Powers led the Council and audience in the Pledge of Allegiance.
On motion by Councilman Caldwell, seconded and carried, Council
approved the minutes of the September 14, 1981 meeting as circulated.
On motion by Councilman Caldwell, seconded and carried, Council set
October 12, 1981, 8:15 P.M. as date of Public Hearing relative to
petition submitted by Phillip and Karen Cunnington requesting City of
Port Orchard vacate a portion of West Street (10 feet wide and 153 feet
south beginning at intersection of Smith and West Streets). Phillip
and Karen Cunnington will furnish City with legal description and map
depicting area of requested vacation.
On motion by Councilman Wilson, seconded and carried, Council moved
to install speed bumps in alley located south of Sroufe Streets, between
Portland and Spokane Streets. Street department is to also install
signs informing motorists of presence of bumps and paint speed bumps
to make them readily visible.
On motion by Councilman Clark, seconded and carried, Council moved to
deny request submitted by Arthur Hoisington for City water service
to his property located outside the incorporated City limits of Port
Orchard. In the event Mr. Hoisington would annex his property into the
City of Port Orchard, the City at that time would consider furnishing
water service to his installed mains.
On motion by Councilman Clark, seconded and carried, Council denied
request submitted by Brent Anderson that he be allowed to pay water/
sewer tap fees and late comer charges on a time -payment plan due on
the four-plex he is developing on West Street.
On motion by Councilman Clark, seconded and carried, Council moved to
extend Don Williams, 1143 Tacoma Avenue, until October 5, 1981 at noon
to pay June/July water bill due to hardship.
On motion by Councilman Clark, seconded and carried, Council moved to
chargeoff $2.70 late penalty assessed against property at 203 Rockwell
(ElizebethHoffman). Payment was delayed by mail service.
At this time, Councilman Clark excused himself from Council table and
discussion on next matter due to "appearance of fairness".
On motion by Councilman Geiger, seconded and carried, Council moved
to charge off $10.00 turn -on fee assessed against property located at
114, Kendall (Marlene Nearhoff). Ms. Nearhoff stated in letter to
Water/Sewer Committee that she received the final notice same day as
water was turned off.
On motion by Councilman Caldwell, seconded and carried, Council moved
to notify Gary Deal the format of water/sewer bills for his properties
within the City of Port Orchard will remain the same as all other
accounts.
On motion by Councilman Wilson, seconded and carried, Council moved
to reimburse Carol Brouwer plumber costs incurred by her due to error
of Water department personnel in amount of $105.00.
Pat McCullough, Consulting Engineer from Entranco Engineers, reported
on status of By -Pass Project and requested Council authorize Mayor
Powers to sign Consultants Agreement and Order to proceed with design
phase of By -Pass Project.
On motion by Councilman Caldwell, seconded and carried, Council moved
to authorize Mayor Powers to sign Consultants Agreement with Entranco
Engineers and to authorize Consulting Engineers to proceed with design
phase of By -Pass Project upon approval of Consultant Agreement by
State of Washington.
Mayor Powers declared recess with meeting to reconvene at 8:45 P.M.
On motion by Councilman Caldwell, seconded and carried, Council approved
Ordinance No. 1177, fixing the amount of Ad Valorem Taxes to be raised
for the year 1982.
Councilman Caldwell moved to approve Ordinance No. 1178, changing day
of regular council meeting to second and fourth Wednesdays of each
month, seconded and lost with two ayes and five nos. Councilman
Dominguez, Wilson, Caldwell, Grosso and Clark voting no.
On motion by Councilman Caldwell, seconded and carried, Council approved
Ordinance No. 1179, amending Ordinance No, 1054, S3 and Ordinance No.
1047, S6 (Port Orchard Municipal Code 10.68.040) eliminating fine for
failure to park vehicle within designated parking lines.
Councilman Grosso moved that minimum parking time on Bay Street be
changed to six (6) hours. Motion died for lack of second.
On motion by Councilman Caldwell, seconded and carried, Council approved
Ordinance No. 1180 with the following amendments:
1. Payments to City will be monthly not quarterly.
2. There be an 18% interest charged in addition to 10% of tax
penalty for late payment of taxes due.
On motion by Councilman Geiger, seconded and carried, Council set
October 12, 1981, 7:30 P.M. as date and time of Budget Hearing relative
to amending the 1981 Federal Shared Revenue Budget in the amount of
$18,000,00.
On motion by Councilman Geiger, seconded and carried, Council set
October 12, 1981, 7:45 P.M. as date and time of Proposed Use Hearing
to obtain public input as to how the City of Port Orchard should use
1982 Federal Shared Revenue Funds in the approximate amount of
$125,400.00.
On motion by Councilman Grosso, seconded and carried, Council set
October 12, 1981, 8:00 P.M. as date and time of Hearing requested
by Richard M. Barry relative to the impounding of his vehicle by
the Port Orchard Police Department.
On motion by Councilman Caldwell, seconded and carried, Council approved
Resolution No. 1250 requesting. Washington State Commissioner of Public
Lands to vacate DeKalb Street Waterway.
On motion by Councilman'Clark, seconded and carried, Council authorized
City of Port Orchard membership in the Kitsap County Visitor Convention
Bureau for one year at a cost of $25.00.
