01/28/1980 - Regular - MinutesPort Orchard, Washington January 28, 1980 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: James Wilson, Mary R. Wilson, Caldwell, Geiger, Miller, Grosso and Clark. Also present: Attorney Haberly, Engineer Kane, Fire Chief Weatherill and Police Chief Mares. Mayor Powers led the Council and Audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the January 14, 1980 meeting as circulated with the following correction: Page 2, paragraph 11; change to read: "Councilman M. Wilson moved to remove bags from parking meters downtown..." Jim Lambion, representing Sinclair Inlet Yacht Club, reported to date they have not been told what caused their members to be overcome by noxious fumes(715 Bay Street) on January 15, 1980. Mayor Powers assured Mr. Lambion the City is investigating this matter. Engineer Kane explained to Yacht Club members city sewers are being tested periodically but this does not appear to be the source of problem. Other buildings in this general location downtown have had a history of strange odors for several years. One suggestion was decaying organic material used in the land fill for this area could be creating a type of gas. Fire Chief Weatherill has agreed to do a survey of the Sinclair Inlet Yacht Club facilities prior to it's use, to assure members of the safety of the building. Mayor Powers will also contact the Kitsap County death Department Medical Staff to solicit their assist- ance in diagnosing what may have caused this problem. Councilman M. Wilson moved to amend Ordinance No. 739 to eliminate that portion of Section 2 which states members of the Parks Commission must live within the City limits. Seconded by Councilman Grosso. Councilman Geiger moved to amend motion to allow only one member of the Parks Commission to live outside the City limits of the City of Port Orchard. Seconded by Councilman Grosso, carried. Councilman Grosso moved to amend amended motion that all City Boards and Commissions can have only one member who does not live within the City limits of the City of Port Orchard. Seconded and carried. Original motion twice amended to allow only one member of any City Board or Commission to live outside the City limits of the City of Port Orchard. Carried unanimously: Councilman Clark, Chairman Water/Sewer Committee stated he expects the February meeting with K. C. Sewer Dist. #5 and Kramer, Chin and Mayo to wind up the design phase of the Secondary Treatment Plant. Councilman Geiger explained site plan for new pump station to be located at present treatment plant site. Mayor Powers set date of January 31, 1980, 8:00 P.M. for a study Session to discuss the following items: 1. Port Orchard/Sewer District No. 5 wastewater facilities improvements 2. Kitsap Sub -Regional Development Plan. On motion by Councilman Grosso, seconded and carried, Council approved issuing a call for bids to purchase 460 lineal feet of 72" cyclone fencing with top pipe support plus a 16' sliding.gate and a lZ' swinging gate. Alternate bid for 285' lineal feet of 42" cyclone fencing with top pipe support with 2 maie,type gates. Councilman Grosso moved to approve Ordinance No. 1125 repealing certain ordinances in Chapters 9.04, 9.08. 9.12, 9.16, 9.20, 9.24, 9.28, 9.32, 9.36 and 9.44 of the Port Orchard Municipal Code and adding new Chapters and Sections thereof to Title 9 of the Port Orchard Municipal Code relating to Peace, Safety and Morals. Seconded and carried, with six ayes and one no. Councilman James Wilson voting no. On motion by Councilman Grosso, seconded and carried, Council moved that all proposed ordinances be submitted to Council members a minimum of one week prior to a regular Council meeting. Mayor Powers declared recess with meeting to reconvene at 9:25 P.M. On motion by Councilman Caldwell, seconded and carried, Council approved Resolution No. 1220 authorizing the Mayor to sign the Project Agreement relative to the Bay & Sidney Traffic Light Control. On motion by Councilman Caldwell, seconded and carried, Council declared the old air compressor and the Studebaker Van surplus. On motion by Councilman Caldwell, seconded and carried, Council authroized expenditure of 1979 Federal Shared Revenue Fund Capital Outlay balance for the purchase of a roller and air tools for the compressor. On motion by Councilman Geiger, seconded and carreid, Council authorized purchase of carpeting for City Hall to be paid for from unexpended 1978 Federal Shared Revenue monies allocated for renovation of Municipal Building. On motion by Councilman Caldwell, seconded and carried, Council approved Ordinance No. 1126 amending the City of Port Orchard Zoning Ordinance No. 899; by amending the zoning map thereof, reclassifying certain property owned by Esther Turvill: Legal description; Beginning 30 feet West of SE corner, Section 34, Township 24 North, Range 1 East, W.M., thence 89* West 1290 feet thence North 0* 23 feet East 331 feet, thence South 89* East 1290 feet, thence South 0* 23 feet West to point of beginning. On motion by Councilman Clark, seconded and carried, Council authorized City staff to enforce City of Port Orchard mandatory garbage service. Mayor Powers recommended appointment of John Clauson, 1103 Spokane Street to the Civil Service Commission. On motion by Councilman Caldwell, seconded and carried, Council concurred w ith,Mayor Powers appointment of John Clauson, 1103 Spokane Street to the Civil Service Commission. On motion by Councilman Clark, seconded and carried, Council appointed Councilman Lee Caldwell as Mayor Pro-Tem for the 1980-1984 term. Meeting adjourned at 10:15 P.M. i " r C l e r k /
