October 13, 1980
Council of the City of Port Orchard, Washington, called to regular
session by Mayor Paul D. Powers, Jr. Council members present:
Dominguez, Wilson, Caldwell, Geiger, Miller, Grosso and Clark.
Also present: Attorney Riehl and Fire Chief Weatherill. Engineer
Kane and Police Chief Mares excused.
Mayor Powers led the Council and audience in the pledge of Allegiance..
On motion by Councilman Caldwell, seconded and carried, Council
approved the minutes of the September 22, 1980 meeting as circ-
ulated with the following correction: Page 1, paragraph 10 should
indicate Councilman Geiger made motion allowing Illiad, Inc. to
obtain domestic and fire flow water from Annapolis Water District....
Dick Asche, owner of Bremerton-Kitsap Airporter, Inc. addressed
Council relative to proposed shoppers bus route for the Port
Orchard area. Mr. Asche stated he has been in contact with the
State Utilities and Transportation Commission and is in compliance
with State regulations governing this type of transportation service.
City of Port Orchard approval is also necessary for operation within
the City limits. Mr. Asche further stated he is anticipating
commencing bus service in the early Spring 1981. Operating cost
will be high but Mr. Asche is hopeful that with adequate utilization
of this service, they will be able to keep cost to customers reason-
able. Council and Mayor voiced approval and support for this bus
service.
Mayor Powers opened Public Hearing relative to application for
Special Use Permit as submitted by Goodman and Guber to permit
the Church of Nazarene and the Church Parsonage to be converted
into a Day Care Center. The property is located at the corner
of Jones Drive and Sidney Avenue (601 Jones Drive)...
Asst. Clerk read facts of finding and recommendation as presented
to Council by Port Orchard Planning Commission.
Larry Monroe, 1445 Sidney and Brenda Lundell, salesperson, Park
Shore Real Estate, spoke in favor of this Special Use Permit
application stating day care facilities are needed; this is a
convenient location, the type of usage requested for this property
would not be detrimental to neighborhood relative to noise, light
and traffic pollution.
Donald T. Goodman, proponent of application, stated they have planned
a buffer zone protecting neighbors from noises created by children
playing; ingress/egress will be allowed only from Sidney Avenue,
no access from Jones Drive will be possible. He and his partner
have done an extensive study into day care centers and are planning
an educational program for this facility.
On motion by Councilman Caldwell, seconded and carried, Council
approved Special Use Permit application as submitted by Goodman
and tuber and permit the Church of the Nazarene and the Church
Parsonage to be converted into a Day Care Center. The property
is located at the corner of Jones Drive and Sidney Avenue (601.
Jones Drive).
Mayor Powers declared Special Use Permit approved and public Hear-
ing closed.
Councilman Clark moved to authorize mayor Powers to sign Real
Property Lease Agreement with Westbay, Inc. for property located
East of Blackjack Creek and West of Westbay,'`Inc. property.
LEGAL DESCRIPTION: Section 25, Township 24N., Range 1E., W.M.,
Point of beginning: Intersection of the Easterly boundary of the
Maple Street Waterway and the Northerly boundary of SR160 right-
of-way, thence Northwesterly a distance of approximately 435 ft.
along the Easterly boundary of the Maple Street Waterway, thence
Westerly a distance of approximately 48 ft. along the existing
top of bank, thence Southeasterly a distance of approximately 314
ft. along a line defined by the top of bank running parallel to
Easterly boundary of the Maple Street Waterway,.thence Easterly
a distance of approximately 10 ft. along a line defined by the
top of bank, thence Southeasterly along a line defined by the
top of the bank running parallel to the Easterly boundary of the
Maple Street Waterway to the Northerly right-of-way line of SR-
160, thence Easterly along the Northerly right--of-way line of
SR-160 to the point of beginning. Seconded and carried, with
four ayes and three nays. Councilman Grosso, Miller and Wilson
voting no.
Mayor Powers opened Public Nearing relative to Proposed Uses of
1981 Federal Snared Revenue Funds. Mayor called for public input
at this time, three citizens were present but offered no input.
Mayor Powers declared Public Hearing relative to Proposed Uses of
Federal Shared Revenues closed.
Councilman Miller, Chairman Parks Committee, recommended Van Zee
Park be a pedestrian park with vehicle access on Poplar Street
for vehicle parking only. The Port Orchard Kiwanis Club has
volunteered to assist in constructing park facilities. The Parks
Committee would like to have one City employee and certain pieces
of City equipment available on weekends to help with the work.
Council agreed that for the City's protection a City employee
should be operating the City's equipment.
On motion by Councilman Miller, seconded and carried, Council
moved to utilize Lundberg Park as a recreational.vehicle parking
area.
Councilman Grosso, Chairman Police/Fire/Safety Committee reported
South Kitsap High School is employing Volunteer Firemen to post
a 24 hour fire watch until such time as fire/building codes are
complied with at the new school building. Fire Watch personnel
will be paid by the School District.
On motion by Councilman Caldwell, seconded and carried, Council
approved Ordinance No. 1143, regulating parking on the South
side of DeKalb Street from the intersection of DeKalb Street
and Tracy Avenue East to the end of DeKalb Street and creating
a new section in the Port Orchard Municipal Code(10.64.170).
On motion by Councilman Grosso, seconded and carried, Council
set October 27, 1980 as date of hearing relative to adoption of
Final Environmental Impact Statement for the Port Orchard By -
Pass and route alternative.
Mayor Powers announced a Special Study Session on the Port
Orchard By -Pass will be held October 20, 1980, 8:00 p.m. at the
Kitsap County Courthouse.Commissioners Chambers, 614 Division.
On motion by Councilman Clark, seconded and carried, Council moved
to authorize obtaining additional medical coverage for uniformed
employees. Teamster medical coverage does not provide benefits
for job related injuries or illness.
On motion by Councilman Geiger, seconded and carried, Council
authorized payment of the bills Voucher No. 7201 - 7305 in the
amount of $41,857.84 and the September payroll in the amount of
$64,767.05 (Warrant No. 10,763 - 10,876).
