04/14/1980 - Regular - MinutesCouncil of the City of Port Orchard, Washington, called to regular session by Mayor Paul D. Powers, Jr. Council members present: J. Wilson, Caldwell, M. Wilson, Geiger, Miller, Grosso and Clark. Also present: Attorney Riehl, Engineer Kane,.Police Chief Mares and Fire Chief Weatherill Mayor Powers led the Council and audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the March 24, 1980 meeting as circulated with the following correction: Page 3, para. 3, should read "On motion by Councilman Caldwell". Norm Glenn, representative of Department of Ecologv addressed Counci l and Sewer Di stri ct #5 representatives : relative- to alternatives to proposed wastewater treatment facility and read letter dated April 14, 1980 (see file #534.50.4.2.1) from J.F. Spencer, Assistant Director, DOE, outlining DOE's position as of April 7, 1980 special meeting. Mr. Glenn extended offer of his assistance if Council has any questions or desires any information relative to DOE or EPA posiition on alternatives -to proposed plan. Clerk read bids received for passenger car, March, 1980: 1. Grey Chevrolet, (cashiers check in the amount of 5% of bid amount attached), Bid total $6,661.44. Grey Chevrolet, (alternate bid) Bid total $6,567.36 2. Walker Chevrolet, "No Bid" On motion by Councilman M. Wilson, seconded and carried, Council referred bids for passenger car to Engineer and Finance Committee for their recommendation. Clerk read bids received for diesel powered tractor and trailer: I. Eastlake Kubota Tractor (disqualified, no bid bond attached) 2. ABC Rentals (disqualified, no bid bond attached)_ 3. Sound Tractor Company (bid bond attached) $4,862.75 (alternate bid) $6,363.28 4. Buck & Sons Tractor Company (bid bond attached).$5,108.10 (alternate bid) $6,213.75 5. Redmond Lawn & Tractor Equipment (bid bond attached) $5,410.54 On motion by Councilman Caldwell, seconded and carried, Council referred bids on to City Engineer and Finance Committee for. recommendation. Mayor Powers reopened Public Bearing relative to application for zone reclassification RH to MF-20 as submitted by Wry Bloomquist for his property located at 303 Perry Avenue North. Councilman Grosso reported Special Committee set up by Mayor Powers at March 24, 1980 meeting has met with Wm Bloomquist, applicant Dudley Perrine, Attorney and Tom Herstad, Architect and explained what could be constructed on this property within requested zone reclassification. Dudley Perrine, Attorney representing Mr. Bloomquist submitted new set of plans (to be attached to application for zone reclassification for property located at 303 Perry Avenue North. Councilman Caldwell moved that Council approve application for zone reclassification as submitted by Wm. Bloomquist from "RH to "MF-20 for his property located at 303 Perry Avenue North contingent upon applicant upgrading parking facilities to eight spaces to conform with plans as presented and that both parcels of property be converted to one tax lot. Seconded. Councilman Grosso moved to amend motion to state building will be constructed in accordance with plans as submitted. Seconded and carried, with 6 ayes and 1 no. Councilman J. Wilson voting no. Original motion as amended carried, with 6 ayes and l no. Councilman J. Wilson voting no. Mayor Powers declared rezone to MF-20 approved and nearing closed. Mayor Powers declared recess with meeting -to reconvene at 9:30 P.M. Councilman Geiger moved to proceed with and complete the following Federal Shared Revenue projects: Insulate Council room, insulate fire hall doors, Rockwell sidewalk, City Hall carport and construct wheel chair ramps in downtown area. Seconded and carried with four ayes and three nos. Councilman Caldwell, M. Wilson and J. Wilson voting no. Councilman M. Wilson moved to allow department heads to send. employees to job related training schools with Mayor Powers concurrence provided funds are available within the budget. Seconded and carried, with 6 ayes and 1 no. Councilman J. Wilson voting no. On motion by Councilman Caldwell, seconded and carried, Council rejected bids received for passenger car. All bids were in excess of budgeted funds. On motion by Councilman Caldwell, seconded and carried, Council granted Engineer Kane and Finance Committee authority to accept or reject bids received for diesel powered tractor. Police Chief Mares expressed concern for safety of members of Cedar Heights and South Kitsap High School marching bands. Both bands have been allowed to practice marching on City streets. Chief Mares stated that with increased traffic and the careless- ness of a few drivers, marching on City streets`i.s hazardous.' Mayor & Council instructed Chief Mares to write letter to Cedar Heights Jr. High School and South Kitsap high School informing them that the City would no longer allow them to practice marching on City streets. On motion by Councilman Caldwell, seconded and carried, Council accepted applications for fireworks stands from Pee Wee, Lions and Rotary organizations and moved to allow them to. set up fireworks stands for the Fourth of July holidays. On motion by Councilman Grosso, seconded and carried, Council set April 28, 1980 as date of hearing relative to rezone application as filed by Ray Pace, Wilhelmi Construction for property located.on Lots 4 & 5 Etta B. Jones Additions to Port Orchard., Council will also hear appeal to Planning Commission recommendation to Council for denial of rezone request as filed by Ray Pace, Wilhelmi Construction. On motion by Councilman Caldwell, seconded and carried, Council approved Ordinance No. 1032, amending Ordinance No. 1067 regarding legal description of Charles Childress and Frank Christen annex- ation. On motion by Councilman Clark, seconded and carried, Council set April 28, 1980 as date of hearing relative to appeal submitted by Al Craig, on building code violations filed against his property located at 810 Bay Street. Page 3 of 3: April 14, 1980 Clerk read letter from Joseph F. Shirley, 879 Puget Drive, Port Orchard, Washington requesting reimbursement of parking fee. Mr. Shirley received a $5.00 fine for parking in a "No Parking 7:00 AM - 8:00 AM".area and would like the ;$.50 parking fee reimbursed. On motion by Councilman Caldwell, seconded and carried, Council rejected request of Joseph F. Shirley, that the ':..5-50 parking fee he paid be reimbursed. Mayor Powers reopened Public Hearing relative to application for vacation of a portion.of Sroufe Street as submitted by Bill and Deborah Noerenberg, Councilman Caldwell moved to vacate a portion of Sroufe Street as requested in petition submitted by Bill and Deborah,Nuerenberg. Seconded. Councilman M. Wilson moved to table motion to vacate a portion of Sroufe Street as requested by Bill & Deborah Noerenberg"to allow Engineer to determine if utility easement should be re- tained on this property. Seconded and carried. On motion by Councilman Geiger, seconded and carried, Council approved payment of bills, Voucher No. 6632 - 6735 in the amount of $98,744.68 and the march payroll in the amount of $58,882.25 (Warrant No. 10062 - 10165) Meeting adjourned at 11:10 P.M.
