09/08/1980 - Regular - MinutesPage 1 of 3 Port Orchard, Washington September 8, 1980 Council of the City of Port Orchard, Washington, called to regular session by Mayor Paul D. Powers, Jr. Council members present: Grosso, Wilson, Caldwell, Geiger, Miller and Clark. Also present: Attorney Riehl, Engineer Kane, Police Chief Mares and Fire Chief Weatherill. Mayor Powers led the Council and audience in the Pledge of Allegiance. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of the August 25, 1980 meeting as circulated. Mayor Powers opened Public Hearing relative to application for Zone Reclassification as submitted by Robert Stewart, owner of record for property located at 1272 Sherman Ave. Applicant has requested prop- erty to be reclassified from Residential High (RH) to Multiple - Family 20 (MF-20) to allow two more units to be built in an existing duplex. Clerk read Findings of Fact and Conditions of Approval as recommend- ed by the Planning Commission. Mayor Powers called for public input at this time, no one voiced opposition to this proposal. On motion by Councilman Caldwell, seconded and carried, Council approved application for Zone Reclassification as submitted by Robert Stewart to reclassify his property at 1272 Sherman Ave. to Multiple --Family 20, contingent upon applicant complying with Findings of Fact and Conditions of Approval as recommended by the Planning Commission and adopted by the City Council. (Legal Description attached) Mayor Powers declared Rezone request approved and Public Hearing closed. Mayor Powers opened Public Hearing relative to application for Zone Reclassification as submited by Iliad, Inc., owner of record for property located at 1730 and 1750 SR 160 between the South Kitsap Mall and the Washington National Guard Armory. Applicant proposes to build an office/retail complex. Lee Little, representing Iliad, Inc. exhibited site plan and drawings depicting proposed development. Clerk read Findings of Fact and Conditions of Approval as re- commended by the Planning Commission. Mr. tittle requested Iliad, Inc. be allowed to obtain domestic water and fire flow water from Annapolis Water District and asked for clarification as to intent of provision under "Condition of Approval which states the land will revert to the zoning classi-` fication it had prior to the rezone if a project is not started within 18 months. Mayor Powers explained City's intent is that project is in an active stage of construction. He also informed Mr. Little that it is the City's policy that property within the City limits rust be served domestic water by the City of Port Orchard Water Department. On motion by Councilman Clark, seconded and carried, Council approved application for Zone Reclassification from Residential Low to Commercial General as submitted by Iliad, Inc. for their property located at 1730 and 1750 SR 160 with the stipulation that approval is contingent upon: 1. Developer must obtain domestic water from City of Port Orchard Water Department and can obtain fire flow water from Annapolis Water District. 2. Land will revert to the zoning classification it had prior to the rezone if construction on a project is N Page 2 of 3 Port Orchard, Washington September 8, 1980 not started within 18 months of finalization of Agreement with South Kitsap Mall owner, Buck Gehring$ to allow ingress and egress to be combined for the two sites, eliminating a need for another access onto SR 160. Council also adopted Planning Commission Findings of Fact and Conditions of Approval as part of approval of Zone Reclassificat- ion. (Legal Description attached) Mayor Powers declared Zone Reclassification approved and Public Hearing closed. George Bowers, representing East Port Orchard Towing, informed Mayor and Council that the Washington State Patrol has assigned them the area East of Wilkins Road/SR 160 to Colchester Road and all points North in which to operate. Owners of East Port Orchard Towing requested that City of Port Orchard use the service of their company. Mayor Powers stated he will discuss matter with Chief of Police and be in contact with East Port Orchard Towing. Mayor Powers declared recess with meeting to reconvene at 9:00 P.M. On motion by Councilman Caldwell, seconded a'nd carried, Council moved to issue a call for bids relative to installation of individ- ual thermostatic controls on radiators and a circulating pump for heating improvements in City Hall. On motion by Councilman Caldwell, seconded and carried, Council authorized installation of street lights in the following six locations: 1. Tremont & Cedar Canyon Lane 2. Tracy -(.Between DeKalb and Morton) 3. East of Sweany off Hull 4. West of Dwight off Mitchell 5. Old Clifton Road (Fur, Fin & Feathers) 6. Roland & Tremont On motion by Councilman Caldwell, seconded and carried, Council appointed John Dominguez to fill Council position vacated by the resignation of Mary Roy Wilson. On motion by Councilman Grosso, seconded and carried, Council authorized extending "No parking 7-8 A.M." on the East side of Prospect from Kitsap to Prospect Street corner. Councilman Clark, Chairman Water/Sewer Committee, reported letter was received from Mrs. Jennie B. Bruce reporting a possible water meter malfunction. The Dater Department has removed the meter, tested it and found that the meter is faulty. They have installed a new meter at 339 Farragut. Mayor Powers instructed Clerk to adjust Mrs. Jennie B. Bruce's water billing for the month of duly/August to reflect her normal consumption and billing. Police Chief Mares reported that Sergeant Benton is on disability leave for a period of two months. His condition at the end of disability period will dictate if he returns to work or not. On motion by Councilman Caldwell, seconded and carried, Council moved to instruct Blossom Brothers Construction Co. to increase their liability coverage $1,000,000.00 for the Perry Avenue Retaining Wall Construction job. Council further moved that in the event Blossom Brothers Construction has not signed a contract for the Perry Avenue Retaining Wail Construction job and delivered it with the necessary insurance coverage policies by the close of business September 12, 1980, their bid guarantee shall be forfeited to the purchaser as liquidated damages. Clerk read letter from Port Orchard Lodge No. 98 inviting Council and Mayor to attend the cornerstone laying ceremony on September 20, 1980 for two new South Kitsap Schools. Port Orchard, Washington Page 3 of 3 September 8, 1980 On notion by Councilman Geiger, seconded and carried, Council authorized payment of the bills, Voucher No. 7127 - 7200 in the amount of $20,758.10 and the August payroll in the amount of $75,780.30 (Warrant No. 10609 - 10762).
