09/08/2003 - Regular - MinutesPort Orchard, Washington Minutes of September 8, 2003 Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 p.m. at City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers, Rider. Councilman Cramer excused. Staff present: Police Chief Townsend, City Engineer Curies, City Planner Wenman, Deputy Clerk Merlino, City Clerk Etgen and City Attorney Jacoby. Call to order Councilman Rider led the audience and Council in the Pledge of Allegiance. Audience Comments Mayor Weatherill asked for audience comments for items not listed on this agenda. No comments were received at this time. New Business Public Hearing: Continued Deliberation of Public Hearing Relating to an Appeal of Staff Determination Regarding Claise & Mike Construction Mayor Weatherill announced, at the request of the City Attorney, that this continued Public Hearing would be continued to the September 22, 2003 City Council meeting. Approval of Proposed Amendments to City of Port Orchard Policy 200-005 Regarding Family and Medical leave. On motion by Councilwoman Powers, seconded by Councilman Geiger, Council approved the amendment to the City of Port Orchard Policy 200-005 regarding Family and Medical Leave. Consent Agenda On motion by Councilman Geiger, seconded by Councilman Clauson, Council approved the consent agenda as follows: A. Minutes of the August 25, 2003 regular City Council meeting. B. Approval of Claim Warrants #39721-39824 in the amount of $162,515.23 and August 2003 Payroll Warrants #137569-137677 and direct deposits in amount of $429,728.45. C. Ordinance No. 1912 authorizing the vacation of a certain unnamed alley through Block 5, as shown on the Plat of S.M. Stevens' Town Plat of Sidney, as recorded in Volume 1, Page 1, of Plats, Records of Kitsap County, Washington. D. Ordinance No. 1913 amending Port Orchard Zoning Ordinance No. 1748 by amending the City of Port Orchard zoning map to change the zoning classification of certain property located at 604 Dwight Street from R8 to Community facilities as well as approving a site specific plan, subject to conditions, to allow for the redevelopment of properties to construct a County Administration Building. September 8, 2003 Page 2 of 4 E. Ordinance No. 1914 relating to and providing for the annexation of territory to the City of Port Orchard for municipal purposes. Known as the Ancilla Tripp property located at 4940 Bethel Avenue. F. Authorization for the Police Chief to declare as surplus forfeited firearms and dispose of them in the best interest of the City. Attachment "A" G. Authorization for the Mayor to sign Memorandum Regarding Terms and Conditions of Employment During Special Assignment -Jason Glantz. Reports Councilman Clauson reported the Water/Sewer Committee met and discussed the Port Orchard Boulevard Sewer Main Project. The Committee recommended changing the wooden light standards on the west side of the boulevard with up-to-date Puget Sound Energy light standards. The east side of the boulevard would maintain the wooden light standards. This would eliminate the cost of maintenance by the City of Bremerton and the need to construct future wood poles as others are replaced. The Council and Mayor concurred with the Water/Sewer Committee's recommendation. New Business (continued) Public Hearing: Street Vacation Request for a Portion of Wendell Avenue and a Portion of Palmer Avenue (Brady) Mayor Weatherill opened the 7:35 p.m. Public Hearing regarding a Petition to Vacate (1) a portion of Wendell Avenue; and (2) a portion of Palmer Avenue, as submitted by Ralph and Gladys Brady. The City Attorney advised this is a Quasi-Judicial Hearing and asked if the Council had any ex parte contact with any individuals regarding this issue prior to this hearing and if the Council has any reason why they cannot render an impartial decision on this matter. No comments were received by the Council. The City Attorney asked the audience if they see any reason why the Council cannot render an impartial decision. No comments were received from the audience. The City Attorney reported this Public Hearing had been continued from the August 25, 2003 City Council meeting to allow Mr. Brady an opportunity to provide additional information and also allow time for City Staff to research whether there are utilities in the property. City Attorney advised the additional information was received from Mr. Brady and no utilities are located on the property. Mr. Ralph Brady, proponent, addressed Council and made himself available for questions from the Council. Mayor Weatherill called for audience comments either for or against the proposed Petition to Vacate (1) a portion of Wendell Avenue; and (2) a portion of Palmer Avenue, as submitted by Ralph and Gladys Brady. As no further comments were received, Mayor Weatherill closed the public input portion of the Public Hearing and referred this matter to Council for their consideration. September 8, 2003 Page 3 of 4 On motion by Councilman Clauson, seconded by Councilman Morrison, Council adopted Resolution No. 2039 recognizing the vacation by Operation of Law of a portion of Wendell Avenue and a portion of Palmer Avenue. Public Forum and Debate on the Pros and Cons of the Passenger-Only ferry Ballot Issue (Dick Hayes, Kitsap Transit) Mayor Weatherill opened the Public Forum and Debate on the Pros and Cons of the Passenger- Only Ferry Ballot Issue. Dick Hayes, representing Kitsap Transit presented Kitsap Transit's Passenger-Only Ferry Investment Plan. Mr. Hayes outlined several points of interest as follows: • The service relates to Bremerton, Kingston and Southworth, with direct route to downtown Seattle. • Increase in fares to $9.00 per round trip • The fleet consists of 14 smaller, 149 passenger boats. o Each boat will cost approximately $2 million to $2 1h million o Five boats per port o Bow-loading for quick loading/unloading of passengers o Low-emission engines and low wake-wash • Rush hour departures every 15-20 minutes and off-peak departures every hour. • Operating Costs approximately $16.0 million per year initially o $8.7 million from local sales tax and Motor Vehicle Excise Tax o $8.2 million from fares and other income • Seamless connections with Kitsap Transit buses and park-and-ride lot system Mr. Hayes discussed the working relationship with the Washington State Ferry Systems specifically to its labor union via interlocal agreements. Mr. Hayes also discussed the source of funding as follows: • 3/10th of a cent from local sales tax • 3/10th of a percent of car value-only on license renewals • Increase in fares • Miscellaneous income from sales of coffee, doughnuts, etc. • Federal funds-minimum per year Councilman Morrison commented he supported the Passenger Only Ferry concept, however he expressed a concern with the increase in sales tax for funding purposes. September 8, 2003 Page 4 of 4 At this time Mayor Weatherill asked for audience comments regarding the Passenger Only Ferry Ballot Measure. Ron Rice, 375 Sedgwick Road, spoke in favor of the Passenger Only Ferries, however expressed a concern with the taxing of motor vehicles. Mayor Weatherill and Council thanked Mr. Hayes for his presentation. On motion by Councilman Clauson, seconded by Councilman Wyatt, Council adopted Resolution No. 2041 supporting Kitsap Transit's Passenger-Only Ferries Investment Plan. Motion passed with 5 ayes and 1 nay, with Councilman Morrison casting the dissenting vote. Reports (continued) Councilman Geiger confirmed and scheduled the following Finance Committee meetings: • November 12, 2003, 7:30 p.m. at City Hall. • November 13, 2003, 7:30 a.m. at City Hall Mayor Weatherill referred to a letter received from City Attorney Loren Combs regarding a Special Project Status Request for Code Enforcement Cases. On motion by Councilman Morrison, seconded by Councilman Clauson, Council authorized the Mayor to sign the Special Project Status Request to transition legal services billing for the Code Enforcement Cases from the City Attorney routine-retainer account to the City Attorney extraordinary expense (non-retainer) account. Councilman Morrison reminded the Street Committee of their meeting scheduled September 11, 2003, 7:30 a.m. at Myhre's. Mayor and Council set the week of October 6 -10, 2003 as 2003 Fall Clean-up.
