RE: Committee Minutes
The Public Property Committee met at the Family Pancake House for
a breakfast meeting, 26 May 1995. Members present were Carolyn
Powers and Jack Grable. John Clauson was absent since the
discussion was about the Kitsap Transit lease. Also present was
Larry Curles.
The City has agreed to lease space to Kitsap Transit as part of
Transit's contribution to the library addition. Transit prepared
a draft lease, which is enclosed for the Council, and the
Committee reviewed it. The following comments will be forwarded
to Transit:
I. In paragraph 4(a), the word "average" is not
applicable. The lease rate will be established and the
term duration derived from that established rent value.
2. The issues of a sublease needs to be included. Horlock
is a sublease of which the City approves. Any other
subleasing of the facility needs prior approval of the
City. The City needs to have insurance requirements
3. The City Clerk is asked to determine what
appropriate level of insurance coverage.
4.- The restrooms will be mai.ntafned-iyaTransit and
available to the public. These requirements need to be
in the lease.
5. The Transit area is supposed to be an office/work space
for Transit activities. Since the lease could be in
affect for 10 or 20 years, this use needs to be better
defined. Right now it is only in the recitals and does
not limit the area to offices.
The Committee also discussed the lease with Howard Minor, City
Hall design and a possible Council retreat.

$1,000,000 each accident.
THE CITY shall be specifically named as an Agditional Insured.
d) Certificates of .Insurance shall be provided to THE CITY upon
---.commencement of this AGREEMENT.
12, Severability If any term or provision of this AGREEMENT, or the application thereof
to any person or circumstance, shall to any extent be invalid or unenforceable, the
remainder of this AGREEMENT, or the application of such term or provision to persons
or circumstances other than those as to which it is held invalid or unenforceable, shall not
be affected thereby and shall continue in ftill force and effect.
