The Finance Committee met at 7:30 AM, Wednesday, 31 July 1996
for a breakfast meeting at Myhre's. Members present were Bob
Geiger, Don Morrison, and John Clauson. Also present were City
Attorney Jim Sells and Larry Curles.
Jim Sells updated the Committee on the law suit and rent issue
with the DNR concerning the lease area.
Once the law suit had been filed by the City, the State AG
moved to dismiss it. The matter was heard by Judge Roper and
the parties are waiting for the Court's opinion.
Jim Sells met with a State attorney and a DNR staff person who
was knowledgeable on harbor lines. The meeting was at the
parking lot. He re-emphasized to the State that the City wants
to meet directly with them and the State DNR employee said she
would arrange this. She was not optimistic about moving the
Inner Harbor Line. She stated that even if it was moved, the
cost of the property would be very expensive. She also noted
that the State would not sell the property. The Committee
indicated to Jim that those arguments will be addressed during
the course of the action. Jim noted that there are several
inconsistencies in the regulations concerning the IHL. In
addition, the law gives the Agency's interpretation of the
rules more credence that someone else's interpretation. This
gives DNR the advantage.
The Committee reaffirmed that it wants the annual rent
adjusted to account for the park and utilities. The park is
free and open to the public. Jim noted that we should name the
park and dedicate some number of parking spaces to it.
The DNR is reorganizing and will become "regional" instead of
being under centralized management. It is not yet known how
this would affect the City.
The Committee and Jim Sells discussed how to influence the DNR and
Legislature. The discussion included lobbying, drafting sample
legislation, and coordinating with the AWC
in order to prepare for continued discussions, the City needs to do
the following:
1. Provide Jim with an updated map showing the utilities in
this area. The utilities would include sewer, stormwater,
water and sidewalks.
2. Send a letter to DNR formally asking to have the rent
adjusted. Point out that the park is complete and provide
the dimensions. Also refer to the utilities and the fact
that this used to be a road.
3. Do a comprehensive survey of cities abutting the Puget
Sound to determine if they are having this struggle with
DNR and if they have a port in their jurisdiction.
The Committee then discussed the issue of Lund Road. After the
completion of the road, the City still has title to the right of
way that was purchased. The Committee recommends that the City
transfer this right of way to the County.
The Committee reviewed the survey of the Guthrie Street right of
way. The City will advise the property owner that his house is
encroaching in the street and the City would consider a vacation
request. The other solutions would be a property line adjustment
for the entire neighborhood.
