Minutes of June 27, 1996
The meeting was convened at 7:30 am at Myhre's. City Council members Geiger, Powers, and
Van Zee were present as was City Planner Gross.
Discussion centered around a request from Rene LaMarche clarifying conditions for a special
use permit granted in 1990 for 715 Sidney Avenue. Mr. LaMarche requests the removal of the
existing fence on the property and the reconfiguration of three parking spaces. The conditions
of approval in Resolution No. 1539 do not address a fence. The approval was not site plan
specific. However, an amended site plan displaying the parking layout was a condition of
approval; parking was conditioned to not be decreased without City Council approval. The
amended site plan displayed a fence.
The owner now wishes to amend the parking plan by changing the location of three of the
parking spaces and removing the fence. The required signage is proposed to remain, and the
number and size of the parking spaces is not proposed to change.
The Committee discussed the traffic patterns and the prohibition of left turn entrances to the site.
Ultimately, there was no opposition to altering the parking configuration nor removing the fence
as long as the signs would remain. These were determined to be insignificant alterations to the
site. However, it was noted that condition of approval number 4 which refers to landscaping
of the property lines along the parking lot has not been met. The Committee stated that planter
boxes with landscaping should be added along the property lines along both Sidney Avenue and
Ada Street.
The Committee then had some general discussion concerning urban growth boundaries and the
County's status regarding the adoption of its Comprehensive Plan. Specifically, the need for
direct communications between the City Council, the County Planning Commission, and both
respective staffs was discussed. The Committee is in favor of having a face to face meeting with
members of all of the above parties to discuss our concerns and mutual needs. It was suggested
that this meeting should take place as soon as possible.
In other matters, Councilmember Van Zee informed the Committee that he is still waiting for
information from US West and Puget Power representatives concerning potential Welcome sign
amendments.
The meeting was adjourned at 9:00 am.

Re: 715 Sidney Ave, Perimeter Fence
Dear Ms Gross;
We respectfully request permission to remove the fence around the
perimeter of the parking area at 715 Sidney Ave, Port Orchard,
WA. We propose that parking space be re -arranged in a manner
that provides the same number of parking spaces as originally
approved; and, further propose, to install parking curbs and
signs more easily maintained than is currently possible.
Attached please find Sketch 1 which reflects the existing site
plan for parking as approved relative to the issuance of a
Special Use Permit for subject property granted under Resolution
No. 1539 of 1990.
Sketch 2 reflects a proposed parking plan that neither reduces
nor increases the number of parking spaces provided for in the
Special Use Permit. The proposed plan provides an equal or
better measure of the type of traffic control detailed in
Resolution No. 1539.
DISCUSSION: Since occupation of the building at 715 Sidney Ave,
Port Orchard, WA, on or about October 25, 1990, the only place to
install signs is on the existing fence. Attaching the signs to
the fence (and at an easily reached location) has made them
highly pilferable and we have replaced 3 sets.
The fence is constantly being impacted by automobiles turning in
or backing around from the current parking locations. The
damaged appearance of the fence detracts from the general
appearance of the building and the neighborhood.
PROPOSED PLAN: Our request entails several parts including; but
not necessarily limited to the following:
a. Install a 4" X 4" pressure treated post at the Northwest
corner of the existing exit way onto Ada St and bolt a sign to
the post stating: "EXIT ONLY. NO ENTRY." The sign would face
Ada St.
b. Install a 411 X 4" pressure treated post at the Northwest
corner of the existing entry way from Sidney Ave. Bolt one
sign to the post in a manner that can be read by traffic
traveling from North to South on Sidney that reads: "NO LEFT
TURN TO PARKING." Place an additional sign on the same post
facing the building at 715 Sidney Ave that reads "ENTRY ONLY.
NO EXIT."
C. Remove the existing fence around the perimeter of the
parking area. Cut off metal posts at asphalt grade level and
fill openings with Thoroughcretef" Grout. Remove all grass and
weeds growing in asphalt and concrete seams. Inject a
herbicide into asphalt and concrete seams. Fill all cracks and
seam openings with an asphalt base, patching material.
d. Install concrete curb bumpers in front of the three parking
stalls in the Northwest parking lot area facing Ada St (to the
North) to prevent users from running over the curb when exiting
the parking lot.
e. Install concrete curb bumpers behind the parking stalls (in
line where the fence is proposed to be removed) facing the
building to prevent users from backing out of those stalls,
over the curb, onto Sidney Ave (to the West).
f. Mark traffic flow directions on the parking area pavement.
Approval of our request will permit us to make the changes at the
same time that we perform maintenance in the parking area;
particularly, re -striping of parking lot spaces.

RESOLUTION NO. 1539
A RESOLUTION OF THE CITY OF PORT ORCHARD
APPROVING THE ISSUANCE OF A SPECIAL USE
PERMIT TO BETHANY LUTHERAN CHURCH, LOCATED AT
715-717 SIDNEY AVENUE FOR A SPECIFIC USE OF A
PARCEL OF PROPERTY WHICH IS IN HARMONY WITH
THE VARIOUS ELEMENTS OR OBJECTIVES OF THE
COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO
EXISTING USES PERMITTED IN THAT PARTICULAR
ZONE.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
HEREBY RESOLVE:
THAT: Whereas the City Planning Commission has held
the required public hearings in accordance with the criteria set
forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469,
Zoning Ordinance of the City of Port Orchard, and;
WHEREAS, the City Planning Commission has recommended
approval of the application by Bethany Lutheran Church located at
715-717 Sidney Avenue, and has recorded with the City Clerk their
decision setting forth their findings and recommendations.
NOW, THEREFORE, the City Council ❑f the City of Port
Orchard does adopt Planning Commission Resolution No. 145-90, with
Findings, Facts and Conclusions as their own and hereby approves
the issuance of a Special Use Permit to allow professional offices
in a residential area, and set additional conditions: (1) to allow
right in and right out turns only, south'of the former church
building; (2) right in turns only from the former school building;
(3) to designate one out of three parking spaces for customer
parking only; ( 4 ) the property lines along new driveway and parking
lot be screened with landscaping, such as a laurel hedge; (5) all
handicapped spaces be installed as provided by State standards; (6)
the parking plan be modified to show correct dimensions and become
site plan specific. Parking cannot be decreased without City
Council approval. (7) Any parking lot lighting installed be
shielded to reduce glare to the neighbors; (8);the former church
building be structurally inspected prior to its conversion to
offices, in accordance with the conditions imposed by Ordinance No.
1469, Chapter 6.
LEGAL DESCRIPTION: Section 26, Township 24N, Range 1£, Portion of
the SE 1/4 of the SE 1/4; Beginning at a point 403 feet south and
30 feet east of the NW corner of the SW 1/4 SW 1/4; thence south
125 feet, east 72 feet, north 125 feet and west 72 feet to the
point of beginning. Also Lots 1 and 2 of Wheelers 3rd Addition to
Sidney.
