01/13/2003 - Regular - MinutesPort Orchard, Washington January 13, 2003 Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers, Rider, and Cramer. Staff present: Police Chief Townsend, City Planner Wenman, City Engineer Curies, City Attorney Combs, Deputy Clerk Merlino, and City Clerk Parks. Councilman Wyatt led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. No comments were received at this time. Janice Sedlak, Department of Ecology, presented the National Pollutant Discharge Elimination System (NPDES) permit requirements. Ms. Sedlak discussed the rules for Phase I and Phase II of the storm water program. The Department of Ecology is currently coordinating with all cities in the northwest region by preparing a general application for compliance with Phase II of the federal regulations. Mary McClure, KRCC Executive Director, presented an update on broadband telecommunication within Kitsap County and asked what is the City's goal and action plan for broadband. Councilman Clauson stated the City of Poulsbo has sent a letter to all cities in Kitsap County asking if -··-·-.. ___ the_y_a[e_intemste.d_in_explming_ the_p.ossibility_of.forming.a. Broadband.cooperative .... Councilman_Ciauson and Mayor Weatherill both concurred it is the City's intent to stay involved in any Broadband discussions. Ron McAffee, Director Kitsap 911 (CENCOM) and Dave Magnenat, Deputy Director Kitsap 911 (CENCOM) presented the proposed countywide 1/101 h of 1% sales tax measure, which CENCOM is planning to submit for the April 22, 2003 ballot. Mayor Weatherill advised this is a public forum discussion regarding CENCOM's (911) proposal and asked if anyone in the audience would like to speak for or against this ballot measure. At this time no comments were received from the audience. On motion by Councilman Clauson, seconded by Councilwoman Powers, Council adopted Resolution No. 2003 demonstrating support for placing a countywide 1/101h of 1 percent sales tax measure on the ballot to provide funding for 911 services. Motion passed with 6 ayes and 1 nay. Councilman Cramer voting nay. At 8:30 PM Mayor Weatherill called for a 10 minute recess with meeting reconvening at 8:40 PM. Dick Myers, representing AMCO Homes, addressed Council requesting a waiver of the city's street standards for development of Lovell Street, stating the subject street is a short dead-end street and will serve a limited amount of residents. City Attorney Combs advised Council Mr. Myers did not pay for or receive any building permits from Kitsap County prior to annexation into the city, therefore the City cannot allow a waiver of City street standards. A waiver of street standards would put the city in a potential liability risk if anyone were injured on a substandard city street. On motion by Councilman Morrison, seconded by Councilman Cramer, Council denied Mr. Myers's request to waive the city's street standards for development of Lovell Street. Ordinance No. 1887 amending the City of Port Orchard Comprehensive Plan Ordinance No. 1634; by amending the Comprehensive Plan Map for select properties located primarily on the plateau of the Ross Point Peninsula; abutting SR-166 to the north and west; SR-16 to the south, and Ross Creek Corridor along the eastern boundary. (CA-14-02) I. Ordinance No. 1888 amending the City of Port Orchard Zoning Ordinance No. 17 48; by amending the zoning map for select properties located primarily on the plateau of Ross Point Peninsula, abutting SR- 166 to the north and east, SR-16 to the south and Ross Creek Corridor along the eastern boundary. (R-1142) m. Ordinance No. 1889 amending the City of Port Orchard Comprehensive Plan Ordinance No. 1634; by amending the Comprehensive Plan Map for a parcel located north and west of the intersection of Canyon Court and Tremont Avenue, and adjacent to east of SR~16. (CA-15-02) Councilman Cramer requested staff prepare draft ordinances updating the Port Orchard Criminal Code, Title 9. The draft ordinances will be presented and considered at the January 27, 2003 City Council meeting. Councilman Cramer presented Police Chief Townsend's request to implement a Marine Patrol Program within the Police Department. Councilman Cramer advised the request would not involve any general fund money, however currently there is approximately $3,000 from the (SIU Fund) drug seizure money that could be utilized to implement the program. On motion by Councilman Cramer, seconded by Councilman Wyatt, Council authorized Police Chief Townsend to implement a Marine Patrol Program within the Police Department utilizing up to a maximum of $3,000 from the SIU Fund. On motion by Councilwoman Powers, seconded by Councilman Morrison, Council authorized the City Engineer to secure the acquisition of the Ancilla Tripp property located at 4940 Bethel Avenue (112301-1- 011-2000) by satisfying the Department of Social and Health Services (DSHS) creditor's claim of $61,903.69. The City Council set February 3, 2003 at 7:30 PM as the date and time for a joint meeting with the Kitsap County Commissioners to discuss how the City and County should jointly plan for the South Kitsap Urban Growth. On motion by Councilman Clauson, seconded by Councilman Geiger, Council moved to pay KRCC $300.00 which was requested by KRCC in 2002 to fund an additional KRCC administrative support staff member. Motion passed with 4 ayes and 3 nays. Council members Cramer, Rider and Morrison voting nay. Council members Clauson, Wyatt, Geiger and Powers voting aye. The City Council set March 3, 2003 at 7:30 PM as the date and time for a Study Session with the Planning Commission to discuss Growth Management Regulatory Policies.
