Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 P.M.
at City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Powers, Rider, and Cramer.
Councilman Morrison excused February 10, 2003, Councilman Geiger excused page two, paragraph 8.
Staff present: City Engineer Curies, City Planner Wenman, City Attorney Amann, Deputy Clerk Merlino, and
City Clerk Parks.
Councilman Clauson led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda. No comments were
received at this time.
Correne Hall and Alan Hurr invited the Mayor and Council to the 52nd Annual 2003 WA State Square and
Folk Dance Festival scheduled at the Kitsap County Fairgrounds, June 20 and 21, 2003. Also in
recognition of the 52nd annual event, Mr. Hurr presented the city with a framed event poster and asked that it
be placed in a public area.
Mayor Weatherill opened the 7:35PM Public Hearing regarding an amendment to the Port Orchard Zoning
Ordinance No. 17 48 relative to the city's Significant Tree Retention Policy.
City Planner Wenman presented staff report stating the standards for protecting significant trees are
provided in Chapter 83, Section 15 thru Section 22 of the Port Orchard Zoning Ordinance. City Planner
Wenman advised the current zoning ordinance has conflicting language that defines a significant tree as
both ten-inches in diameter as well as eighteen inches in diameter. Other items of discussion were the
replacement ratio of 3 trees planted for each removed significant tree, special requirements for trees in
excess of 36 inches and replacement trees required to be a minimum of 6 feet in height.
Mayor Weatherill called for audience comments regarding the proposed amendment to the Port Orchard
Zoning Ordinance No. 1748 relative to the city's Significant Tree Retention Policy. As no comments were
received, Mayor Weatherill closed the public input portion of the Public Hearing and referred this matter to
Council for their consideration.
On motion by Councilman Rider, seconded by Council members Cramer and Powers, Council moved to
approve Ordinance No. 1895 amending the City of Port Orchard Zoning Ordinance regarding retention of
significant trees.
Councilman Clauson moved to table motion approving Ordinance No. 1895 for further review, seconded by
Councilman Wyatt. Motion failed with 2 ayes and 3 nays. Councilmen Clauson and Wyatt voting nay.
Original motion, approving Ordinance No. 1895 amending the City of Port Orchard Zoning Ordinance
regarding retention of significant trees, passed with 3 ayes and 2 nays. Councilman Clauson and Wyatt
voting nay.
Karen Ross, Kitsap County Project Manager, presented an overview of the county administration's efforts to
develop a master plan to guide future County Courthouse improvements. Eric Schmidt, Miller-Hull
Architects discussed in detail the proposed master plan phases, such as within 5 years (2008) the
completion of the Kitsap County Administration Building and associated parking; 5-20 years (2023) the
county is proposing to begin acquiring and developing office space in the remaining parcels south of Taylor
Street; 20-40 years (2043) the county is proposing to expand the Law and Justice Building, development of
government offices on corner of Sidney and Division, develop parking on Austin Avenue; over 40 year the
county is proposing to begin acquiring and developing government office and associated parking in the two
blocks between Smith Street and Givens Community Center, begin building a parking structure on the west
side of Austin between Smith and Taylor.

Sian Roberts, Miller-Hull Architects, presented preliminary site plans and a concept model of the proposed
County Administrative Building. Ms. Roberts indicated on the proposed model the entrance to the new
Administrative Building will be located directly across from the current County Courthouse entrance on
Division Street; the architects are proposing sidewalks up Cline Street with a friendly pedestrian path to and
from the downtown area; angle parking is proposed around the new facility and cost energy saving features
will be implemented as much as possible within the building.
Councilwoman Powers suggested the county consider placing a pocket park or plaza at the SidneyfTaylor
Street intersection to break-up the appearance of continual office type structures.
Karen Ross and the architects thanked the Council and Mayor for their input and advised they will return
with more information as the project progresses.
At 8:40 PM Mayor Weatherill called for a 10 minute recess with meeting reconvening at 8:50 PM.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council approved Ordinance No. 1896
amending Port Orchard Municipal Code 13.04.060 (Section 8 of Ordinance No. 1799) increasing the Water-
Sewer Lien Fee to reimburse for costs to research, prepare and file lien and satisfaction of lien documents.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council adopted Resolution No. 2010
amending Public Works Administrative Fees to provide for reimbursement of costs incurred to process
permits, land use actions, and duplication of public works publications.
Mayor Weatherill asked that Item "f' of New Business be carried to the March 24, 2003 agenda to allow for
further language clarification.
On motion by Councilman Clauson, seconded by Council members Wyatt and Cramer, Council excused
Councilman Geiger from this council meeting.
On motion by Councilman Clauson, seconded by Councilwoman Powers, Council approved the consent
agenda items as follows:
a. Minutes of the following meetings:
(1) February 18, 2003 Special Joint Study Session City Council-County Commissioners
(2) February 24 2003 Regular City Council Meeting.
b. Approval of Claim Warrants #38718-38802 in amount of $226,117.23 and February 2003 Payroll
Warrants #137152-137203 and direct deposits in amount of $286,701.92.
The Mayor and Council set the week of June 2, 2003 as Spring Clean-up Week for residents within Port
Orchard city limits.
On motion by Councilman Clauson, seconded by Councilman Rider, Council authorized the Mayor to send
a letter to KRCC indicating the city's continual support of the Passenger Only Ferry Service to Kitsap County
and urging this service be given a higher funding priority over individual city projects.
Mayor Weatherill advised Council of his monthly meeting with Commissioner Jan Angel and the Council Ad
Hoc Committee. Items of discussion were as follows:
• Status on the County Courthouse Campus Plan
• The Gorst sewer main and the need for the county and city to work together to establish sewer
service for this area.
• Broadband project and final documents
• Countywide Planning efforts and population allocations.

On motion by Councilwoman Powers, seconded by Councilman Clauson, Council authorized the city to
contract with Tom Herstad Building Design as the architect to prepare the architectural and structural
drawings for the indoor shooting range at a cost not to exceed $10,000.
Councilwoman Powers, Chair Public Property Committee, reported on the Port Orchard Rotary's
Community Improvement Projects Application. The committee has informally recommended submitting an
application for landscaping the Bethel Avenue Roundabout. The Council concurred with the recommended
application.
