Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 P.M.
at City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers,
Rider, and Cramer. Staff present: Police Chief Townsend, City Planner Wenman, City Engineer Curies, City
Attorney Amann, Deputy Clerk Merlino, and City Clerk Parks.
Councilman Rider led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
Norm Olson representing Soroptimist International of Port Orchard and Givens Senior Center addressed
Council concerning the Holly Daze Bazaar 2002 and the recent enactment of the $30.00 Port Orchard
Business License. Mr. Olson advised many of the bazaar vendors have declined participation due to the
Business License fee and asked for exception or relief for small arts and craft fundraisers. Mayor Weatherill
placed this matter into the Finance Committee for review and asked for a recommendation at the next city
Council meeting.
Mayor Weatherill opened the 7:35 PM Public Hearing regarding a Petition to Vacate the easterly half of
Farragut Avenue right-of-way, adjacent to tax parcel 4027-026-007-0009, platted as Prospect Court and
submitted by John and Clara Hauschild. LEGAL DESCRIPTION: Exhibit "fl:'
Tracy DiGiovanni, attorney representing Mr. and Mrs. Hauschild, applicant, outlined the proposed Street
Vacation and property boundaries.
Mayor Weatherill called for any further audience comments regarding the proposed Petition to Vacate a
portion of Farragut Avenue right of way. As no further comments were received, Mayor Weatherill closed
the public input portion of the Public Hearing and referred this matter to the Council for their consideration.
On motion by Councilwoman Powers, seconded by Councilman Geiger, Council approved the Petition to
Vacate the easterly half of Farragut Avenue right-of-way, adjacent to tax parcel 4027-026-007-0009, platted
as Prospect Court, as submitted by John and Clara Hauschild with the condition the compensation of
$350.00 received from the Street Vacation be redistributed from the Street Fund to the Designated
Unreserved Fund Balance for Parks.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized staff to prepare
an amendment to Resolution No. 1670 regarding Street/Alley Vacation Policy revising the rate of
compensation to be 100% of the appraised value as per RCW 35.79.030.
Mayor Weatherill referred to Old Business item No. 4g.-A request for an adjustment of Carollo Engineer's
wage schedule. Carollo Engineers are currently designing the Port Orchard Boulevard Sewer Main.
On motion by Councilman Clauson, seconded by Councilwoman Powers, Council authorized the City
Engineer to accept the 2002 Wage Fee Schedule, as presented by Carollo Engineers, who are currently
designing the Port Orchard Boulevard Sewer Main project, with the condition the increased fee schedule will
not exceed the value of the contract.
On motion by Councilman Clauson, seconded by Councilwoman Powers, Council approved the consent
agenda items as follows:

b. Approval of Claim Warrants Numbers 37697-37791 in the amount of $215,741.54 and August
2002 Payroll Warrants Numbers 136631-136749 and direct deposits in the amount of
$420,021.03.
Councilman Cramer, Chair of Public Safety Committee, reported on a proposed ordinance relating to the
impoundment of unauthorized vessels (boats) that the committee and Police Chief have been working on
with the City Attorney. Councilman Cramer requested staff prepare the ordinance in final draft form and
place on the September 23 City Council Agenda for consideration by full Council.
Councilman Rider, Chair Growth Management Committee, referred to continued discussions regarding the
Memorandum of Agreement between Kitsap County and the City establishing the phased Planning Process
for the South Kitsap Urban Joint Planning Area, which was signed by both jurisdictions on October 15, 2001.
After much discussion, Councilman Morrison, seconded by Councilman Wyatt, authorized the Mayor to send
a letter to the Kitsap County Commissioners requesting the County honor the Memorandum of Agreement
between the two jurisdictions, as the City has entered into the agreement in good faith by signing the MOA
and to question the County Commissioners' commitment to allocating time, staff, and budget resources
towards the South Kitsap Urban Joint Planning Areas.
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council denied request by N.L. Olson
and Associates to put a concrete ecology block retaining wall in the Farragut Avenue right-of-way as part of a
parking lot project. The request was denied since it would be a permanent encroachment into the right-of-
way.
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council approved request by
Soroptimist International of Port orchard to place signs in the city right of way advertising the Holly Daze
Bazaar with three conditions:
• The sign cannot be in the center of the roundabout
• The sign cannot block the sidewalks at Sidney Avenue and Bay Street
• The signs need to be removed in the evenings.
On motion by Councilman Morrison, seconded by Councilwoman Powers, Council excused Councilman
Clauson from the next Council meeting, September 23, 2002.
On motion by Councilman Clauson, seconded by Councilman Geiger, Council authorized the Mayor to
sign Change Order #1 with Holt Drilling for Well No. 9 in the increased amount of $10,235.30. The
change order provides for the additional cost of going 138 feet deeper than project specifications and
acknowledges an increased cost of steel pipe while the project was delayed.
On motion by Councilman Clauson, seconded by Councilman Geiger, Council authorized an increase in
the contract amount with Hugh Goldsmith and Associates from $10,000 to $13,100 for the preparation of
a water system model.
