01/14/2002 - Regular - MinutesPort Orchard, Washington January 14, 2002 Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 P.M. at City Hall, 216 Prospect Street. Council members present: Clauson, Morrison, Wyatt, Powers, Rider, and Cramer. Councilman Geiger excused. Staff present: Police Chief Townsend, City Engineer Curies, City Attorney Combs, Deputy Clerk Merlino, and City Clerk Parks. Councilwoman Powers led the audience and Council in the Pledge of Allegiance. On motion by Councilman Morrison, seconded by Councilman Clauson, Council excused Councilman Geiger from this Council meeting. Mayor Weatherill introduced and welcomed the newly elected, first term Council members, Ron Rider and Todd Cramer. Mayor Weatherill asked for audience comments for items not listed on this agenda. John Hokanson, representing Bethany Lutheran Church, 151 Tremont St. W., requested the City Council authorize waiving $50. of a $100 False Alarm Response Fee charged on 10/5/01. Mr. Hokanson contended the ordinance in effect at that time was vaguely written and he does not believe that the amount charged is in conformance with the ordinance. He also reported that Mayor Weatherill had acknowledged in writing that the ordinance was unclear. Plus, the City Council recently revised the False Alarm Ordinance clearly defining the fees for each false alarm response fee. City Attorney Combs advised the proper procedure for this type of request would be for Mr. Hokanson to pay the response fee and then file a Claim for Damages seeking reimbursement. This claim would then be revfewed and the City Council would make a final determination on this matter. Fred Chang, 319 Seattle Avenue, expressed a concern with the City's Public Notice procedures and wondered if all the appropriate persons were given proper notification. Mr. Chang presented the following suggestions: • The City place a large display ad in the Port Orchard Independent listing current events within the City and a schedule of the Council and Planning Commission meetings, or • Set up a voice mail system where the public could call in and listen to a message regarding important meetings, agendas, notices, etc. Mayor Weatherill and Council thanked Mr. Chang for his suggestions. Mayor Weatherill referred to his letter dated December 28, 2001, which was hand delivered to each Council member, (Attachment "A") notifying them of his action to invoke veto powers over Ordinance No. 1843 regarding the authority of the City Council to establish Council Committees, make appointments to and remove Council members from such Council Committees. City Attorney Combs advised Council of the proper procedure to follow for the veto and reconsideration of motion to approve Ordinance No. 1843 relating to the Council Committee selection process. Councilman Clauson moved to override Mayor Weatherill's veto of Ordinance No. 1843 relating to Council Committee procedure and opened the floor for further discussion on the reconsideration of Ordinance No. 1843, seconded by Councilman Morrison. After considerable discussion, Councilman Clauson withdrew motion and upheld Mayor Weatherill's veto of Ordinance No. 1843, seconded by Councilman Morrison. January 14, 2002 Page 2 of3 On motion by Councilman Clauson, seconded by Councilman Wyatt, Council adopted Resolution No. 1959 creating a Community Service Supervisor position within the Engineering Department and providing for the salary thereof. On motion by Councilman Morrison, seconded by Councilman Clauson, Council adopted Resolution No. 1960 fixing the date of a Public Hearing on a petition to Vacate a portion of Farragut Avenue right of way, adjacent to the westerly portion of Lot 4027-025-008-0208, (platted as Prospect Court), as submitted by Patricia Barnes. (Public Hearing scheduled for February 11, 2002 at 7:30 PM) On motion by Councilwoman Powers, seconded by Councilman Wyatt, Council approved the consent agenda items as follows: a. Minutes of the City Council meeting held December 20, 2001. (This meeting was a continuation from the regular December 10, 2001 City Council meeting.) NOTE: The December 24, 2001 City Council meeting was canceled due. to a lack of quorum. b. Approval of Claim Warrants Numbers 36265-36391 in the amount of $348,476.27 and December 2001 Payroll Warrants Numbers 135938-136019 and direct deposits in the amount of $280,107.37. Councilman Clauson reported on the City's Annual Audit and advised the city once again received a "No Findings" audit. Council Clauson also advised this is the City's 11 1h "No Finding" audit. Councilman Clauson congratulated City Treasurer Tompkins and her staff for a job well done. Councilman Clauson read a letter from Dorothy Wilson expressing her appreciation for the holiday decorations and complimenting the Public Works employees for making the decorations extra special this year. On motion by Councilman Morrison, seconded by Councilman Rider, Council adopted Resolution No. 1961 authorizing the Mayor to sign the necessary documents to submit the Local Agency Agreement and Prospectus to the Washington State Department of Transportation, for the Bay Street Pedestrian Path Project. Councilman Morrison urged the citizens of Port Orchard to become familiar with the proposed Charter Government and understand what this form of government could mean to the citizens of Port Orchard. On motion by Councilman Morrison, seconded by Councilman Rider, Council adopted Resolution No. 1964 supporting the Home Rule Charter form of Government. Motion passed with 5 ayes and 1 nay. Councilwoman Powers voting nay. Councilman Cramer, Public Safety Chair, presented a request from Police Chief Townsend asking for authorization to purchase breakfast and lunch for the lateral police officer and entry-level police officers oral board panel. As required in the City's Travel Policy (Section 2.1) Police Chief Townsend also requested approval of a special meeting to be held at Mary Mac's Restaurant. The purpose of this meeting is for a special Police Department training and strategic planning session. Cost will be approximately $100 for a conference room and lunch for the Police Chief and three Police Sergeants. On motion by Councilman Cramer, seconded by Wyatt, Council approved the following expenditures out of the 2002 Police Department budget: • Authorization to purchase breakfast and lunch for the lateral police officer and entry-level police officers testing panel • Authorization for a special meeting and an expenditure of approximately $100 for a conference room and lunch for the three Police Sergeants and Police Chief training session and strategic planning session. January 14, 2002 Page 3 of3 Councilman Clauson asked for Council's concurrence on acknowledging the arrival of the USS Carl Vinson and the USS Sacramento and congratulating the men and women aboard these ships who have had the duty of supporting our country. On motion by Councilman Clauson, seconded by Councilman Morrison, Council adopted Resolution No. 1962 acknowledging the men and women aboard the USS Carl Vinson for the dedicated service to their country, Council further authorized Mayor Protem Morrison to represent the City of Port Orchard and present this Resolution upon arrival of the USS Carl Vinson. On motion by Councilman Clauson, seconded by Councilman Wyatt, Council adopted Resolution No. 1963 acknowledging the men and women aboard the USS Sacramento for the dedicated service to their country, Council further authorized Mayor Protem Morrison to represent the City of Port Orchard and present this Resolution upon arrival of the USS Sacramento. On motion by Councilman Morrison, seconded by Councilman Wyatt, Council directed the City Engineer to not submit a letter of commitment to National Marine Fisheries Services (NMFS) regarding the implementation of the regional road maintenance provisions of the Endangered Species Act (ESA) program, until more information is received and not until the road maintenance responsibilities are defined. On motion by Councilman Morrison, seconded by Councilman Clauson, Council authorized the Mayor to sign Supplement #5 with Howard Small regarding the Forensic Gas Testing at 514 Bay Street in the amount of $5,442. On motion by Councilwoman Powers, seconded by Councilman Clauson, Council authorized an extension of the Real Estate Purchasing Agreement with the Kitsap County Housing Authority to June 30, 2002 for property located at 900 Mitchell Avenue. ! Ordinance No. 1843 January 14, 2002 Attachment "A" I do not believe this action is proper for the City Council at this time, because it was determined and designed by individual preference or convenience rather than by necessity to improve what has already been a very positive working relationship. I believe at this time that it would be advantageous for City Council members and myself to study this subject in greater detail.
