Council of the City of Port Orchard, Washington, called to regular session by Mayor Weatherill at 7:30 P.M.
at City Hall, 216 Prospect Street. Council members present: Clauson, Morrison, Wyatt, Geiger, Rider, and
Cramer. Councilwoman Powers excused. Staff present: Police Chief Townsend, City Planner Wenman,
Code Enforcement Officer Woodside, City Attorney Combs, Deputy Clerk Merlino, and City Clerk Parks.
Councilman Clauson led the audience and Council in the Pledge of Allegiance.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council excused Councilwoman
Powers from this Council meeting.
Mayor Weatherill asked for audience comments for items not listed on this agenda. No response was
received at this time.
On motion by Councilman Geiger, seconded by Councilman Morrison, Council approved consent agenda
items as follows:
a. Minutes from the January 14, 2002 regular City Council meetings
b. Claim warrants numbered 36392-364 73 in the amount of $270,633.18.
c. Authorization for the Mayor to sign the Coastal Zone Management Shoreline Inventory Contract
with Applied Environmental Services at a cost of $23,825, subject to review by the City Attorney.
d. Authorization for the Mayor to sign the geotechnical contract for the Sewer Treatment Facility at a
cost of $74,861.
e. Authorization for the Mayor to sign the contract amendment for additional effort to respond to
ecology comments on the engineering report for the Sewer Treatment Facility at a cost of
$30,095.
f. Authorization for the Mayor to sign the design contract for the Port Orchard Boulevard sewer
main at a cost of $49,000, subject to review by the City Attorney.
Mayor Weatherill opened the 7:35 PM Public Hearing regarding an appeal to a Code Enforcement Action
submitted by Joe Mentor for a sign located at 839 Bay Street.
City Planner Wenman gave the staff report and background on the code violations indicating the sign was
installed on the roof of the building, which is in violation to POMC Chapter 15.16 (Roof signs are
prohibited in all zoning districts) and also the sign was installed without a sign permit.
Joe Mentor, 9481 Silverdale Way, #201, Silverdale, WA, presented his appeal to the Council stating he
did apply for a sign permit, however the sign was first installed on a metal pole and eventually moved to
the top of the wall of the building located at 839 Bay Street. Mr. Mentor further stated he hired an
engineer to comply with the sign ordinance so the sign would be installed properly and engineered to be a
wall sign not a roof sign. Mr. Mentor asked for Council's concurrence on the sign location and asked for
the Council to remand this matter back to the Building Department with instructions to approve the
installation of the sign.

Mayor Weatherill asked for further audience comments either for or against the appeal by Joe Mentor
regarding the Code Enforcement Action on his sign located at 839 Bay Street. As no further comments
were received, Mayor Weatherill closed the public input portion of the Public Hearing and referred this
matter to the Council for their consideration.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council upheld the decision of
the Planning and Building Department regarding the Notice and Order for the Abatement of an Unsafe or
Unlawful Condition concerning the installation of the roof sign without proper sign permits located at 839
Bay Street. Motion passed with 5 ayes and 1 nay. Councilman Geiger voting nay.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council excused Councilman
Morrison from the February 11, 2002, February 25, 2002 and March 11, 2002 City Council meetings.
At 8:24 PM Mayor Weatherill adjourned the Council meeting.
