02/26/2001 - Regular - MinutesPort Orchard, Washington February 26, 2001 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. at City Hall Council Chambers, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison, Geiger, Powers, VanZee, and Stansbery. Staff present: Police Sergeant Duncan, City Engineer Curies, City Attorney Combs, Deputy Clerk Merlino, and City Clerk Parks. Councilwoman Powers led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. Sharon Miller, expressed a concern with the lack of street lighting on the Blackjack Creek By Pass Bridge. Ms. Miller suggested placing streetlights on the bridge. Ms. Miller recommended the expense for the installation of the streetlights be shared by the city, county, and state. Mayor Weatherill asked for further audience comments for items not listed on this agenda. No further comments were received at this time. On motion by Councilman Clauson, seconded by Councilman Morrison, Council approved Ordinance No. 1816 relating to and providing for the annexation of territory into the City of Port Orchard for municipal purposes. (McCormick Well Field property) On motion by Councilwoman Powers, seconded by Councilman Clauson, Council adopted Resolution No. 1925 giving notice of intent to annex territory into the City of Port Orchard as petitioned by William Wiley, et al, and authorized by Council action subsequent to public hearing held January 8, 2001. Motion passed with 6 ayes. Councilman Wyatt stepped down from council table and refrained from any discussion or voting, due to a conflict of interest. On motion by Councilman Geiger, seconded by Councilman Morrison, Council directed city staff to prepare a letter to the state legislators regarding the imposition of tolls to pay for the Tacoma Narrows Bridge Project. The letter will urge reconsideration of proposed tolls and suggestresearching alternative methods of funding such as those used to fund the 1-90 bridge project and Hood Canal Bridge reconstruction projects. Motion passed with 6 ayes. Councilman VanZee voting no. This letter will be circulated to other governmental entities within Kitsap County through KRCC with a request for their unified support for consideration of alternative funding resources. Council discussed Old Business item a -regarding removal of significant large trees along Sidney Avenue by Kitsap County during the jail expansion project. The Growth Management Committee has reviewed this item and discussed the city imposing a fine per tree and requiring Kitsap County to replace each significant tree. Fred Chang, 391 Sidney Avenue, urged Council to have the trees replaced on Sidney Avenue. Mayor Weatherill introduced letter submitted by Patrick and Lori . Moriariy, 1720 Guy Wetzel Street appealing Engineering Department's directive to remove a post and chain barrier which the Moriarity's have installed in the Tracy Avenue/ Guy Wetzel Street right of way. The Moriarity's state they had installed the barrier to keep high school students from parking at this location, blocking the Moriarity's vehicle ingress/egress. Councilman Morrison, Street Committee Chair, presented motion to uphold Engineer Department directive and deny Patrick and Lori Moriarity's request to maintain a post and chain barrier in Tracy Avenue right of way. Motion included alternative solution of posting the Tracey Avenue right of way as 2- hour parking to mitigate the parking problems and the Moriarity's vehicle access situation. Motion seconded by Councilman Wyatt and carried with unanimous vote. February 26, 2001 Page 2 of2 Keith Folkerts, Kitsap County Natural Resources Coordinator, presented an update on the Endangered Species Act 40 Rule Process and a brief outline of the goals for implementation. Resolution No. 1924 authorizing participation in the USGS, University of Washington study of Earthquakes and Tsunami effects in Sinclair Inlet. On motion by Councilwoman Powers, seconded by Councilman Van Zee, Council authorized an expenditure of $350.00 to support Kitsap Regional Coordinating Council's effort to contract with two lobbyists for the remainder of the 2001 legislative session.
