11/26/2001 - Regular - Minutes, Regular SessionPort Orchard, Washington November 26, 2001 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30 P.M. in City Hall Council Chambers, 216 Prospect Street. Council members present: Clauson, Morrison, Wyatt, Geiger, Van Zee, and Stansbery. Councilwoman Powers excused. Staff present: Police Chief Townsend, Deputy Clerk Merlino, City Treasurer Tompkins, Municipal Court Judge Decker, City Engineer Curies, and City Attorney Combs. Councilman Stansbery led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this meeting's agenda. No response was received at this time. Mary McClure representing Kitsap Regional Coordinating Council, presented KRCC's 2002 Legislative Issues. Ms. McClure highlighted some of the proposed issues for discussion: • Water: Growing Communities; Infrastructure and Storage Facilities • Transportation: Stable Ferry Funding; Tacoma Narrows Bridge • Unfunded Mandates: Endangered Species Act Telecommunication Services • Growth Management Act Ms. McClure asked for Council's concurrence and adoption by resolution. Councilman Van Zee moved to approve Resolution No. 1955 endorsing the Kitsap 2002 Countywide Legislative Agenda developed by the Kitsap Regional Coordinating Council with the following correction to the last paragraph as follows: 'The Mayor of Port Orchard is 11erelly may be directed by the Port Orchard City Council to sign multi-jurisdictional statements to this effect as part of materials prepared by the Kitsap Regional Coordinating Council to petition the Washington State Legislature for the recommended actions.", seconded by Councilman Geiger and carried. Ms. McClure introduced the proposed lnterlocal Agreement between Kitsap County and the Cities of Bainbridge Island, Bremerton, Port Orchard and Poulsbo concerning revenue sharing upon annexation and in conjunction with major land use decisions within a city's Urban Growth Area. The Council expressed the following concerns regarding the proposed lnterlocal Agreement, • Section 1.4 -If the County and City(s) cannot reach an agreement there is no motivation factor for the County to reach an agreement. The County will receive funding either way, • If this agreement does not have all the details, what are the reasons for approving this document at this time? • Why should the cities reimburse the County for road construction? Ms. McClure stated many of the issues will be addressed during the next few months. Ms. McClure also clarified the City of Bainbridge Island is the only city that has currently signed the agreement. City Attorney Combs referred to Section 1.4 of the lnterlocal Agreement and advised, if an agreement is reached it will become an obligation of the city, however if an agreement is not reached the city has no further obligation. City Attorney Combs also acknowledged within the lnterlocal Agreement there is an out- clause where the city can terminate their participation in the agreement. In conclusion City Attorney Combs advised the city not to change the agreement effective date with the revised wording shown. The proposed change would have replaced the September 4, 2001 effective date. November 26, 2001 Page 2 of 3 After much discussion, Councilman Clauson, seconded by Councilman Stansbery moved to table, for further review, the proposed lnterlocal Agreement between Kitsap County and the Cities of Bainbridge Island, Bremerton, Port Orchard and Poulsbo concerning revenue sharing upon annexation and in conjunction with major land use decisions within a city's Urban Growth Area. On motion by Councilman Stansbery, seconded by Councilman Van Zee, Council adopted Resolution No. 1956 expressing concern with the lack of adequate ferry service by Horluck Transportation. At 9:15PM Mayor Weatherill called for a 10 minute recess with meeting reconvening at 9:25PM. On motion by Councilman Van Zee, seconded by Councilman Morrison, Council approved Ordinance No. 1831 amending Port Orchard Municipal Code Sections 2.08.020 and 2.08.030 regarding the duties of the office of the City Attorney and providing the manner of appointment and compensation for such office. On motion by Councilman Clauson, seconded by Councilman Morrison, Council approved consent agenda items as follows: Note: Councilman Wyatt refrained from voting due to a conflict of interest regarding item "e". a. Minutes of the November 13, 2001 regular City Council meeting b. Claim warrants numbered 36077-36135 in the amount of $177,202.54. c. Approval of Firework Stand Permit for New Year's Eve submitted by Rochelle's Fine Fabrics located at South Kitsap Mall parking lot. d. Ordinance No. 1837 regarding File No. CA-08-01 Comprehensive Plan Map Amendment, Richard J. Fitzpatrick, proponent, re-designating 4.78 acres of land currently designated as Commercial & High Density Residential to High Density Residential. Located at the northwest corner of Olney Avenue and Mile Hill Drive. e. Ordinance No. 1838 regarding File No. CA-09-01 Comprehensive Plan Map Amendment, City of Port Orchard, proponent, re-designating land recently annexed into Port Orchard from Urban Low (Kitsap County designation) to Medium Density Residential. The subject area is commonly known as the "Wiley Annexation" which is comprised of 11.80 acres. f. Request by the City Treasurer to declare as surplus, to the needs of the city, miscellaneous computer equipment and authorization to dispose of these items in the best interest of the city. Councilman Geiger reminded Council of the 2002 Budget Public Hearing scheduled for 7:30 PM on Monday, December 3, 2001. Mayor Weatherill and City Council set Wednesday, December 12, 2001 at 7:30PM as the date and time for a Study Session regarding McCormick Urban Growth Area Subarea Plan. On motion by Councilman Clauson, seconded by Councilman Wyatt, Council authorized the City Engineer to write a letter of support as requested by Richard A. Brown and William Palmer for their Comprehensive Plan Amendment, which were denied by Kitsap County. The areas in question are as follows: • The commercial area within the Sidney/Sedgwick Road area, • 1 05 acres in McCormick East Urban Growth Area • The commercial development located within the McCormick East UGA, between Glenwood Road, Sedgwick Road and Berry Lake Road.
