Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at
7:30P.M. at City Hall, 216 Prospect Street. Council members present: Clauson, Morrison, Geiger, Powers,
Van Zee, and Stansbery. Councilman Wyatt excused page 1. Staff present: City Clerk Parks, Deputy
Clerk Merlino, Police Sergeant McCarthy, City Planner Wenman, City Engineer Curies, and City Attorney
Combs.
Councilman Clauson led the audience and Council in the Pledge of Allegiance.
On motion by Councilman Morrison, seconded by Councilman Stansbery, Council excused Councilman
Wyatt from this Council meeting.
Mayor Weatherill asked for audience comments for items not listed on this agenda. No comments were
received at this time. ·
Mayor Weatherill introduced letter from Ron Rice regarding enforcement of the sign ordinance. Mayor
Weatherill asked City Attorney Combs to brief Council on the status of the code violations relative to the
court process.
City Attorney Combs advised Council, Mr. Rice was given a Notice of Code Violation with an appeal period
of five days. Since Mr. Rice did not respond within the appeal period or correct the violations, citation(s)
have been issued and the citiations are now in the court system. City Attorney Combs cautioned the
Council to not address this matter. However City Attorney Combs stated Mr. Rice has the right to voice his
concerns regarding the sign ordinance.
Mr. Rice presented a notebook with pictures and correspondence depicting his concerns relative to the sign
ordinance.
Mr. Rice presented the following questions to the Council and asked Council to rule on these issues
concerning his signs.
• Did banner type signs require a permit, prior to passage of the new sign ordinance?
• If a permit is required for a banner sign, do all banner signs have permits?
• Under new ordinance, how far does a sign have to be moved before a permit is required?
• Is there a limit on how many directional signs can be posted?
• Does total square footage of sign include those signs on buildings? If not what is being
approved when an attached banner type sign requires a permit?
• Does the city enforce the size and height of addresses on commercial and residential
structures?
• The ordinance covers "non-confirming signs", prior to the passage of the new sign ordinance,
however the ordinance does not address "conforming signs" installed prior to passage of the
new sign ordinance. What is the City's intent regarding "conforming signs"?, and will new
permits be required after passage of the new ordinance?
• Were permits required for all signs under the old municipal code?
City Attorney Combs advised Council the appeal period for Mr. Rice has passed and the Council cannot
take any action or address these questions.
On motion by Councilman Clauson, seconded by Councilman Stansbery, Council approved Ordinance No.
1815 relating to and providing for the annexation of territory into the City of Port Orchard for municipal
purposes (Wastewater Treatment Facility).
Councilman Stansbery moved to remove Consent Agenda Item - a (2) Minutes of the January 22, 2001
regular City Council meeting, for separate consideration, seconded by Councilman Clauson and carried.

Councilman Stansbery stated he and Councilman Morrison had spoke against approval of the
recommendation to authorize issuance of a Temporary Use Permit to Kitsap County which would allow
temporary parking at 706 Taylor Street and their opposition was not reflected in the minutes. Also the draft
minutes on page four incorrectly show Councilman Stansbery voted in the affirmative for the motion to
approve the Temporary Use Permit.
On motion by Councilman Stansbery, seconded by Councilman Clauson, Council approved the minutes of
January 22, 2001 City Council meeting with corrections to reflect Councilman Stansbery and Councilman
Morrison spoke against the motion to authorize a Temporary Use Permit allowing Kitsap County to utilize
their property at 706 Taylor Street for parking during the jail construction project and Councilmembers
Stansbery, Morrison, and Geiger voted no on this motion.
On motion by Councilman Stansbery, seconded by Councilwoman Powers, Council approved the consent
agenda items as follows:
a. (1) Minutes of the continued January 8, 2001 regular City Council meeting (January 17,
2001) as revised.
b. Approval of Claim Warrants Numbers 34368-34481 in the amount of $222,469.33 and
January 2001 Payroll Warrants Numbers 134961-135035 and direct deposits in the
amount of $236,248.21.
c. Request by Police Chief Townsend to surplus miscellaneous firearms and bicycles and
dispose of these items in the best interest of the city. Attachment "A"
d. Request by City Engineer to surplus the following items and dispose of these items in the
best interest of the city: Tag No. 300073 -Acetylene gas welder-S#272706EQ#65 and
Tag No. 300107-book binding machine.
e. Request by City Treasurer to surplus miscellaneous computer equipment and dispose of
these items in the best interest of the city: Tag No. 1100024-95 Micron PC (P66) not
Y2K compliant; and Tag No. 110031-96 -SCS PC (P133) unsuitable for current
environment.
On motion by Councilman Clauson, seconded by Councilman Van Zee, Council excused Councilwoman
Powers from the April9, 2001 City Council Meeting.
On motion by Councilman Clauson, seconded by Councilman Van Zee, Council excused Councilman
Morrison from the March 12, 2001 City Council Meeting.
Mayor Weatherill placed into the Growth Management Committee memorandum from City Planner
Wenman, dated February 12, 2001 regarding Kitsap County Jail Expansion -Significant Trees. The
project superintendent has requested permission to remove the majority of the large trees located along
Sidney Avenue.
Mayor Weatherill placed into Street Committee letter from Patrick and Lori Moriarity, 1720 Guy Wetzel Road
requesting permission to allow a chain link fence on a portion of Tracy Avenue right of way.
Mayor Weatherill received concurrence from the City Council to appoint Fire Prevention Technician Greg
Rogers as representative for the City of Port Orchard on the Kitsap County Fire Safety Advisory Committee.
This position is a three-year term, which will help administer the county wide (R-1) Fire and Life Safety
legislation.
Kitsap Transit allows free bus service for one public event per year. Mayor Weatherill designated the Cruz
and Festival By The Bay as the public events, which would have, free bus service during their August 12,
2001 scheduled event.

The City Council set February 21, 2001 at 7:30 PM as a Town Hall Meeting with the Kitsap County
Commissioners to provide an opportunity for public questions and comments on Kitsap County's proposal to
move some county offices to Bremerton.
On motion by Councilman Clauson, seconded by Councilman Stansbery, Council approved the Waste
Management Curbside Yard Waste Program for the City of Port Orchard.
On motion by Councilman Clauson, seconded by Councilman Geiger, Council authorized the City Engineer
to proceed with advertising and preparing the plans and specifications for the Wastewater Treatment Facility
centrifuge installation.
City Engineer Curies reported the University of Washington has selected Sinclair Inlet for an
Earthquake/Tsunami Hazard study. In support of this study the University of Washington is asking for a
Resolution granting approval of this study.
By general consensus, the City Council authorized the City Engineer to prepare a Resolution granting
support to the University of Washington for their study regarding Earthquake/Tsunami Hazards.
At 9:10 PM Mayor Weatherill adjourned Council into Executive Session for 10 minutes to discuss labor
negotiations. Executive Session was extended an additional20 minutes. ·
At 9:40 PM Mayor Weatherill reconvened meeting into regular ~essie~ adjourned meeting.
