Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at
7:30 P.M. at City Hall Council Chambers, 216 Prospect Street. Council members present: Clauson,
Wyatt, Geiger, Powers, Van Zee and Stansbery. Councilman Morrison excused. Staff present: City Clerk
Parks, Police Chief Townsend, Deputy Clerk Merlino, City Engineer Curies, and City Attorney Loren
Combs.
Councilman Clauson led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
Andi MacDonald, representing Washington State Cemetery Association, spoke regarding the court action
filed by Spencer Masters, owner of Sidney Cemetery seeking to remove the cemetery dedication from his
property. Ms. MacDonald requested the city become actively involved in saving the Sidney Cemetery by
filing a motion of intervention with the court.
Spencer Master, owner of Sidney Cemetery, assured Mayor and Councii he believes ail remains have
been removed from the gravesite(s) and encouraged the Council members to visit the cemetery to see
first hand. He stated that having an archaeological study done would not be conclusive due to the
uneven terrain and vegetation.
While Mayor Weatherill and Council members concurred it is their desire to protect gravesites, if they
exist, they questioned City Attorney Combs what the city's responsibility or liability is on this matter. City
Attorney Combs stated he has, at Mayor Weatherill's direction, filed an objection with the Superior Court,
however the city has not officially intervened. The city has no liability on this matter because the cemetery
Wj3S not plated under city codes or laws. A Superior Court Judge will make the final determination on the
issue.
On motion by Councilwoman Powers, seconded by Councilman Van Zee, Council agreed to not file a
motion to intervene regarding the Sidney Cemetery matter.
Mayor Weatherill advised New Business Item "A" presentation of the Good Neighbor Award -
Commercial Category will be presented at the September 11, 2000 Council meeting .
Grant Griffin, representing Kitsap Visitor and Convention Bureau, presented three radio campaigns
advertising the Kitsap Peninsula and advised how the radio announcements have already been effective
in attracting tourist to the Kitsap County region.
Mayor Weatherill opened the 7:35 PM Public Hearing regarding a petition to Vacate a portion of Forest
Park Street (Berry Street) right of way, as submitted by Ron and Shawn Hutchinson, et al.
City Engineer Curies updated Council on the vicinity and proximity of the proposed street vacation and
gave report on the Street Committee's recommendation for approval of this petition.
Ron and Shawn Hutchinson, petitioners, requested approval of this petition and discussed their proposed use
of the subject property.
Mayor Weatherill called for further audience comments regarding the Petition to Vacate a portion of Forest
Park Street right of way. As no further comments were received, Mayor Weatherill closed the Public Hearing
portion of the meeting and referred this matter to Council for their consideration.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council approved the Petition to Vacate
a portion of Forest Park Street right of way, with the city receiving a certified check in the amount of
$4,996.50, as submitted by Ron and Shawn Hutchinson, et al. The description of the utility easement to be
included in the approving Street Vacation Ordinance.
At 8:30PM MayorWeatherill called for a 10 minute recess with meeting reconvening at 9:40PM.

Mayor Weatherill opened the 7:40 PM Public Hearing regarding adoption of the Comprehensive Sewer Plan,
2000.
City Engineer Curies discussed in detail the many areas that are incorporated within the Comprehensive
Sewer Plan, such as, however not limited to: replacement of sewer lines along Port Orchard Boulevard;
population trends and their expectation of sewer growth within our area; and the continuation of monitoring
the mains south of Tremont Street.
Mayor Weatherill called for any audience comments regarding the adoption of the Comprehensive Sewer
Plan, 2000. As no further comments were received, Mayor Weatherill closed the Public Hearing input portion
of the Public Hearing and referred this matter to Council for their consideration.
On motion by Councilman Clauson, seconded by Councilman Stansbery, Council adopted the
Comprehensive Sewer Plan, 2000.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council adopted Resolution No. 1905
eliminating the employment positions of Assistant Clerk 1 -Receptionist and Assistant Clerk 1 -Probation
Monitoring and creating an employment position of Court Clerk.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council approved the consent agenda
as follows:
a. Minutes of the August 14, 2000 City Council meeting
b. Claim warrant numbers 33422-33486 in the amount of $43,561.27.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council authorized Police Chief
Townsend and Mayor Weatherill to sign lnterlocal Agreement between South Kitsap School District and the
Port Orchard Police Department for the School Resource Officer Program.
Councilwoman Powers requested the $4,996.50 received from the Forest Park Street Vacation be placed
into a separate fund for park acquisition. Mayor Weatherill placed this matter into the Finance Committee for
review.
On motion by Councilman Clauson, seconded by Councilman Wyatt, Council excused Councilwoman
Powers from the October 9, 2000 and November 27, 2000 City Council meetings.
On motion by Councilman Clauson, seconded by Councilwoman Powers, Council authorized the Mayor to
sign the consultant agreement with Reid Middleton for the synchronization of the Traffic signals on Tremont
Street.
At 9:50 PM Mayor Weatherill adjourned Council into Executive Session for 10 minutes to discuss labor
negotiations. Executive Session was extended an additional 20 minutes.
