February.26, 1979
Council of the City of Port Orchard, Washington called to regular
session by Mayor Paul D. Powers, Jr. Council members present: Eugene
Caldwell, Wilson, Lee Caldwell, Geiger, Miller, Roos and Clark. Also
present: Attorney Riehl, Engineer Knobbs, Fire Chief Weatherill and
Police Chief Mares.
Mayor Powers led the audience in the Pledge of Allegiance.
On motion by Councilman Lee Caldwell, seconded and carried, Council
approved the minutes of the February 13, 1979 meeting as circulated.
Police Chief Mares introduced members of the newly organized Reserve
Police Unit. This unit is comprised of ten men who have completed their
Police Reserve training. Mayor Powers at this time administered the
oath of office and welcomed the new officers as volunteers for the City
of Port Orchard.
A. T. Lindsay, 528 DeKalb St. approached the Council concerning the
subject of junk cars sitting on City right--of--way. Mayor Powers
informed him that he would look into the situation and have it
corrected.
.Becky Tyrson, representing South Kitsap Western Little League, renewed
the request for use of City property at the old garbage dump site on
the Old Clifton, Road as a practice field. Councilman Roos, Chairman
Parks Committee, stated his Committee has not met on this matter and
he will be in contact with Ms. Tryson as to date for Meeting.
Guy Coons, Annapolis Water District, questioned Council as to matter of"
Annapolis Water District serving ten Port Orchard water customers as
per contract which lapsed several years ago. Mayor referred matter
to Water Committee, who will meet with Annapolis Water Commissioners
to reach an agreement on how this situation will be handled.
Mayor Powers declared Public Hearing open relevant to request submitted
by Frank Karas for zone reclassification from Residential High to
Multi --Family 20 for his property located on the corner of Sroufe and
Portland.
Clerk read Planning Commission recommendations setting forth findings
and conditions, (as per attached).
Councilman Lee Caldwell moved to approve reclassification subject to
conditions set forth by the Port Orchard Planning Commission. Seconded.
Councilman Wilson moved to amend motion to state that parking must be
situated in such a manner that no car must back into the alley or onto
Portland Street. Seconded and carried.
original amended motion to approve zone reclassification as requested
by Frank Karas from Residential High to Multi,. -family 20, for his
property located at the corner of Sroufe and Portland Streets, carried,
subject to conditions as set forth by Planning Commission as amended
by City Council. (ordinance No. 1083) Legal Description: Lots 1, 2, 3,
4, 5, 6, 7, 8 and 9, Block 5, Railroad Addition to Sidney, as per plat
recorded in Volume T of Plats, Page 69, Records of Kitsap County.
Mayor Powers noted that several members of the audience were present
pertaining to the Roland Rezone Hearing held February 12, 1979. Council
members stated that Council has not received minutes nor- transcripts of
hearing and it had been announced at the Hearing that at such time the
Council intended to discuss Roland application for rezone, a public
notice would be issued. As transcripts have not been received and no
public notice issued, Council did not discuss matter at this time.
Mayor Powers announced that if anyone present would like to make a
statement relevant to Roland and Roland rezone application, they could
do so at this time.
Jack Carter stated that on a drawing attached to the final Environmental
Impact Statement showing the Sedgwick Mall area, his property at the end =
of Hovde Road is 'shown as a proposed park. Mayor Powers assured Mr.
Carter that the Port Orchard Comprehensive Plan which contains this
particular drawing is only a proposal of what would be a good use -for
this property if the City owned it.
Councilman Roos, Chairman Park Committee, stated that the City of
Port Orchard has received two requests to use the Part Orchard Sanitary
land fill area on Old Clifton Road. Mr. Roos requested Council to allow
the committee time to study what would be most appropriate utilization
of this land in the best interests of the City, and develop Long range
comprehensive plans.
Becky Tryson, South Kitsap Little League, explained to Council that
their request for use of this land would be of no expense to the City
of Port Orchard, would cause no damage to land and would in no way
interfere with any study the City might do. They requested use of
this land for practice fields only.
Councilman Geiger moved that the Parks Committee be given authority to
approve use of Port Orchard Sanitary land fill area on Old Clifton
Road by the South Kitsap Little League. Seconded and carried with four
ayes and three nos. Councilman Eugene Caldwell, Wilson and Roos voting
no.
On motion. by Councilman Clark, seconded and carried, Council approved
and accepted as completed, the telemetry control system installed by
Dyad Construction as a water system improvement.
On motion by Councilman Eugene Caldwell, seconded and carried, Council
granted permission for Joe Snow, Fire Marshal, to attend an arson school
-to be held in Portland, Oregon April 30, 1979. Expenditure to be $280.00.
On motion by Councilman Eugene Caldwell, seconded and carried, Council
approved Ordinance No. 1088, an Ordinance amending Ordinance #983
relative to increase infees and the adding of new fee schedules for
Building Department fees.
Councilman Lee Caldwell moved to approve Resolution No. 1211, a
resolution amending Resolution No. 1191 relative to a special use permit
issued to Cedar Heights Associates, D. Alson VanderStaay, Agent.
Councilman Lee Caldwell moved that April 2, 1979 be set as a deadline
for accepting fireworks stand applications for the year 1979, with
approval to be given on April 9, 1979. Seconded.
Councilman Wilson moved to amend motion to state number of stands to
be approved subject to review by City Attorney and Fire Chief. Seconded
and carried.
Original amended motion carried.
On motion by Councilman Wilson, seconded and carried, Council approved
proclamation to be issued by the Mayor proclaiming March 11 through 17
as Girl Scout Week in the City of Port Orchard.
