03/27/1978 - Regular - Minutesh Port Orchard, Washington March 27, 1978 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Lee Caldwell, Robert Geiger, Margaret Jane Miller, Dave Libby, Leonard Clark and Mary R. Wilson. Eugene Caldwell excused. Also present: Attorney Riehl, Engineer Knobbs and Chief Weatherill. Chief Mares excused. Mayor Powers led Council and the audience in the'Pledge of Allegiance. On motion by Councilman Lee Caldwell, seconded and carried, Council approved the minutes of the March 13, 1978 meeting as circulated with the following corrections: Page 1, paragraph 14, should state: Council felt if any change in public access to the area be allowed, area should be required to be open to public during daytime hours. Senator Red Beck issued an open invitation to Council and public to attend a special meeting being held by several�.,of the heads of. -.the Highway Depart- ment and State Representative to discuss what types..offunding are possibly available to the.City of Port Orchard to sole_-the.traffic congestion problems .in -tilis area. Senator. Beck stated the meeting will be held at Frank Givens Elementary School, Tuesday, April 11,`1978 at 7:..00 P,.M:. Roy Johnson inquired as to status of Granat Street matter. Mayor informed Mr. Johnson that the City Attorney is studying legal documents that have been obtained to determine if Granat Street is a City street or private property. Mr. Johnson requested that he be informed as.to result of this investigation. Mr. Dan Dunphy, 17811 110th Ave. S E, Renton, Washington 98055 also requested results of this investigation. Mayor instructed Clerk to supply Mr. Johnson and Mr. Dunphy of the results of this study when determination is made. South Kitsap Junior Women's League requested that April 15, 1978 be declared "Port Orchard Clean Up Day". On motion by Councilman Lee Caldwell, seconded and carried, Council approved the City of Port Orchard joining with the South Kitsap Junior Women's League to participate in "Port Orchard Clean Up flay" April 15, 1978. City truck will be available for pick up of clean up material. Representative of L.C. Properties approached Council to request results of study by Street and Alley Committee concerning a proposed rezone application for property they own on Kitsap Street. Legal description: E , of Lot 3 and all of Lot 4, Blk. 7, 1st Addition to Sidney as per plat, recorded in Vol. 1, of Plats, pages 10 and 11, Kitsap County, Washington. Councilman Lee Caldwell, Chairman, Street and Alley Committee stated that the Committee was greatly concerned over ingress and egress from proposed parking area. The Street and Alley Committee would like to discuss and see plans of alternative parking area before making recommendation as to whether LC Properties should make application for rezone of their property. City Engineer Knobbs introduced new Assistant City Engineer Benjamin Long. Mr. Long came aboard March 15, 1978 and. stated "he is glad to be here" Councilman Wilson reported that a leak has developed in the Woof of the Active Club Building (Room 2) and a roofer has been called in to make the necessary repairs. Councilman Lee Caldwell, Street and Alley Committee informed Council that the third and final parking, study has been taken. The Committee will now compile all results and findings into usable statistics and present them to Council. Councilman Wilson requested that letter be written to students involved in helping the Street and Alley Committee complete the three phases of the parking study, thanking them for their assistance. Mayor Powers directed Clerk to write letter. Councilman Lee Caldwell reported to Council that the Blackjack Creek guard rail has been replaced by the State Highway Department. Councilman Lee Caldwell stated that Horluck Transportation Company has informed the Street and Alley Committee that they are not interested in providing a bus from the "park & ride" lot to the ferry at this time. Bremerton -Charleston Transportation Company is not enthusiastic about providing a bus unless the bus would go straight to Bremerton. Councilman Lee Caldwell informed Council that Item No. 8 of the unfinished and old business can be dropped (tabled motion by Lee Caldwell, Horluck Transportation Co. agreement for City to be responsible for financing on building of new ferry) as Horluck Transportation Co. has purchased a hull and are planning to construct a new ferry without Federal funding. On motion by Councilman Geiger, seconded and carried, Council obligated $3,213.00 from the P.W.E.A. Fund to Building and Maintenance in General Government, Current Expense Fund. On motion by Councilman Geiger, seconded and carried, Council approved adjustment of following salaries: City Treasurer $ 15,800.00 Assistant Clerk Treasurer 14,165.00 Cashier -Receptionist 13,291.00 Assistant Clerk 12.000.00 Police Traffic Court Clerk 13,291.00 Parking Police Officer 9,500.00 Clerk read letter from Ron Olson, Alpha Homes, requesting permission to utilize a portion of their property located on Sidney Road and Lippert Drive for equipment storage. After much discussion by Council as for need to refer this matter to Planning Commission and gain citizen input,. Mr. Olson asked that he be allowed to withdraw their request as time is a factor and they can make other arrangements for storage of the equipment. On motion by Councilman Libby, seconded and carried, Council set the date of May 8, 1978 as the deadline for accepting applications for fireworks license. On motion by Councilman Libby, seconded and carried, Council approved Resolution No. 1197, a resolution setting April 24, 1978 as the date of hearing for petition submitted by Gary P. Wasilchen, 195 Tremont to vacate unknown alley running between Blocks 1 and 2 of Harrison Park Addition. Clerk read Ordinance No. 1032 and recommendation of Planning Commission relative to Ordinance No. 1032, an ordinance amending Section 10, City Zoning Ordinance No. 899. After much discussion, Council felt that more time was needed to study this matter in depth. No action will be taken at this time. On motion by Councilman Geiger, seconded and carried, Council set April 24, 1978 the date of public hearing for recommendation of Planning Commission to amend City Zoning Ordinance No. 899 relative to "Low Density" yard set -backs. On motion by Councilman Lee Caldwell, seconded and carried, Council approved Ordinance No. 1046, an ordinance amending the Uniform Building Code to include Thermal Efficiency Standards --as described -in RCW 19.27 On motion by Councilman Lee Caldwell, seconded and carried, Council approved Ordinance No. 1047, an ordinance repealing certain sections of Ordinance No. 490, Ordinance No. 694, Ordinance No. 979, Ordinance No. 890, Ordinance No. 918 and Ordinance No. 520 and establishing a new Chapter relating to parking meter violations. On motion by Councilman Lee Caldwell, seconded and carried, Council. approved April 24, 1978 as date of hearing on a proposed Special Use Permit Applica- tion submitted by Jack Cyr, Jr. owner of record, requesting that a law office and real estate office be permitted use within the Residential High Zoning District. The use would be established in the basement of an exist- ing structure located at 712 Cline Avenue. On motion by Councilman Lee Caldwell, seconded and carried, Council set April 24, 1978 as date of hearing on proposed rezone request submitted by Gilbert Benoit for property located at 703 Kitsap Street from Res- idential High to Multi --family 20. On motion by Councilman Libby, seconded and carried, Council set April 24, 1978 as date of hearing on proposed rezone request submitted by Leslie J. Weatherill and William Bloomquist, owners of record, for property located 100 ft. north of Tremont Street on West Street from Residential High to Multi -family 20. Councilman Lee Caldwell read letter from Kitsap County Engineering Dept. requesting that a "no parking Zone" be established on the south side of Sweany Street from Sidney Avenue to the parking lot and on the north side of Sweany Street at Sidney to provide a safe turning radius for vehicles and visability for pedestrians, a distance of forty, (40) feet. On motion by Lee Caldwell, seconded and carried, Council approved the Kitsap County Road Department to install and maintain "No Parking" signs on the south side of Sweany Street from Sidney Avenue to the Courthouse parking lot, a distance of 173.5 feet and on the north side of Sweany Street at Sidney for a distance of forty feet. On motion by Councilman Lee Caldwell, seconded and carried, Council approved allocation of approximately $200.00 to be expended from the Fire Department Training Budget for the Fire Chief to attend a Fire & Arson Seminar at Pasco, Washington on May 22, 23 and 24, 1978. Councilman Wilson reported that the Bypass Study questionaires have been mailed to the public and are being returned. The Bypass Study team will be holding public meetings relative to this study in the near future and invite public input in this matter.
