02/23/1976 - Regular - MinutesPort Orchard, Washington February 23, 1976 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Lee Caldwell, Wilson, Libby, Van Zee, Roos and Geiger. Councilman Eugene Caldwell excused. Also present: Attorney McCluskey, Engineer Knobbs Chiefs Dow and Weatherill. On motion by Councilman Caldwell, seconded and carried, Council approved the minutes of February 9, 1976 as circulated. Mayor Powers recognized two young ladies from Marcus Whitman Humanities class, Miss Tami Ormiston and Miss Annette Summerill. Mr. J. H. McDonald, 310 Sweany Street stated he would like the City to secure a variance from the Puget Sound Air Pollution Agency allowing the residents of the City to burn waste papers and cardboard boxes in outside burners. Council took the request under advisement. Mr. Terry Thompson, Financial Consultant for the City spoke on advance refunding of the General Obligation Bonds approved by the people and sold in December, 1975. Mr. Thompson introduced Mr. Ron C. McLaughlin Vice President of the Municipal Consulting Department of Foster and Marshall, Inc., Investment Bankers and Brokers, who presented a pro- posal to the Council in which Foster and Marshall agree to purchase $695,000.00 General Obligation Refunding Bonds, 1976 of the City of Port Orchard at a par plus accrued interest to date of delivery. Mr. McLaughlin also stated that the City would be able to save the taxpayers $40,419.06 on the advance refunding issue which would be spread over the life of the issue. Attached and made a part of these minutes are the proposal and schedules. On motion by Councilman Roos seconded and carried, Council approved and accepted the proposal as presented. Matter of the lease rental agreement with Olympic TV Cable continued until March 8, 1976 meeting so Council members can study and review the lease agreement. Mr. Twiner of Olympic TV Cable informed Council that he has already invested $400.00 in the partially completed build- ing at Fire Station #2. Mr. Arnold Carraway, 1713 DeKalb Street, stated he was interested in what the Council is going to do relative to his request for vacation of the southerly half of an alley adjacent to Lots 1 & 2, Block 3, Wheeler's Second Addition. Councilman Lee Caldwell moved to remove the motion of February 9, 1976 meeting to table. Seconded and carried. Attorney McCluskey recommended the vacation stating that if the alley was improved without passing of title, there would be no way in which either Mr. Carraway or the City could control trespassing or vandalism. Councilman Wilson stated that this was a new house and not`a pre- existing condition and should not be considered as such. Councilman Geiger moved that the vacation be approved, seconded and carried, with one nav vote. Mayor declared a recess at 8:50 to reconvene at 9:05 P.M. Discussion was held on the traffic condition at Bay and Sidney during the period 4:30 to 5:15 P.M. It was surmised that when the State Highway Department has completed the renovation at both Westbay and Bay and Sidney there will be considerable improvement in the traffic problem. Street Committee is still reviewing the foot traffic problem at the East crossing of Bay Street. Councilman Roos stated there should be no left turns onto Bay Street from Harrison Street. Mayor excused Chief Dow at 9:20 P.M. Councilman Van Zee reported that there will be a Park Advisory meeting at his home on March 4, 1976. Councilman Libby reported that the Water Improvement Program is on schedule. Councilman Lee Caldwell reported that the Committee had met with Mr. Zirkel of the State Highway Department and the State may three --lane Bethel Avenue and lengthen the holding lane at Westbay for,left turns. They also are going to install buttons on the left turn lane at the Behel Y. In response to Councilman Geiger`s request of the February 9, 1976 meeting relative to a new tax, Attorney McCloskey informed Council that the tax was transit housing tax of 20 of the gross sales on hotels, motels and other transit incomes and would be placed in a special fund for the construction of stadiums or for convention uses. Councilman Geiger inquired about boats, such as overnight mooring in the Port Marina. Attorney will research this. There was further inquiry about a joint venture with the City, Schools and County for a high school auditorium. Attorney will also research this. Clerk informed Council of the Summons by Horluck Transportation Com- pany against the City relative to parking spaces in the parking area north of Bay Street. Referred to Attorney. Councilman Van Zee excused at 9:35 P.M. Engineer Knobbs reported that progress is slow on the new library and it appears there are sufficient light panels to give the required Lighting without purchasing additional ones. He also reported that the new meter boxes (slot machines) should be here this coming week. Chief Weatherill reported that there are a number of kids playing on the blacktop fronting Station #2 and riding motor bikes and horses over the blacktop. He was concerned over the liability of the City and was informed to post No Trespassing signs as there is not much else the City can do. Letter of Mrs. Maxine Doyle requesting permission to lease City prop- erty just north of the City Municipal Building and South of Caldwell°s Trading Post referred to Fire and Light Committee. Clerk read ordinance #968 vacating a portion of Austin Street and portions of alleys in the Courthouse complex. Councilman Lee Caldwell moved to approve the vacation provided that Austin Street be kept open and blacktopped. Seconded. Councilman Roos moved to amend the motion to allow ingress into the parking lot from Sidney on Sweany. Seconded. Councilman Geiger moved to delay action on this ordinance until Street and Alley Committee have reviewed the area and make- recommendations. Seconded and carried. Councilman Libby informed Council that the conditions at Clausons wrecking yard are quite bad and something should be done about it. Councilman Wilson was excused for the March 22nd, 1976 meeting by Mayor Powers. Meeting adjourned at 10:05 P.M. Clerk- - Mayor
