05/10/1976 - Regular - MinutesPort Orchard, Washington May 10, 1976 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Lee Caldwell, Wilson, Eugene Caldwell, Libby, Roos and Geiger. Also present: Chief Dow, Weatherill, Engineer Knobbs and Attorney McCluskey. Van Zee excused. On motion by Councilman L. Caldwell, seconded and carried, Council approved the minutes of the April 26, 1976 meeting as corrected: (1) page 1, line 7 from bottom, after Commission, add "for reconsideration, using high density as the criteria". (2), page 2, paragraph 5, strike "Engineer Knobbs" and insert Councilman L. Caldwell. Councilman L. Caldwell reported that the slot parking meters have been installed and that effective Monday, May 17, 1976, citations will be issued to those not conforming. Councilman Geiger stated that the three hour parking along the water- front has been eliminated and the Council should consider those who wish to stop and view the waterfront as well as those who would like to enjoy the small park. Matter referred to the Street and Alley Committee. Mr. Tom Kearns, Kramer, Chin & Mayo showed Council the plan for the Bremerton intertie water line route, stating that within three weeks the final plans should be completed, and there are a few places where peat & bog conditions have been encountered but this will be solved during the construction period. At this time there has been no response from either the State Game or Fisheries Department. Also, that the matter of restoration of Cook Road has not been finalized. Mayor informed Council that the County will hold the hearing on the request of a franchise by the City to construct, operate and maintain water lines along, under and over public roads and highways within the County on June 7, 1976 at 11:45 A.M. in the Commissioners Chambers, County Administrative Bldg. On motion by Councilman Libby, seconded and carried, Council approved the expenditure of sufficient .funds to complete the new Council Chambers in the old library section of the City Hall. Engineer informed Council of the cost of the waste.receptac.le;s, ($145.00) each. Engineer will contact other sources as to more reasonable cost. Chief Dow requested the Police Committee give him some guidelines as to office hours and personnel when Cen-Com is in operation, possibly June 22, 1976. Chief Dow informed Council that the extra cost for policing the Loyalty Day Parade amounted to $299.98. Chief Weatherill reported that the Eugene, Oregon arson school was "the best ever". Mayor recessed the meeting at 8:50 P.M. to reconvene at 9:05 P.M. On motion by Councilman Geiger, seconded and carried, Council rejected the claim for damages in the amount of $326.18 submitted by Elbert L. Koontz 810 Bay Street caused by sewage back up in his place of busies-ess and re- ferred the claim to the City`s insurance carrier. In reference to the letter of CH2M, dated May 3, 1976, re:the City sewer system, Engineer Knobbs stated that there is no need for study relative to infiltration and/or inflow removal. On motion by Councilman Libby, seconded and carried, Council approved the request of the Kiwanis Club of Port Orchard to close Kendall Street on July 3, 1976 from 9:00 A.M, to 1:00 P.M. for the "Port Orchard, 500 Derby". Clerk read from PAWS (Progressive Animal Welfare Society) of Bainbridge island relative to uniform dog license fees throughout the County. Filed. Clerk read copy of letter sent to Safeway, Inc. Bethel Avenue,relative to noise nuisance from sweepers and truck unloading in the early morning hours. Chief Dow will investigate and report to Council. Councilman Geiger, Chairman of special committee to review the request of Ms. Maxine Doyle, 1120 Bethel Avenue, that she be allowed to utilize the City property adjacent to Caldwell's Trading Post, informed the Council that access to the emergency generator must be available at all times, that the space in question is used and needed by the Fire Department Volunteers when in response to a fire call and that a temporary wooded building could not be placed in Fire Zone 2. Councilman Geiger moved that Council allow no construction which would obstruct ingress and egress to the area. Seconded and carried with Councilman Lee Caldwell abstaining from the vote. Councilman Wilson stated that the Councilman Workshop was a very worth- while seminar and it was too bad the other Councilmen could not attend. Councilman Geiger moved that under old business the matter of Mitchell Cemetary and Mitchell Point be dropped. Seconded and carried. On motion by Councilman L. Caldwell, seconded and carried, Council approved the passage of Ordinance #974 amending Port Orchard Municipal Code Section 2.12.010., Appointment of Fire Chief. On motion by Councilman Libby, seconded and carried, Council approved the Mayor to proclaim May 15, 1976 as the day to honor and dedicate the Washington State segment of the Medal of Honor Grove at Freedoms Found- ation, Valley Forge, Pennsylvania and the publishing of same. Councilman Libby moved that the proper person responsible for the re- cycling program at the old County shed on Mitchell Avenue be contacted and informed that the City wants the recycling material removed from the City property. Seconded. Councilman Wilson moved to amend that a notice be sent to Mr. Colin Hergert stateing that something must be done about the conditions at the site and he should meet with the Council at the next meeting. Seconded. Motion lost with four nays and two yeas. Councilman Geiger moved to amend that City equipment be used to clean up the entire place and post signs relative to more dumping and/or recycling subject to Attorney's approval as to the legality of the motion. Seconded and carried. Amended original motion approved and carried. Clerk will write letter to responsible parties on the removal of the items and materials involved. Attorney will prepare an ordinance on the slot box parking meters for the meeting of May 24, 1976. Councilman Geiger moved that the Mayor appoint a Committee to analyze the Mitchell Avenue property and building to determine if the building should be demolished or painted. Seconded. Councilman Wilson moved to amend that the Committee consider all alternatives. Seconded and carried. Amended original motion carried. On motion by Councilman Geiger and carried, Council approved the bills (41872 -- 1972) in the amount of $53,309.32 and'the April payrolls in the amount of $53,161.71.
