07/22/1974 - Regular - MinutesPort Orchard, Washington July 22, 1974 Council of the City of Port Orchard, Washington called to order by Mayor Paul D. Powers, Jr. Council members present: Fulton, Caldwell Doyle, Libby, Van Zee, Roos and Geiger. Also present were Attorney McCluskey, Engineer Knobbs, Chief Dow and Chief Weatherill. On motion by Councilman Fulton and seconded, Council approved the minutes as corrected. Recreational Director of the School District, Colin Hergert, reported on the supervised recreation program. Stated that there are about 240 children participating at East Port Orchard Elementary and about 130 at Givens. Also, that most of the funds are being spent for advertising and very little for materials. There were 40 adults report- ing for the workshops and 150 for tennis. Also, that the Active Club Building is being used daily. He informed Council that the first 9,400 flyers (advertising) cost $400.00,and they expect the flyer for the fall program will cost about $130.00. Also asked Councilman Geiger if the condition of grants, bequeaths, gifts or other funds received for the program shall decrease the cost of the program to the City as an ongoing condition. Councilman Geiger stated, only for this year, as it is expected that the program will be funded from other sources in the future. Mr. Robert Gehring submitted a petition for the vacation of a piece of Cedar Street, 30 feet by 30 feet abutting on his property directly north of 691 Bethel Avenue. Council set the date of hearing on the petition for August 26, 1974 at 7:30 PM. Referred to Street Committee. Mr. Robert M. Schultz, Box 95, Lilliwaup, Washington also submitted a petition for the vacation of a portion of Cedar Street abutting Lots 1 & 2, Block 7, Wheelers Addition. Hearing date set for August 26, 1974 at 7:45 PM. Referred to Street Committee. Mr. Nick VanderStaay, 691 Bethel Avenue reported to Council that he has nearly completed the improvements at the 691 building and that the last item to do is the landscaping which will be done when weather per- mits. Councilwoman Doyle stated that the sidewalks in that area are in very bad condition. Matter referred to Street and Alley Committee. Mr. and Mrs. Louis Molzahn, 1886 Sidney, asked if they could meet with Engineer Knobbs and the City Clerk at 9:30 AM Tuesday, July 23 at the City Hall to discuss the procedures and assist them in securing the proper information relative to the preparation of the Environmental Summary. Meeting was set for 9:30 AM Tuesday and the Molzahns will bring Mr. William Rheems, Park Shore Realty, who is handling the proposed development for them. Clerk presented Council with a map showing the proposed improvement of SR 160 and Bethel Avenue Intersection by the State Highway Depart- ment. The attached letter requested the Council approval of the imp- rovement. Engineer Knobbs explained the changes and stated that the State has $40.,000.00 to spend which would fall short of enough funds to complete the improvement as originally expected. Mr. Clarence Dahlke, 751 Warner, showed the Council his proposal and explained his objections to the plan. After considerable discussion on the proposed improvement, Council approved the plan as proposed on motion by Coun- cilman Geiger, seconded and carried, with Councilwoman Doyle and Councilman Roos voting no. Councilman Van Zee moved that a letter be written to the State Highway Department requesting that the right turn lane as proposed by Mr. Mel Holgerson, Project Engineer, be shown on the plans and will be considered within the year or when funds are available. Seconded and carried. On motion by Councilman Caldwell, seconded and carried, Council approved the leasing of the Taylor Street Building to the County of Kitsap for the purpose of housing planning staff. The county will make minor re- pairs that are necessary. Council was informed that the current lease July 22, 1974 Page Two cost for new office building is from $3.50 to $4.00 per square foot per year. Finance Committee will review and study the lease cost and make recommendations to the Council at the next meeting. Nick VanderStaay, 691 Bethel Avenue informed Council of a 13 acre tract of land in the Cedar Heights area that he intends to develop into apartment houses. There will be about 180 units of one and two bed- rooms. Councilman Van Zee moved that the statement of Sundt-Farron for the City's liability coverage for this year in the amount of $11,408.00 be approved. Seconded. Councilwoman Doyle moved to amend the motion by "the Council will review the policy at the end of the year". Seconded and carried. Original motion, as amended, carried. Clerk read Ordinance #934. Councilman Van Zee moved the Ordinance #934 providing for the construction and installation of the Water Intertie & ak2,000,000 gallon reservoir and providing for a $700,000.00 general obligation bond proposition be placed on the September 17, 1974 election ballot. Seconded. Councilwoman Doyle moved to amend the motion by the elimination of the word emergency which appears in the Ordinance. Seconded. Motion to amend lost with one yes and six nos. The original motion carried with six yes and Council -woman Doyle voting no. Clerk read letter from the Consulting Firm of Kramer, Chin and Mayo dated July 15, 1974 (KCM #505) relative to the necessity of an Environ- mental Impact Assessment for the Water System Improvement Program, setting the schedule and time table and proposing to complete the E.I.S. for the sum of $3,100.00 and further stating that the total cost shall not exceed the $3,100.00 without Council approval. Council- man Fulton moved to accept the proposal as set forth in the letter and Estimate of Professional Services and that the firm of Kramer, Chin and Mayo proceed with the preparation of the Environmental Impact Assessment. Seconded. Motion carried with one no. Mayor declared a recess at 9:45 for fifteen minutes. Council reconvened at 10:00 P.M. On motion by Councilwoman Doyle, seconded and carried, Council accepted resignation from James Benton, Patrol Officer and instructed the Clerk to write a letter to James Benton commending him for the services rendered to the City. On motion by Councilman Geiger, seconded and carried, Council approved the paying of the extended coverage from 5/l/74 through 5/18/75 under Binder #48202 in the amount of $703.00. Engineer Knobbs explained the Evaluation and Declaration of Environ- mental Significance prepared by the City for the posposed filling and drainage of the Radey Pond. After discussing the effects of the action and weighing all the factors involved, Councilman Caldwell moved that the Council declare that the action may have significant adverse effect on the environment and that a detailed environmental impact assessment be prepared. ,Seconded. Motion lost with three ayes and four nays. Councilman Geiger moved that the Council declare that the proposed action will not have a significant adverse effect om the environment and that the action be classed as a negative declaration. Seconded and carried with five ayes and two nays. On motion by Councilman Caldwell, seconded and carried, Council instructed the Clerk to write to the Soil Conservation Agent of the County for their assistance in designing and engineering for the drainage plan relative to the Radey Plan. Councilman Caldwell explianed that he contacted the agent and the assistance may be available.
