Council of the City of Port Orchard, Washington called to regular session
by Mayor Paul D. Powers, Jr. Council members present: Fulton, Caldwell,
Doyle, Libby, Van Zee, Roos and Geiger. Also present Attorney McCluskey,
Chief Weatherill , Superintendent of Public Works Knobbs-and Chief Dow.
Councilman Fulton moved that the minutes of July 22, 1974 be approved as
circulated. Motion seconded. Councilman Roos wanted the minutes to re-
flect his moving that a study session should be held on the Bethel Ave-
nue Intersection and SR 160. Councilwoman Doyle moved to amend the min-
utes to show the discussion of the SR 160 and intersection with Bethel
Avenue and that a study session would be set up to discuss the matter.
Seconded. On the question there were four nay votes, Motion lost.
Councilwoman Doyle moved to amend the original motion by making correc-
tions as noted on attached list. Seconded. Motion lost with four nays
and three yeas. The original motion approved by the Council with five
yeas and two nays.
Mrs. Anita Sanford presented the three Kitsap County Rodeo Princesses to
the Council. Claudia Razor, South Kitsap, Sue Strand, North Kitsap and
Sally Robinson of East Bremerton. Each princess spoke briefly to the
Council. Princess Claudia Rzaor presented Mayor Powers with a 10 gal-
lon hat.
Clerk read a petition from residents in the Bethel Avenue area protesting
the razing of the Old McClenathan home and also protesting the building
of a new church by the Church of the Nazarene on the property. Council
listened to dicussion on the matter by both sides and the Mayor informed
those present that there could be no action taken by the Council at this
time as there is nothing to act on. Councilwoman Doyle stated that
the old home could possibly be of historical significance.
Mr. Adrian Carr congratulated the Council on the Water Improvement Program
stating that he had spent time on the study for water when he was on the
Council. Also reported that he was having little if any sucess in interest-
ing the County Commissioners in a animal leash law. Also that he is being
bothered by a crowing rooster and would like to see a amendment to the
Animal Control ordinance to prohibit keeping roosters in the City.
Chief Weatherill reported that Mr. D. Erdahl had left the employ of the
City and that he had hired a Mr. Randy Calhoun to the position of Fire
Marshall.
Mr. Ron Perkerewicz informed Council that the Merchants would like to
fix up the marquee on Bay Street with a nautical theme by setting used
piling around the supports and tying them 2 inch manila. There would be
14 (fourteen) supports in this manner. Matter referred to Street and
Alley Committee. Councilman Geiger moved that the committee have the power
to act. Seconded. Councilwoman Doyle moved to amend the motion that the
committee would have to come back to the Council for action and approval.
Seconded. On the vote the amendment to the motion failed with five nayes
and two yeas. On the vote the original motion approved with five yeas
and two nays.
Attorney McCluskey reproted that he had mot with the Superior Court Judge
Hamiton on the Cities request for a temporary injunction against Mr. Tom
Clauson, 1971 Sidney relative to his operation as a open storage yard.
edge Hamiton stated that as there were no irreparable damage to the sur-
rounding area by Mr. Clauson he would not issue a temporary injunction.
The case is now set for full trial in the first week of October.
On motion by Councilman Caldwell, seconded and carried Council approved
the issuance of Shorelines Management Substantial Developement Permit
NO. 9. Council reviewed the Evaluation and Declaration of Environmental
Significance and agreed that the action would not have a significant
adverse effect on the quality of the environment and that the action con-
stitutes a negative declaration. The applicant being Horluck Transporta-
tion Company.

Clerk read request from Mr. Deane Robinson, principal of Givens Elemen-
tary School for temporary parking on the West side of Sidney between
Kendall and Sroufe for a period of twenty to thirty minutes for parents
to park when on school business. Councilman Fulton moved that the re-
quest be approved. Seconded. Councilwoman Doyle moved to amend the motion
to include that parking on the east side of Sidney Street be eliminated
during the times that parking is permitted on the west side. Seconded.
Motion to amend' -failed with five nays and two yeas. Councilman Geiger
moved to amend the motion to include one hour parking on the west side
during school hours. Seconded. Motion to amend carried with six yeas
and one nay. Original motion as amended carried with six yeas and one
nay.
Clerk read letter from Mr. Richard Warren, Kramer, Chine & Mayo, and dis-
tributed copies of the action calendar for processing of the E.I.S. on
the Water Improvement Program. Councilman Libby moved that the calendar
be accepted with the understanding that the dates could be changed if
some unforseen problem became apparent. Seconded and carried.
Clerk read letters from the Department of Social & Health Services re-
questing the Council to advise them what action should be taken on the
application for the 1MG Reservoir and the application for the Well. On
the recommendation of Engineer Knobbs Council approved the cancellation
of the application for the 1MG Reservoir and that the application for
Well funds be kept active.
Clerk read letter from Kitsap County Department of Health recommending that
the Baptist Church install a seperate system for the mobile home being used
as a parsonage. Councilwoman Doyle moved that the Council accept the recom-
mendation of the Health Department and that the Council should follow those
recommendations. Seconded. Councilman Fulton moved to table the motion
until the next Council meeting. Seconded and carried. Mayor referred
item to Water, Sewer Committee.
Clerk read letter from Kitsap County Sheriff informing City that the daily
charge for boarding and lodging prisoners has been raised from Three Dollars
per day to Seven Dollars per day effective August 1, 1974.
Clerk read request from the Christian Times, local businessman and local
churches requesting approval to hold a community Christian folk life
musical between noon and 8:00 pm September 14, 1974 in the new marina park-
ing lot. After discussion on the possible problems that -could be fore-
seen relative to traffic flow, congestion and other items, Councilman
Geiger moved to approve the request with the stated items within the re-
quest that they will furnish Liability in the amount of $100,000 and Med-
ical coverage in the amount of $500.00 with State Farm Insurance Com-
pany and they will furnish portable toilets. Also they feel that they
can handle the traffic and will do the cleaning up of the area after the
program is completed. Seconded. Chief of Police Dow stated that there
would be normal problems and that he would have patrol officer watching
the operation. Seconded.
Councilman Geiger moved that the Council keep the same restrictions on the
number of houses (30) that the Kitsap Housing Authority can renovate with-
in the City for low cost housing. And if warranted a change could be made
at a later date. Seconded. Councilwoman Doyle moved to table the motion
until additional information can be obtained so the Council can study
with uptodate information. Motion lost for lack of a second. Original
motion carried with one nay.
On motion by Councilman Fulton and carried Council approved Resolution NO.
1132 of the City of Port Orchard authorizing the expenditure of funds in
the amount of $23,825.00 from the Federal Shared Revenue Fund, Classi-
fication Utilities to the Classification Transportation. One nay.
On motion by Councilman Caldwell, seconded and carried Council approved
Resolution #1133 designating the City Attorney and all the assistants
to the City Attorney.
On motion by Councilman Roos, seconded and carried Council approved the
appointment by the Mayor of Jack Grable, 1019 Kitsap to the City Planning
Commission to fill the vacancy of Ronald Heuer who has resigned. Mr.

Grable will serve until 12/31/1975.
Councilman Van Zee moved that the Council approve the Appointment of
Clarence Hovde, 245 Fireweed by Mayor Powers to the vacancy on the Park
Commission by the resignation of Mr. Maynard Lundberg. Said appointment
to expire 3/31/75. Seconded. Councilwoman Doyle moved to table motion
as Mr. Hovde is already on the South Kitsap Park Board. Seconded and
carried.
Councilman Caldwell informed Council on the Mitchell Point property, stating
that the county appraises the property at $10,800.00. Also that it may ec-
in the hands of Bureau of Indian Affairs and if this is so it could take
a long time to get any results. Matter will be discussed.at a study session
on Tuesday, August 20, 1974 at 7:30 in the Council Chambers. The clerk
will inform the Planning Commission and ask that they give some input to
the Council on the Lowry zoning plan at the same meeting.
Clerk read letter from the South Kitsap Hospital District recruiting for
members to a advisory committee that will aid in coordinating the medi-
cal problems of our community and make recommendations to the commissioners.
David Libby volunteered to serve on the committee and represent the City.
Councilwoman Doyle informed the Council of Mary Wilson, 1306 West Street
as desiring to serve on the Planning Commission and stated that she has
engineering background and would be a asset to the City. Councilman Roos
moved that the Council approve the appointment of Mary Wilson to the
Planning Commission to fulfill the unexpired term of Wayne Williams va-
cated by his resignation. Seconded and carried. The term of Mary Wilson
will expire on 12/31/74.
Engineer Knobbs reported that the State Highway Department had approved
Ordinance No. 931 of the City eliminating parking on SR 160 (Bay Street)
from Harrison Avenue to Maple Avenue on both sides.
Informed Council that the sewer line is almost completed on Sidney South
of Melcher and that the last residence that can be served is the O.R.
Rood residence at 1341 Sidney. The sidewalk is about k complete at this
time. There is a problem at the Clare Hicks residence 1230 Sidney in that
the sidewalk as laid will not contour with the entrance into their pro-
perty. Matter referred to Street Committee.
Reported that bids were opened on Friday August 9, 1974 and that the high
bid for the 1966 Model 530 backhoe was $4250.00. Engineer recommended that
the Council accept this bid. Councilman Caldwell moved that the City accept
the bid of H & S Quility Construction of Route 5, Box 270 Bremerton, WA.
in the amount of $4250.00 plus Sales Tax in the amount of $212.50. Seconded
and carried. Engineer reported -that the bid of Puyallup Tractors, Inc.,
514 River Road, Puyallup, Wa.in the amount of $10,500.00 plus Sales Tax
was the only bid received and<that he recommends that the City purchase the
1973 Case 580E Tractor loader backhoe. Councilman Caldwell moved to pur-
chase the 1973 Case 580B tractor loader and carried. Engineer reported that
only one bid recieved for the Hanson loader and requested that Council re-
ject the bid. Recommendation approved on motion by Councilman Caldwell,
seconded and carried.
Chief Dow reported that Mr. Ray MacPherson had passed his physical and will
report for duty as a patrol officer with the department on August 22, 1974.
Also reported that the new patrol vehicle is on the job. Also that he will
be on vacation from Thursday August 15 through September 3, 1974.
Attorney McCluskey reported to the Council on the Lowry zoning plan, stating
that this is a new concept and that it would be challenged and that the
Council should determine if they want to test a new concept. Also reported
that he had been contacted by the attorney for the insurance company that
is defending Chief Dow in the suit brought by Mr. Griffiths and was in-
formed that there is a possibility that there may be an exclusion in the
coverage as to damage to tangible or intangible property. Attorney asked
the Council if he should enter as co -counsel for the Chief and that at
this time there would be no cost to the City but would inform the Council
if and when costs would occur and the Council can act at that time.
Attorney McCluskey stated that the foreclosure sale on those Local
Improvement District properties that are delinquent will be held by the City

On motion by Councilman Geiger, seconded and carried Clerk instructed to
write a letter to Superior Court Judge Donald Thompson congratulating
him on that appointment.
Councilman Caldwell moved that the rental fee for the Taylor Street
building be $75.00 per month and that the renter (Kitsap County) pay all
utilities. Seconded. Councilman Fulton moved to amend the motion to
include "the length of rental shall be for six months and at that time shall
be reviewed". Seconded. Amendment to the motion carried. Amended motion
carried.
Councilman Geiger reported that paper copies of Roberts Rules of Order are
available for 95� and moved that sufficient copies be purchased for the
use of the Council. Seconded and carried.
Councilman Geiger explained to the Council of the EEA program that will
pay up to $700.00 per month for one position in the Police Department. The
funds will be available through December,1974 and that there may be funds
available during 1975. Councilman Geiger moved that the position requested
by Chief Dow be filled. Seconded and carried.
Councilman Geiger informed Council of the new program with the Employment
Security Department under Title 11 whereby the City could obtain two em-
ployees for one year with the City being subsidized in the amount of $7000.00
per year each. Councilwoman Doyle stated that the City needs a planner and
that the City should consider the offer of the county to share a planner.
Councilman Geiger moved that the Council approve the Mayor to sign contracts
for two employees under Title 11 program for use in the Public Works Depart-
ment. Seconded and carried.
On motion by Councilwoman Doyle, seconded and carried Council approve the
sending of a letter to the South Kitsap All Star Babe Ruth team congrat-
ulating them on winning the Pacific Northwest Regional Babe Ruth Tournament.
On motion by Councilwoman Doyle, seconded and carried Council approved the
sending of a letter to the South Kitsap High School Drill Team congratulating
them on bringing home two of the top trophies from the Thunderbird Drill
Team Clinic in Portland July 15 to the 19th.
Councilwoman Doyle informed Council of the Steering Committee meeting of
P.E.D. stating a list of priorities, including Mitchell Point as a view
point. Also stated that waterfront property has the highest priority for
IAC funding. Also informed Council that hopefully there will be a meeting
of Our Next Step on Tuesday August 20, 1974. Also asked Council to approve
the study and if they want her to continue on the project. Council indi-
cated yes.
Councilwoman Doyle informed Council of her plan to furnish the lounge stat-
ing that about $665.00 should do the job, and moved for the approval to
expend funds for the project, seconded and carried.
Councilwoman Doyle reproted on her trip to Expo 74 in Spokane and informed
Council that a 1600 foot ski lift is available and could be used to trans-
port people up and down Sidney. Informed Council that she had invited some
Australians and Russians to visit our City and would like the members of
the Council to assist when they arrive. Reported that on September 9, 1974
there will be a meeting on Transportation sponsored by the League of Womens
Voters -in Silverdale at 10:00 A.M. Representatives form PSGC and Highway
Department as well as others will be there.
Councilman Caldwell reported that the Street Committee had inspected the
sidewalks in the area of�'691 building and found that on the turn the side-
walks had been removed and not replaced and that there is some settlement
in other areas but nothing should be done until all construction in that
area has been completed.
Councilman Fulton reported on the meeting in Lacey with the Department of
Ecology on the Sewer Facilities Plan for South Kitsap Sewer Plan.
Councilman Fulton reported of meeting with Mr. Brinken and Mr. Siegfried
of Puget Sound Power & Light and learned that the present lighting along
Port Orchard Blvd. is $1.45 less per light than if we used PSP&L facilities.
