Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at
7:30P.M. at City Hall, 216 Prospect Street. Council members present: Clauson, Wyatt, Morrison Geiger,
Powers, Van Zee, and Stansbery. Staff present: Deputy Clerk Merlino, Police Chief Townsend, City
Treasurer Tompkins, City Planner Wenman, City Engineer Curies, City Attorney Combs, and City Clerk
Parks.
Councilman Stansbery led the audience and Council in the Pledge of Allegiance.
Mayor Weatherill asked for audience comments for items not listed on this agenda.
Ron Rice, Briarkirk Enterprises, Inc., submitted a letter to Council suggesting his business located at 369
SW Sedgwick Road is being discriminated against by the City of Port Orchard for the following reasons:
• Selective enforcement of the City of Port Orchard sign ordinance.
• Rigid enforcement of building codes
• Port Orchard Engineering Department is acting in concert with the Albertson's Store adjacent to
his property in an attempt to gain a portion of his property along Sedgwick Road.
Edie Wood, 4500 block of Sidney Avenue, spoke in support of Ron Rice's business and stated the noise
levels in the area have increased significantly over the past few years, with the addition of Sidney Glen
Elementary School, the Nazarene Church, Grey Chevrolet and now the Amphitheater.
Mayor Weatherill advised Mr. Rice, he will review this issue with the City Engineer.
Bob Wheeler, Triangle Associates, discussed the planning efforts for the Water Resource Inventory Area-15
(WRIA-15). Mr. Wheeler outlined the three phases of the plan as follows:
• Phase 1 -Organize the planning unit
• Phase 2-Conduct a watershed assessment
• Phase 3 -Develop the watershed plan.
In conclusion, Mr. Wheeler asked for Council concurrence and authorization for Mayor Weatherill to sign
Memorandum of Understanding regarding the Watershed Planning-WRIA-15.
Councilman Van Zee moved to authorize the Mayor to sign the Memorandum of Understanding regarding
the Watershed Planning-WRIA-15, seconded by Councilwoman Powers.
Councilman Van Zee amended the motion to reflect authorization for the Mayor to sign is subject to review
by City Attorney, seconded by Councilwoman Powers and carried.
Original motion as amended, authorizing Mayor Weatherill to sign the Memorandum of Understanding
regarding the Watershed Planning-WRIA-15, subject to review by the City Attorney, was approved by
unanimous vote.
Councilman Geiger moved to approve Ordinance No. 1803 requiring fire sprinkler systems in new and
remodeled residential properties; establishing fire and life safety requirements for existing multi-family
residential buildings classified as Group R, Division, Occupancy, seconded by Councilman Morrison.
Assistant Chief Senter answered questions pertaining to the attachments of Ordinance No. 1803.
On motion by Councilman Clauson, seconded by Councilman Geiger, Council tabled motion to approve
Ordinance No. 1803 for further clarification and reformatting. Proposed Ordinance No. 1803 to be before
Council at the December 26, 2000 meeting.
On motion by Councilman Stansbery, seconded by Councilman Wyatt, Council approved Ordinance No.
1804 repealing Ordinance No. 1798 and reestablishing tow away zones, and providing for the impound of
vehicles where the driver is arrested for patronizing prostitutes, driving without a valid license or while under
the influence of alcohol or drugs.

Density Residential to include an additional Residential Classification of Medium Density Residential.

On motion by Councilwoman Powers, seconded by Councilman Stansbery, Council approved Ordinance
No. 1808 by amending the City of Port Orchard Comprehensive Plan Ordinance No. 1634; by amending the
Comprehensive Map to reflect a classification of Medium Density Residential and Industrial on
approximately 104 acres of land in the Ross Point Plateau, Evergreen Pacific Foundation, proponent.

On motion by Councilwoman Powers, seconded by Councilman Morrison, Council approved Ordinance No.
1809 by amending the City of Port Orchard Comprehensive Plan Ordinance No. 1634; by amending the
Comprehensive Plan Map for properties located on the northwest corner of Pottery Avenue and South
Kitsap Boulevard from High Density Residential to Commercial, Roger Johnson, Michael Bell and Eric
Kvinsland, proponent. (Planning File no. CA-05-00) Legal Description: Attachment "D"
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council approved Ordinance No.
1810 by amending the City of Port Orchard Comprehensive Plan Ordinance No. 1634; by adding a new
provision to the Transportation Element of the Comprehensive Plan; providing for an inventory of level of
service standards for state-owned facilities, and as estimate of traffic impacts and needs on State Highway
facilities. (Planning File No. Ca-06-00).
At 8:35PM Mayor Weatherill called for a 10-minute recess with meeting reconvening at 8:45PM.
On motion by Councilman Geiger, seconded by Councilman Clauson, Council approved the consent
agenda items as follows:
a. Minutes of the following Council meetings:
(1) November 27, 2000 regular meeting
(2) November 27, 2000-2001 Budget Study Session
(3) December 4, 2000 Public Hearing regarding 2001 Budget
(4) December 4, 2000 Revenue Sharing Study Session
b. Approval of Claim Warrants Numbers 34006-34111 in the amount of $359,970.01 and
November 2000 Payroll Warrants Numbers 134 798-134876 and direct deposits in the
amount of $229,587.84.
c. Ordinance No. 1811 adopting the budget for the year 2001 to reflect appropriations as
designated at the budget hearing held December 4, 2000.
d. Resolution No. 1918 repealing Resolution No. 1636 and reestablishing a policy on
conversion of homes to businesses.

e. Authorization for the City Treasurer to dispose of miscellaneous computer equipment in
the best interest of the city. Attachment "E"
Councilman Geiger presented the Request For Proposals received offering to conduct a Salary Survey
for the City of Port Orchard. The Finance Committee interviewed representatives from each company.
The following proposals were received.

D Hulbert Associates, Inc.
On motion by Councilman Geiger, seconded by Councilman Morrison, Council accepted the proposal
submitted by Hulbert Associates, Inc. to conduct a Salary Survey for the City of Port Orchard, in the
amount of $13,940 plus expenses and authorized the Mayor to sign contract.
Council set Thursday, December 28, 2000 at 6:30 PM as a date and time for a tour of the city's residential
and commercial locations nominated for the city's Holiday Season 2000 Good Neighbor Awards.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council authorized the Mayor to
sign a contract for a special storage unit for Police Department use.
City Treasurer Tompkins reported on a conversation with Fire Chief Mike Brown in regards to the city's
CENCOM cost allocation. Ron McAffee, CENCOM Director, has concurred that upon authorization from the
city, CENCOM will bill South Kitsap Fire District No. 7 directly for the newly agreed 25% fire portion of the
city's share of the CENCOM costs. This will start in 2001. By consensus the Mayor and Council approved
authorizing CENCOM to bill South Kitsap Fire District No. 7 direct for the 25%.
City Treasurer Tompkins discussed the impacts of 1-722 and Association of Washington Cities
recommendation that cities reenact ordinances and resolutions, which adopted or set taxes and fees from
July 1999 to December 1999.
City Attorney Combs concurred with the City Treasurer and recommended passage of proposed Resolution
No. 1919 and Ordinance No. 1812.
On motion by Councilman Clauson, seconded by Councilman Morrison, Council by unanimous vote,
approved Ordinance No. 1812 regarding charges for services and fees collected by the City of Port Orchard
and readopting Ordinance Nos. 1778, 1769, 1775, 1777, 1780, 1781, and 1786 and declaring this a public
emergency to be effective immediately.
On motion by Councilman Morrison, seconded by Councilman Wyatt, Council by unanimous vote, adopted
Resolution No. 1919, re-adopting Resolution Nos. 1880, 1878, and 1888 and declaring this a public
emergency to be effective immediately.
At 9:20 PM Mayor Weatherill adjourned Council into Executive Session to discuss pending labor
negotiations and a real estate issue for 30 minutes. Executive session was extended an additional 30
minutes.
At 10:18 PM MayorWeatherill adjourned executive session and reconvened Council into regular session.
On motion by Councilman Geiger, seconded by Councilman Morrison, Council authorized Mayor to enter
into an agreement with Police Sergeant employees with contract provision the same as the patrol officers,
except for the following terms, which were discussed in executive session.
o Set base wage at $54,500 per year effective December 3, 2000;
o A 3.5% Cost of Living Adjustment (COLA} effective December 3, 2000.
o Adjust life insurance policy value to $50,000.

o Medical, dental, and vision plans would remain same as non-represented employee classification.
