02/24/1975 - Regular - MinutesPort Orchard, Washington February 24, 1975 Council of the City of Port Orchard, Washington called to regular session by Mayor Paul D. Powers, Jr. Council members present: Fulton, Doyle, Libby, Van Zee, Roos and Geiger. Councilmember Caldwell excused because of illness. Also present, Attorney McCluskey, Engineer Knobbs, Chief Weatherill and Chief Dow. Councilman Fulton moved that the minutes of February 10, 1975 be approved as circulated. Seconded. Councilwoman Doyle moved to amend the motion to make twenty corrections that she felt should be made. Seconded. Councilman Geiger moved to amend the amendment by excluding all of the twenty corrections except "Page 1, No. 1; Page 2, No. 1 and 2. Seconded. Councilwoman Doyle moved to table. Motion to table lost for lack of a second. Motion to amend the amendment approved by Council and carried. Original motion as amended approved by Council. Corrections are as follows: Page 1, paragraph 4, "add to paragraph 4, Highway 160 at Bethel V ., and Page 2, paragraph 1, add "plumbing inspections to be done for the fees involved". Paragraph 2, add to Chief Weatherill report "with Washington Surveying and Rating Bureau recommendation for 35,000 gallon per minute fire flow. Add "that permit for burning cannot be issued to Lee and Throm while there is a dirt cover over the trash". Attorney McCluskey stated that inaccurate reporting of the minu es shoul be changed at the Council meeting. Also that any citizen or could file suit against the Clerk and the Council to make them file correct and accurate minutes, then the Judge would decide on the case. Councilwoman Doyle moved that the City Attorney investigate the matter of incomplete and inaccurate minutes and take appropriate action. Motion died for lack of a second. Mr. C. Adrian Carr complained to the Council again about dogs running uncontrolled in his area on Annapolis Hill and stated that the only answer to the problem is a leash law. Also wanted to know if anything has been done on the animal control ordinance as he had requested on his last visit to the Council. Mayor informed Mr. Carr that the comm- ittee was still reviewing the ordinance. Mr. Carr stated that use of CETA personnel could be used to inventory the animals within the City. Mr. Clarence Dahlke stated the Humane Society should not be subsidized by local governments, that the Society should be self supporting. Councilman Libby moved that the Council hold a public meeting March 3, 1975 at 7:30 p. m. in the Council Chambers to allow the citizens to voice their opinions as to a second cab company operating within the City. Seconded and carried. Engineer Knobbs reported that Mr. Richard Warren, Kramer, Chin and Mayo, could not be present as he has the flu, but will be at the March 10, 1975 Council meeting. 410 - Lillian Wilson, Northwest Air Photos, left price lists for Council to review. The proposed contract for Emergency Communications and Other Services was discussed by the Council and Councilman Van Zee moved to complete the contract and the Mayor be authorized to sign on behalf of the City. Seconded. Councilwoman Doyle moved to table until the contract could be discussed more thoroughly. Seconded. Motion lost. Councilman Geiger moved to amend the motion to allow for either monthly or quarterly pay- ments by the City rather than a single payment. Seconded. Carried. Amended original motion carried with all members voting yes except Councilwoman Doyle voting no. Councilman Geiger moved that Ordinance #946 amending Chapter 13.04 of the Port Orchard Municipal Code, Water Rates, be approved and adopted. Seconded and carried with all members voting yes except Councilwoman Doyle voting no. Councilman Fulton moved that Ordinance #947 amending Chapter 13.08, Mun- icipal Code, Sewer Rates, be approved and adopted. Seconded. Council- woman Doyle moved to amend the motion by deleting "whether occupied or not" from (1) Class I. Motion died for lack of second. Councilwoman Doyle moved to table the motion for further study. Motion died for lack of second. Council approved the original motion with all Council members voting yes except Councilwoman Doyle voting no. Councilwoman Doyle moved that the Water, Sewer and Sanitation Committee study and recommend to the Council fair rates for water and sewer on the Marina connections. Seconded and carried. Councilwoman Doyle moved that garbage rates be amended to $2.00 per can per month on residential users and $15.00 per pick up on the one cubic yard containers. Motion died for lack of a second. Councilman Roos moved that the Engineer and staff prepare specifications for a call for bids for the operation of the Sanitation Department under the guidance of the Sanitation Committee. Seconded. Councilwoman Doyle moved to amend the motion to franchise the large and commercial users and the City continue to operate the disposal of the residential users. Motion died for lack of a second. Council approved the original motion with all members voting yes except Councilwoman Doyle voting no. After lengthy discussion on the cleaning up of the area surrounding the garbage area at the Dr. J. Coyle property, Engineer stated Dr. Coyle had stated he would clean up the area and keep it clean. Councilwoman Doyle questioned that there is room enough to add a storage area and still have room to handle large supply trucks. Councilman Fulton moved that the Council approve Dr. J. Coyle's application for Shorelines Management Substantial Development Permit and that the action will not have a significant adverse effect on the quality of the environment, and this finding together with any attached supporting materials constitute a negative declaration. Seconded. Carried with all members voting yes except Councilwoman Doyle voting no, stating the Council is acting with- out thorough information. Engineer Reports: Sewer project of laying laterals in the Herb Theisen area, 116 Bay Street is nearly complete. North Kitsap Sand and Gravel Co. have completed the punch list and Engineer recommended that the Council approve the project and that the retained fee be paid. Councilman Roos moved to approve the project and pay the retainer. Seconded and carried. Councilman Libby moved that the Council approve the purchase of two used 3/4 ton pick ups of the same year and make for use of the Public Works Department and that the funds come from the Federal Shared Revenues. Seconded. Councilwoman Doyle moved to amend the motion to use funds in the Utilities accounts. Seconded and carried. On the amended original motion, Council approved with five yes and one no vote. Council and Attorney discussed changes in the original proposed business registration ordinance. Attorney will prepare new version and Clerk will see that all Council members get a copy prior to next meeting. February 24, 1975 Page Three Councilman Geiger asked the Engineer to contact Seattle and Tacoma City Light as to protectors for the lights on the Port Orchard Blvd. Councilman Roos asked the Police Chief to review the false alarms problem. Councilman Van Zee stated that he can secure a 4' x 6' portable board which has a chalk board on one side and a cork surface on the other side for the Planning Commission for a cost of $163.28 plus $5.68 for casters. Clerk will see if there are available funds in the Planning Budget, and if so Councilman Van Zee will purchase the board. Councilwoman Doyle suggeste that the ordinance for employ holidays be changed to eliminate 4&e�- holidays in February and in October, and also to consider curtailment of, the em ��1,Q ees accumulated annual leave. Also consider ways to elimina�er-�vse t i � Mayor informed Councilwoman Doyle that holidays and leave can only be changed during the negotiating period. Meeting adjourned at 11:30 P.
