May 26, 1975
Council of the City of Port Orchard, Washington called to regular
session by Mayor Paul D. Powers, Jr. Council members present:
Fulton, Caldwell, Doyle, Libby, Van Zee, Roos and Geiger. Also
present: Attorney McCluskey, Engineer Knobbs, Chief Dow and Chief
Weatherill.
Councilman Doyle moved that the minutes of May 12, 1975 be approved
as corrected (corrections as attached and which become part of these
minutes). Seconded and carried.
Mrs. Anita Sanford, (Little Britches Association) accompanied queen
Luellen Clymo and Princesses Ardith Short, Susan Bryant and Lynn
Goodwin to the Council meeting. The Queen and the Princesses
addressed the Mayor and Council on the Little Britches Rodeo at the
Kitsap County Fairgrounds on June 13, 14 and 15, 1975 and informed
the Mayor that he has been challenged by the Bremerton City Comm-
issioners to a contest on the milking of a wild cow.
Mr. John Kleinbach, Chairman of the Library Board, reported to the
Council that the Board had approved the facilities of the surplus
Pacific Northwest telephone building as suitable for library purposes
with some remodeling.
Mr. Arthur Mikelsen, Chairman of the Port Orchard Planning Commission
addressed the Council on problems confronting the Planning Commission
and also indicated dissatisfaction of the structure of the buildings
at Orchard on the Green. Council briefly discussed the matter of
the parking slots at Orchard on the Green.
Clerk read letter from Senator Henry M. Jackson relative to the
Navy Hospital proposed for Jackson Park. Ordered filed.
Clerk read letter from Planner Lombard relative to I.A.C. Grant for
proposed development of the Tremont Park and Recreation Area. Letter
set up the goals and objective of the City, the need of updating the
existing 6 year Comprehensive Park Plan, the need for an operation
budget for the next five years, determined need for staff and/or
consultants and the need for a Citizens Advisory Committee to gather
input from the citizens for the Park Board and Committee. Clerk will
run ad in the Independent until June 20, 1975 requesting those
interested to contact the City Clerk.
Clerk informed Council that the application for a Special Use Permit
for a 190 unit development on Pottery Avenue just North of Cedar Heights
Junior High School by Mr. Nick VanderStaayf Vanderstaay. and Jacobson Realty, has
been received from the City Planning Commission and notice has been published
in the Independent setting the time and place of this hearing and the
Planning Commission recommends that the development be approved and
the Special Use Permit be granted. City Engineer Knobbs informed
Council that in his opinion, after considering the Environmental
Declaration that there is major action with insignificant adverse
effect on the environment and that this is his recommendation. Council-
man Fulton moved to concur with the Engineer's recommendation and
declare that there is major action with insignificant adverse effect
on the environment. Seconded. Carried with five ayes and two nays.
Councilman Fulton moved that the Council concur with the recommenda-
tions of the Planning Commission with the site plan and all records
attached and considered in the records of the Planning Commission to
grant the Special Use Permit for the development of Mapleridge.
Seconded and carried. Complete text of the entire hearing is on tape
number 4 and 5, dated 5/26/75.
Mayor Powers declared a recess at 9:10 P.M. to 9:25 P.M.
Councilman Doyle moved that the Council and the Planning Commission
have a joint meeting with Mr. Mayer of Orchard on the Green to work
out some of the items under question to improve the development,

including parking. Seconded and carried with three nays and four
ayes.
Engineer reported that Mr.R. Rivas,owner of the property at 1017 Bay
Street had purchased a demolition permit and would have the building
on that property completely demolished and removed within 90 days.
Councilman Caldwell reported that the revised prospectus for the 1975
summer oiling by the County had been approved by the State in the
amount of $16,000.00.
Councilman Doyle moved that the City Engineer and the Planning
Department give attention to developing bicycle paths for City routes
previously approved and to prepare an application for the funding
through the I.A.C. in conjunction with the Tremont Park project.
Seconded. Councilman Geiger moved to amend the motion by eliminating
the preparation of the application for funds. Seconded and carried.
Amended original motion carried with five yeas and two nays.
Councilman Doyle gave Council a brief report on the inspection of he
City's buildings and other facilities.
Councilman Doyle moved to remove the matter of the Mitchell Avenue
property,which is in the process of being exchanged by the County
for the Taylor Street property owned by the City, and that the student
recycling center continue at the present site with the understanding
that they want to rearrange the collection area in a more orderly way
and to make it more sightly and that the Planning Department make an
outline drawing to approximate scale to aid in planning with the
student workers for the efficient location of bins. Seconded. Motion
lost with six nays and one yea.
Councilman Doyle reported on the summer job project for students,
stating they must report to the Department of Employment Security
for interview, also there will be a viewer in the County Courthouse
showing available job openings. Councilman Doyle moved for Council
approval to expend funds for the purchase of several posters which
would be produced by the High School Art Class. Seconded and carried.
Councilman Doyle moved that a study session be set within the next
month to examine closely the financial situation with regard to
meeting our immediate and projected needs, especially with respect to water supply
and sewer treatment plant and additional extensions. Motion died
for lack of a second.
Councilman Doyle stated that the City should do some advertising for
the conducting of profit making business on City property, that profit
making business should be paying the City when using City..property...
Councilman Doyle reported that the sign on the south side of Caldwell's
Trading Post is encroaching about two feet on City property and stated
that whenever profit making business uses City property they should
be paying for the use of the property.
Councilman van Zee reported on Park Committee activities. Mayor stated
that the Park Committee and Commission should come up with some cost
figures for the Tremont Park development, determine what priorities
are to be considered and then the Council will act on application for
funding. The City must meet the State grant with 25% of the cash.
Park Committee and Park Commission will get names to the Mayor prior
to the June 9, 1975 Council meeting and the Mayor will appoint them
to the Citizens Advisory Committee.
Councilman Geiger reported on the two quotes received for the City'.t
insurance program for the year 1975-76; Liability and Fire, Errors
and Omissions and Law Enforcement Officers false arrest in the follow-
ing amounts: Fire and Liability with $1,000,000 umbrella coverage
$11,208.00, Errors and Omissions $828.00, Law enforcement officers
false arrest $724.00, for a total of $12,760.00 from Wolfstone, Donley
and McMannama, 408 Roy Street, Seattle, Wa. Fire and Liability with
a $500.00 deductible on both bodily injury and property damage in the
amount of $10,996.00. Councilman Geiger moved to accept the quote of

Wolfstone, Donley and McMannama in the amount of $12,760.00. Seconded
and carried.
Councilman Geiger reported on the progress for the use of the vacant
lot east of the Port Orchard Tavern as a resting place for citizens
with tables and benches. The cleaning and care of the lot would be
done by the adjoining business places. Will have a lease prepared
with the consideration of only public use. Councilman Geiger moved
that the Council approve the signing of the lease with Doctor Pettibon
1940 Sylvan Way, Bremerton, with the approval of the City Attorney.
Seconded and carried.
Councilman Geiger reported on his visit to the Pacific Northwest Bell
Company surplus building on Prospect Street,stating that there were
about 2,300 square feet involved and that with minor remodeling it
would he suitable for use of the library, also that the purchase of
the building would be a sound investment. Councilman Geiger moved for
the Council to approve for the negotiation with the Pacific Northwest
Bell Telephone Company for the building for Library use. Seconded
and carried.
Councilman Geiger moved that the Council reverse their prior determin-
ation on the :Fmvironmental Declaration of Mr. Louis C. Molzahn, 1866
Sidney, and the action be of major action with insignificant adverse
effect on the environment, on the premise that the action taken this
evening on Mr. A. VanderStaay's property is identical in use and
the impact would be the same. He stated also that the Council did
not alarm- the proper or necessary material to make a reasonable
judgement. Seconded. Motion lost with four nays and three yeas.
Engineer reported:
Mr. Del Guzzi will be here next week to discuss the obligation of his
paving and the preparing of the transition lane at the Safeway Complex.
Need approval from the Council for Kramer, Chin and Mayo to proceed
on the survey of the alternate routes for the proposed intertie in
the Water Improvement Program.
Councilman Caldwell moved for Council to approve the survey of the
alternate routes. Seconded and carried with Councilman Doyle voting
no. Councilman Doyle protested that this item was not on the agenda
and that a copy of the Kramer, Chin and Mayo letter should have been
sent to Council members.
Chief Weatherill reported on the Fire Investigation School at Ellens-
burg. Weatherill stated that a new 1,000 gallon pumper is needed.
Councilman Doyle moved that the specifications be prepared by the
Fire Chief and submitted to the Fire and Light Committee. Seconded
and carried with Councilman Fulton voting no.
