Council of the City of Port Orchard, Washington called to regular
session by Mayor Paul D. Powers, Jr. Councilmen present: Fulton
Caldwell, Doyle, Libby, Van Zee, Roos and Geiger. Also present: Chief
Dow and Chief Weatherill, Engineer Knobbs and Attorney Sells.
Councilman Caldwell moved that the minutes of the September 22nd meet-
ing be approved as circulated. Seconded. Councilman Doyle moved to
amend by making several corrections to the minutes. Motion lost for
lack of a second. Original motion carried with Councilman Doyle voting
no.
Four members of the Sweet Adelines presented the Mayor with a certif-
icate of appreciation.
Mr. Tom Kearns, project engineer for water improvement program presented
members of Council with a pre -design report on the Anderson Creek Trans-
mission Line, and summarized what the report contained. Mr. Kearns
then requested the Council to allow his firm to proceed with the final
design on the Phase II project. Informed Council that it appears there
will be about $90,000.00 more needed to complete the project than had
been anticipated and stated the cause is one of inflation, and in com-
paring the bids received on the reservoir, this amount appeared. Also,
a request had been made to DSHS for additional Referendum Funds for
a total of $417,000.00 and that DSHS at this time would allocate only
$380,000.00. He further reported this would be a one time grant only
and the DSHS recommended that the City wait until the April rating
period, then request the one time additional grant which should bring
the grant total to something higher than the $380,000.00. He also
stated that some funds could be saved by the City Engineer doing some of the
inspections. He suggested that the City request a franchise from the
State for boring under SR 16 at Tremont, and also obtain franchise from
Kitsap County for going along County R/W. Councilman Doyle moved to
postpone the matter until a public hearing could be held. Motion died
for lack of a second. Councilman Fulton moved to award the bid on the
reservoir in the amount of $448,770.00 to KETA Construction Company and
the Water Transmission Main in the amount of $126,682.80 to Bert Robi-
son Construction Company, to be effective when the written approval is
received from DSHS. Seconded and carried. Councilman Fulton moved to
authorize the firm of Kramer, Chin and Mayo to proceed with the final
design for the Anderson Creek Transmission Main. Seconded. Councilman
Doyle moved to amend to postpone until a study session could be held.
Motion died for lack of a second. Carried with Councilman Doyle voting
no.
Councilman Fulton moved that the Council proceed with the sale of the
general obligation bonds in the amount of $700,000.00. Seconded.
Councilman Doyle moved to amend to use Revenue Bonds for the total
project. Motion died for lack of a second. Original motion carried
with Councilman Doyle voting no. Attorney was asked if the change in
the route of the transmission line could be challenged, and he answered
in the affirmative. He also stated anyone can challenge, but this does
not mean they will be successful.
Councilman Caldwell moved to adopt Ordinance #955, setting the interest
rates, the dates of maturity and ordering the sale of the G. 0. Bonds.
Seconded. Councilman Doyle moved to postpone until all members of
Council have received a copy of the ordinance. Seconded. Motion to
amend lost with five nays and two yeas. Councilman Doyle moved to
amend the motion to state that the bonds would not necessarily be
purchased by one bidder, but would be available for many bidders. Motion
to amend lost for lack of a second. Original motion carried with
Councilman Doyle voting no.
On motion by Councilman Caldwell, seconded and carried, Council approved
the vacation of an unnamed alley requested by Mr. Walter Ainsworth at
208 Mitchell Avenue.
On motion by Councilman Fulton, seconded and carried, Council approved
the Mayor to write a letter to Mr. Robert Speilman, Valley Properties
