03/13/2000 - Regular - MinutesPort Orchard, Washington March 13, 2000 Council of the City of Port Orchard, Washington, called to regular session by Mayor Leslie J. Weatherill at 7:30P.M. at City Hall, 216 Prospect Street. Council members present: Clauson, Morrison, Wyatt, Geiger, Powers, Van Zee, and Stansbery. Staff present: City Clerk Parks, Deputy Clerk Merlino, Police Chief Townsend, City Engineer Curies, and City Attorney Montgomery. Councilman Stansbery led the audience and Council in the Pledge of Allegiance. Mayor Weatherill asked for audience comments for items not listed on this agenda. Joe Mentor, 833 Y, Bay Street property owner, (formerly Washington State Liquor Store) requested permission to allow the entrance stairs (east side of the building) extend approximately five feet into the right of way on Harrison Avenue. (The stairs were constructed prior to city approval.) Jeff Eggleston, manager of JJ's on the Bay, 833 Y, Bay Stree~ reiterated Mr. Mentor's request and also voiced a concern with a loss of parking spaces, if the stairs were to be repositioned. On motion by Councilman Morrison, seconded by Councilman Wyatt, Council denied request submitted by Joe Mentor (833 Y, Bay Street property owner), seeking permission to maintain the stairs on the east side of the building that extend into Harrison Avenue city right of way. Sergeant Randy Drake, WestNet, gave a brief and interesting overview on WestNet's current operation in Kitsap County. Sgt. Drake also presented comparable statistics on past and present drug seizures in and around Kitsap County. At 8:50 PM Mayor Weatherill called for a 10 minute recess with meeting reconvening at 9:00 PM. City Engineer Curies reported on bid opening held March 2, 2000 at 2:00 PM regarding the Pottery Avenue Sidewalk Improvement project. Three bids were received with the required bid bonds and acknowledgement to Addendum 1 as follows: Ace Paving Marenbach Construction Services Olalla Hills Excavating ENGINEER'S ESTIMATE $128,085.00 $187,438.17 $159,847.85 $169,783.00 On motion by Councilman Morrison, seconded by Councilwoman Powers, Council accepted the bidding for the Pottery Avenue Sidewalk Improvement project and awarded the bid to the lowest bidder, Ace Paving in the amount of $128,085.00. On motion by Councilman Morrison, seconded by Councilman Geiger, Council authorized Mayor Weatherill to sign contract, in the amount of $22,575.00 with Perteet Engineering for the administration and contract compliance of the Pottery Avenue Sidewalk Improvement Project. Mayor Weatherill placed into Street Committee a request, from a Farragut Avenue property owner, who has concerns regarding vegetation blocking their view. On motion by Councilman Geiger, seconded by Councilwoman Powers, Council approved the consent agenda items as follows: a. Minutes of the following Council meetings (1) February 28, 2000, regular Council meeting. (2) March 10, 2000 Study Session regarding City/County Cost Revenue Sharing b. Approval of Claim Warrants Number 32463-32555 in the amount of $129,225.67 and February 2000 Payroll Warrants Number 133284-133436 in the amount of $224,768.72. March 13, 2000 Page 2 of 2 c. Declare miscellaneous computer equipment as surplus and authorize City Treasurer to dispose of these items in the best interest of the city. (Attachment "A") d. Declare miscellaneous bicycles as surplus and authorize the Police Chief to dispose of these items in the best interest of the city. (Attachment "B") e. Resolution No. 1887 repealing Resolution No. 1688 and designating the City Engineer as the Shoreline Administrator. f. Resolution No. 1888 repealing Resolution No. 1689 and designating the City Engineer as the Administrative Variance Official. g. Applications for Public Events: (1) The Great Ball Race-July 4, 2000 (2) Mustang on the Waterfront-July 30, 2000 (3) The Cruz-August 13, 2000 On motion by Councilman Stansbery, seconded by Councilman Van Zee, Council excused Councilwoman Powers from the April 10, 2000 and June 26, 2000 City Council meetings. On motion by Councilman Stansbery, seconded by Councilman Clauson, Council declared as surplus ten firearms (Attachment "C") and directed the Police Chief to remove these items from the evidence room, and place them into the armory room until clarification of RCW 9.41.098 is obtained. On motion by Councilman Van Zee, seconded by Councilman Wyatt, Council authorized the City Engineer to coordinate with the Knights of Pythias Cemetery for the installation of 140' of stormwater culvert, in the 1000 block of Bethel Avenue, and further authorized the city to pay the necessary city permits. City Engineer reported one proposal was received, for the sidewalk replacement project, from Marenbach Construction Services, in the amount of $19.23 per foot. On motion by Councilman Morrison, seconded by Councilman Clauson, Council authorized the City Engineer to accept proposal from Marenbach Construction Services, for the sidewalk replacement project, in the amount of $19.23 per foot. The City Council set April 20, 2000 at 7:30 PM, as the date and time, for a Study Session to meet with Kitsap County representatives to discuss their facilities plan and schedule for the jail. On motion by Councilman Geiger, seconded by Councilman Morrison, Council authorized the City Engineer to proceed with the hiring of a new City Planner on a lateral wage basis. Councilman Geiger moved to reclassify the Code Enforcement/Associate Planner position from an exempt city employee to a non-exempt city employee, seconded by Councilwoman Powers. Motion failed with 6 nays and 1 aye. Councilman Geiger voting aye. Mayor Weatherill placed into the Personnel/Finance Committee, for review and recommendation, the proposal to reclassify the Code Enforcement/Associate Planner position.
