A RESOLUTION OF THE CTIY OF PORT ORCHARD, WASHINGTON,
AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL
AGREEMENT REGARDING THE ALLOCATION OF SHB 2060
SURCHARGE FUNDS TO VERY LOW INCOME HOUSING PROJECTS
IN KITSAP COUN1Y AND ITS INCORPORATED CillES
WHEREAS, in 2002 the State enacted SHB2060, 2002 Washington Laws Ch.
294, relating to funding the operation and maintenance of low income housing projects; and
WHEREAS, pursuant to the legislation, revenue generated through a surcharge
on recording documents may be used by Kitsap County and its cities and towns for housing
projects that are affordable to very low income persons; and
WHEREAS, the portion of the surcharge retained by a county shall be allocated
to very low income housing projects or units. within the county and its cities and towns
according to an Interlocal Agreement; and
WHEREAS, the Kitsap County and its incorporated cities have worked together
to prepare a set of Guiding Principals that will serve as a framework for allocating the surcharge
monies to various projects for very low income persons; and
WHEREAS, the City supports the general purpose of the Interlocal Agreement,
but has concerns with specific provisions of the agreement and in the near future intends to
propose amendments for the County and the cities to consider; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
THAT: The Mayor of the City of Port Orchard is hereby
authorized to sign the Interlocal Agreement regarding allocation of
SHB2060 surcharge funds, a copy of which is attached hereto and
incorporated by this reference; provided, unless the Agreement is
amended to the satisfaction of a majority of the Port Orchard City
Council, the Mayor shall terminate the City's participation in the
Agreement pursuant to Section 9.2, effective not later than
December 31, 2004.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
