2075 - Resolution - Retention and Removal of Significant TreesRESOLUTION NO. 207S A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, REGARDING THE RETENTION AND REMOVAL OF SIGNIFICANT TREES AT INDIGO POINTE SUBDIVISION WHEREAS, on March 22, 2004, the City Council approved the Indigo Pointe preliminary plat with conditions; and WHEREAS, one of the conditions of preliminary plat required the applicant to obtain an arborist's report regarding the retention and removal of significant trees; and WHEREAS, the applicant has provided the City with a tree evaluation report for seven significant trees, as prepared by Arbor Management Services dated March 21, 2004; and WHEREAS, the tree evaluation report identified trees numbered 3, 6, and 7 as healthy and recommends that they be retained and the report identified trees numbered 2, 4, and 5 as diseased, damaged, or hazardous trees and recommends that they be removed; and WHEREAS, the tree evaluation report identified tree number 1 as healthy but within the area where the applicant has proposed to locate underground utilities; and WHEREAS, pursuant to Zoning Ordinance No. 1748, Part C4, section 16, the City Council must approve the removal of significant trees with a diameter at breast height of 36 inches or greater; and WHEREAS, the City Council has considered the recommendations of Arbor Management Services and the requirements of Zoning Ordinance No. 1748; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: the City Council adopts the recommendations of Arbor Management Services as set forth in the report dated March 21, 2004 and approves the removal of trees numbered 2, 4, and 5, as identified in the applicant's Significant Tree Retention Plan a copy of which is attached as Exhibit A and, provided the applicant installs underground utilities for the subdivision, the removal of the tree numbered 1; and further THAT: the applicant shall comply with all applicable City requirements for the replacement of significant trees. Poulsbo, WA 98370 360-297-5560 Re: Tree Evaluation of Seven Trees for Site Development off of Goldenrod Rd. in Port Orchard. Dear Mark: In response to your telephonic request I shade a site visit to your project site on Wednesday March 17, 2004. We reviewed the site together and discussed the issues associated with the trees and the lot layout from your preliminary plat design. It is my opinion that the trees should not be adversely impacted if construction activities remain outside the drip line of Trees numbered 3, 6, and 7. The trees appear healthy at this time. It should be sufficient for the buffer to be contained to the drip line of the trees described above. This recommendation also includes that caution should be taken if any work occurs within the drip line of the trees. Every effort should be made to keep spoils, construction materials, and equipment from being placed or stored within the drip line of the trees. Regarding the trees numbered 1, 2, 4, and 5. Each of these four trees possesses defects that would categorize them as a Danger or Hazardous Tree. I have included a Data Page, which describes each of the trees I was tasked to evaluate. Certified Arborist PN-0233 Indigo Pointe data Indigo Pointe Property Tree Inventory 3/21/2004 Tree Tree # species dbh Comments Drip Line Measurement Recommendations Tree is next to Goldenrod, according to the plat design the tree will be right on the line of the new ROW that is being given to the City of Port Orchard as part of the development. The tree will also be included in the 10' Utility Easement. These two factors will make it impossible for the tree to avoid being impacted by construction activities. The trees critical root zone will be 1 DF 38.4 negatively impacted. The tree should be removed. 18' radius, 36' diameter Remove Tree According to my measurement of this tree the dbh classifies it as a Significant Tree but according to Section 16 it would not be subject to City Council approval designation because it is less than 36"dbh. The tree has codominant tops. The tops branch from one trunk into 2 trunks at 12' to 15' above ground line. Once the plat is cleared if this tree was to be retained it 2 WRC 33.4 would be more exposed and sect to failure due to this trunk abnormality. 20' radius, 40' diameter Remove Tree 3 DF 37.3 Tree appears to be healthy and should be able to be retained if no activities are allowed to occur inside the dripiine of the tree 24' radius, 48' diameter Save Tree Tree is defective.
