2082 - Resolution - Declaring Surplus the Screening EasementRESOLUTION NO. 2082 A RESOLUTION OF THE CTIY OF PORT ORCHARD, WASHINGTON, DECLARING AS SURPLUS THE SCREENING EASEMENT FOR CERTAIN REAL PROPERTY LOCATED ON SIDNEY AVENUE AND AUTHORIZING THE MAYOR TO RELEASE SAID EASEMENT. Tax Parcel Numbers: 4026-000-001-0001; 4026-000-002- 0000; and 4026-000-003-0009. WHEREAS, when the property at the intersection of Sidney Avenue and South Fireweed Street was originally platted, Sidney Avenue was a major thoroughfare and the City acquired a 15-foot screening easement on the west side of the tax parcels identified above to screen the subject properties from vehicular traffic, as illustrated on the survey that is attached as Exhibit "A" and incorporated by this reference; and WHEREAS, changes to the City's road system have resulted in a significant reduction of vehicular traffic along this portion of Sidney Avenue such that the original purpose for the screening easement no long exists; and WHEREAS, the owners of the subject properties have requested that the City release its screening easement; and WHEREAS, the City Council has determined that the screening easement on the subject properties is surplus to the needs of the City and should be released; and WHEREAS, the City Council has determined that said easement has no monetary value; and WHEREAS, the City does not intend and shall not be construed as releasing any other types of easements on the subject properties, including but not limited to screening and drainage easements on other portions of the subject properties; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The 15-foot wide screening easement located on the west side of tax parcels 4026-000-001-0001; 4026-000-002-0000; and 4026-000-003-0009, as illustrated on the survey that is attached as Exhibit "A" and incorporated by this reference, is hereby declared surplus and the Mayor is authorized to execute such documents as are necessary to release said easement.
