A RESOLUTION OF THE CTIY OF PORT ORCHARD, WASHINGTON,
DENYING KITSAP COUN1Y'S APPPUCATION FOR TEMPORARY USE
PERMITS NO. 015-03 REGARDING PARKING LOT, OFFICE SPACE,
AND STORAGE BUILDING USE
WHEREAS, Kitsap County has submitted an application for ten (10) Temporary
Use Permits (TUP 015-03) to establish parking Jots, government office space, and use of a
building for storage on a temporary basis, to meet the needs of Kitsap County Administration;
and
WHEREAS, on February 9, 2004, the City Council referred the matter to the
Growth Management Committee for further review; and
WHEREAS, the City Council Growth Management Committee met with County
representatives on February 17, 2004, to discuss the proposal in greater detail. At the meeting,
the County staff clarified that the need was due to the displacement of parking and office space
that would occur during the construction of the County Administration Building adjacent to
Division Street; and
WHEREAS, the City Council Growth Management Committee met again on
February 21, 2004, and after further review of the application made a recommendation to deny
the permits, finding the request for additional parking is not consistent with the parking plan
that was outlined in the request for Rezone for the County Administration Building, which
demonstrated that other sites were available to meet the parking needs of the County, and
also, that the County has not abided by the conditions set in prior Temporary Use Permits
issued in the area during the construction of the County jail, and
WHEREAS, at a Council meeting on March 8, 2004, the City Council discussed
the application request and the recommendation of the Growth Management Committee.
Malcolm Fleming, County Administrator, explained that the temporary parking lot would be
situated at 614 and 620 Taylor Street, where there would be minimal impact to surrounding
residential properties. The office space use would be contained within an existing former
residential structure located at 802 Sidney Avenue to provide office space for the Fire Marshal's
Office. The storage use would be located at 810 Sidney Avenue within a large garage located
adjacent to the alleyway to be used for the purpose of storing office furniture. Mr. Fleming
stated that the County's use of these sites would be temporary until the Government Use
Overlay District standards that are currently under discussion were in place, and at that time
through application review the County would agree to revise the use of these sites as
necessary, to comply with the newly developed standards; and
WHEREAS, the City Council finds and concludes as follows:

1. Kitsap County has requested temporary use permits for establishing
approximately 90 parking spaces, relocating the office of the Fire
Marshall, and use of a building for storage for a period of not less than
five (5) years.
2. The County has not fully abided by the conditions set in prior permits
relating to the construction of the County Jail, which has caused hardship
to neighboring residential properties.
3. Before the uses requested by the County are permitted, standards are
needed to address how the area will transition over time to government
use while minimizing impacts on the remaining residential sites.
4. As set forth in Zoning Ordinance No. 1748, temporary use permits are not
intended for the types of use the County has requested.
5. As set forth in Zoning Ordinance No. 1748, temporary use permits are not
intended for the duration of time the County has requested.
6. Ordinance No. 1927 contemplated that the use of the County-owned
parcels for which temporary use permits are now sought would remain
residential until such time as Government Use Overlay District Standards
were adopted and the County presented site-specific rezone requests
consistent with those standards.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
SECTION 1. Kitsap County's application for Temporary Use Permits (TUP No.
015-03) is hereby denied.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the Clerk in authentication of such passage this 22nd day of March 2004.
