A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
PROVIDING A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT
FOR THE SINCLAIR INLET MARINA TO RELOCATE DOCK "A" AND
ADD A WAVE ABATEMENT FLOAT.

KITSAP COUNTY, WASHINGTON; TOGETHER WITH FIRST CLASS TIDELANDS
ADJOINING; EXCEPT THAT PORTION CONTAINED WITHIN DEKALB STREET

TIDE LANDS ON FILE IN THE OFFICE OF THE COMMISSIONER OF PUBLIC
LANDS AT OLYMPIA, WASHINGTON.
WHEREAS, the City adopted the revised Shoreline Master Program in 1994 to regulate the
property within the jurisdiction of that Program, and
WHEREAS, the applicant is seeking a Shoreline Substantial Development Permit
approval JARPA 137-02, proposing to relocate Dock "A" from the southwest corner of the Sinclair Inlet
Marina, to the northeast corner of the Sinclair Inlet Marina, and to add approximately 900 s.f. of widened
dock area for wave abatement, and
WHEREAS, the project has received a Mitigated Determination of Non-Significance by
the City of Port Orchard on April 22, 2002, for the project, and
WHEREAS, the applicant has prepared a Biological Evaluation, dated April 3, 2002 to
consider potential impacts to marine habitat in regards to listed endangered species, and
WHEREAS, a Hydraulic Project Approval was granted for this project by the Department
of Fish and Wildlife on May 13, 2002, and

WHEREAS, the National Marine Fisheries Service, (NOAA Fisheries) has reviewed the
Biological Evaluation "BE" for this project, and concurs with the determination of the report of "may affect,
not likely to adversely affecf', for Puget Sound Chinook salmon, which are ESA threatened listed species.
The Army Corps has reviewed this determination and has issued approval, dated February 25, 2003, and
WHEREAS, the City Council has determined that the proposal and granting of a
Shoreline Substantial Development Permit is consistent with the intent of the Shoreline Management
Program, now therefore,
THE COUNCIL OF THE CITY OF PORT ORCHARD DOES RESOLVE AS FOLLOWS:
The City of Port Orchard recommends approval to the Department of Ecology for the
granting of a Shoreline Substantial Development Permit to the owners of Sinclair Inlet Marina to allow for the
relocation of dock "A" from the SW corner of the marina to the NE corner of the marina and to add 900 s.f. of
additional dock for the purpose of wave abatements proposed, in JARPA/SDP 137-02, subject to the
following conditions:
1. Work shall be accomplished per plans and specifications entitled, Relocate
Dock "A" from SW Corner of marina to NE Corner of the Marina, figures 1-4
dated January 17,2002. All proposals as approved, are considered
conditions of approval, unless otherwise stated or as modified with required
approvals.
2. Prior to commencement of work, a building permit for this project shall have
been issued from the City of Port Orchard.
3. All work shall comply with the Department of Fish and Wildlife within the
Hydraulic Project approval dated May 13, 2002.
4. All work shall comply with the Army Corps of Engineers requirements as
stated in the approval letter dated February 25, 2003.
5. Approval from Department of Ecology shall be required prior to any work.
