A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
PROVIDING A SHORELINE SUBSTANTIAL DEVELOPMENT PERMIT
FOR THE CITY OF PORT ORCHARD TO ALLOW FOR PORTIONS OF
THE PROPOSED EXPANSION OF THE PORT ORCHARD JOINT
WASTEWATER FACILITY TO BE WITHIN THE SHORELINE
ENVIRONMENT.

WHEREAS the City adopted the revised Shoreline Master Program in 1994 to regulate the
property within the jurisdiction of that Program; and
WHEREAS, the applicant is seeking approval of a Shoreline Substantial Development
Permit application, JARPA file No. 139-02, to allow for the construction of certain elements of the
proposed expansion of the Port Orchard joint Wastewater facility to be within the shoreline environment;
and
WHEREAS, the overall plant expansion project will result in structural improvements
throughout the site that will provide for the ability to process and treat wastewater flows and meet the
demands of growth in the South Kitsap area; and
WHEREAS, the project has received a Determination of Non-Significance by the City of
Port Orchard; and
WHEREAS, the subject property has a shoreline designation of "Urban and is designated
on the City's Shoreline Master Comprehensive Plan Map as "Public and Community Spaces, and is
zoned "Public Facilities", and that a Sewer Treatment Plant is listed as a permitted use in this zone; and
WHEREAS, the City Council has determined that the proposal and granting of a Shoreline
Substantial Development Permit is consistent with the intent of the Shoreline Management Program, and
Comprehensive Plan, and as such, will further the protection of the public general health, safety and welfare,
now therefore,

THE COUNCIL OF THE CITY OF PORT ORCHARD DOES RESOLVE AS FOLLOWS:
The City of Port Orchard recommends approval to the Department of Ecology for the
granting of a Shoreline Substantial Development Permit to the City of Port Orchard to allow for the
construction of certain elements of the Wastewater Treatment Plant expansion project to be within 200 ft. of
the shoreline of Sinclair Inlet, as described in Exhibit"/>!', subject to the following conditions:
1. All project proposals are subject to the conditions of approval for all
required permits, unless modified herein.
2. The requirements of Fire District 7 shall be met, as listed in the
memorandum dated April 2, 2003.
3. Prior to construction, the City shall address the following:
a) Landscape Plan, consistent with the landscaping standards of the
City's Zoning Ordinance No. 17 41, to address appropriate landscape
mitigation between the Treatment Plant site and the neighboring
Veteran's Home.
b) Stormwater Drainage Plan, consistent with the City's Stormwater
Ordinance No. 1736, to address increased runoff from the site
expansion.
c) Right-of-way permit from Kitsap County for necessary improvements
located within the County right-of-way.
d) Building elevation plans.
