ORDINANCE NO. 037-21
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ACCEPTING THE TERMS AND CONDITIONS FOR CONTRACT NO. C085-21
WITH THE WASHINGTON STATE PUBLIC WORKS BOARD FOR AN
EMERGENCY LOAN FOR THE POTTERY SEWERAGE LIFT STATION
EMERGENCY REPAIR PROJECT AND AUTHORIZING THE MAYOR TO
EXECUTE THE CONTRACT; PROVIDING FOR SEVERABILITY AND
PUBLICATION; AND SETTING AN EFFECTIVE DATE.
WHEREAS, on June 22, 2021, the City of Port Orchard City Council adopted Resolution
No. 044-21, formally declaring the existence of an emergency related to the repair of the
Pottery Sewerage Lit Station; and
WHEREAS, on July 9, 2021, the City of Port Orchard Public Works Department was
notified by Washington State Department of Commerce that the City was successful in
obtaining a $500K Loan through the Public Works Board Emergency Fund; and
WHEREAS, on, September 1, 2021, the City received Contract No. PE22-96103-000 from
the Washington State Public Works Board for the loan; and
WHEREAS, the City Council has determined it to be in the best interest of the City to
enter into Contract No. C085-21 with the Public Works Board for the Pottery Sewerage Lift
Station Emergency Repair Project; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby approves of and authorizes the Mayor to execute
Contract No. C085-21 with the Washington State Public Works Board for the Pottery Sewerage
Lift Station Emergency Repair Project, inclusive of the terms and conditions of Public Works
Board Emergency Loan Contract No. PE22-96103-000.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law.
