2030 - Resolution - Additional Right-of-Way from Commercial Developmentand therefore, RESOLUTION NO. 2030 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON ESTABLISHING A REQUIREMENT FOR ADDITIONAL RIGHT OF WAY FROM COMMERCIAL DEVELOPMENT. WHEREAS, the City of Port Orchard strives to plan for the future needs of the community; WHEREAS, the City of Port Orchard anticipates the eventual widening of Bethel Road, now, THE COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE THAT: Future applications to reclassify land use of property along Bethel Avenue from its intersection with State Highway 166 to the south City limits will be reviewed as to the future impact upon Bethel Avenue. If appropriate, the City Council will require additional right-of-way to be dedicated to the City as a condition of the land use reclassification. The additional right-of-way will be 20 feet wide for the length of the property abutting Bethel Avenue and will be used for the eventual widening of the road. If the City Council requires right-of-way dedication, the property transfer shall be completed prior to issuance of any grading or building permit. If the property reverts back to its original land use, the City shall retain the dedicated property.
