2042 - Resolution - Kitsap County Admin Building ConstructionRESOLUTION NO. 2042 A RESOLUTION OF THE CTIY OF PORT ORCHARD, WASHINGTON EXEMPTING FROM THE REQUIREMENTS OF THE CITY'S VIEW PROTECTION ORDINANCE THE PROPOSED CONSTRUCTION OF THE KITSAP COUN1Y ADMINSITRATION BUILDING, APPLICATION R-1147 WHEREAS, in December 1999, the City Council adopted Ordinance No. 1785, which created a View Protection Overlay District and established related regulations; and WHEREAS, Section 12 of the View Protection Overlay District Ordinance sets forth a process by which a property owner may petition the Council to have his property exempted from the requirements of Ordinance No. 1785, provided the property owner meets the criteria listed in the Ordinance; and WHEREAS, the property owner and project applicant, Kitsap County, is seeking an exemption from the view protection requirements in order to construct an administration building within the View Protection Overlay District and it has submitted a View Protection Analysis indicating that the proposed building meets the exemption criteria; and criteria; WHEREAS, City Staff concurs that the proposed building meets the exemption WHEREAS, being fully advised, the Council finds and concludes as follows: FINDINGS 1. The building will provide public amenities including pedestrian access to the waterfront and public views and spaces. 2. The building will create physical improvements that enhance the surrounding neighborhood and creates an inviting atmosphere for residents and visitors. 3. The project will provide a permanent home for Kitsap County staff and thus maintain the economic base and diversity of jobs and businesses in Port Orchard. 4. The building will not impact the views from the adjacent properties that are not otherwise owned by the applicant. 5. The building will be constructed in a manner that greatly minimizes, if not eliminates, any reduction of solar access to neighboring lots. CONCLUSIONS Resolution No. 2042 Page 2 of 2 1. Granting an exemption will not be detrimental to the public health, safety, or welfare or create significant adverse effects to other properties and improvements in the view protection overlay district. 2. Granting an exemption conforms with the policies and goals of the Comprehensive Plan. 3. The view of adjacent property owners will not be obstructed or reduced if the property is exempted. 4. Granting an exemption will not reduce the solar access of neighboring lots, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON RESOLVES AS FOLLOWS: Section 1. Based upon the recommendations of City Staff and the Planning Commission and the findings and conclusions contained herein, the applicant, Kitsap County, is granted an exemption from the view protection guidelines and requirements for the construction of an administration building, application R-1147. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the Clerk in authentication of such passage this 22nd day of September 2003. LESLIE J.
