RESOLUTION NO. 2049
A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
PROVIDING A CONDmONAL SHORELINE SUBSTANTIAL DEVELOPMENT
PERMIT FOR KITSAP TRANSIT TO ALLOW FOR THE RECONSTRUCTION OF
THE EXISTING FERRY DOCK FAGLITY, AND SUPPORTING UPLAND
IMPROVEMENTS.
WHEREAS, the City adopted the revised Shoreline Master Program in 1994 to regulate the
property within the jurisdiction of that Program; and
WHEREAS, the applicant is seeking approval of a Conditional Shoreline Substantial
Development Permit application, JARPA file No. 154-03, CUP/SDP 011-03, to allow for the replacement of
the existing feny dock facility to improve the ability of the site to provide connections between Kitsap
Transit's Passenger Ferry and Bus Systems, consistent with the regulations for individuals with disabilities,
and address safety issues associated with the degradation of the existing pier and dock; and
WHEREAS, The project has received a Determination of Non-Significance by the City of
Port Orchard; and
WHEREAS, The applicant has prepared a Biological Evaluation, dated October 2003, to
consider potential impacts that the project may have on threatened or endangered species; and
WHEREAS, the Department of Fish and Wildlife granted the applicant a Hydraulic
Project Approval for this project on November 12, 2003; and
WHEREAS, on December 22, 2003 the City Council held a public hearing regarding the
Conditional Shoreline Substantial Permit application; and
WHEREAS, the City Council has determined that the proposal and granting of a
Conditional Shoreline Substantial Development Permit is consistent with the intent of the Shoreline
Management Program; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
The City of Port Orchard recommends approval to the Department of Ecology for the
granting of a Conditional Shoreline Substantial Development Permit to Kitsap Transit to allow for the
reconstruction of the ferry dock terminal as provided in the application dated October 1, 2003, except as
modified by the WSDFW HPA dated November 12, 2003, subject to the following conditions:

1. Prior to commencing work, a building permit for this project shall have
been issued from the City of Port Orchard;
2. All work shall comply with conditions set forth in the Department of Fish
and Wildlife's Hydraulic Project Approval dated November 12, 2003.
3. Prior to commencing work, the applicant shall receive all necessary
permits and approvals from National Marine Fisheries Service and the
Army Corps of Engineers.
4. All work shall comply with the "Conservation Measures" set forth in the
Biological Evaluation, dated October, 2003, or as may be approved by the
National Marine Fisheries Service or the Army Corps of Engineers.
5. Approval from Department of Ecology shall be required prior to any work.
